HomeMy WebLinkAboutOrdinance - 1140-1951 - Establishing The N Building Line On Portion Of 34Th St. - 09/14/195109-IL+-lSSI ORDINANCE NO. 1140 C9-2.<2> -\~51 AN ORDINANCE ESTABLISHING THE NORTH BUILDING LINE ON THAT PORTION OF 34TH STREET BETWEEN THE NORTH-SOUTH HALF SECTION LINE OF SECTION 15, BLOCK B, LUBBOCK COUNTY, TEXAS, SAID SEC- TION LINE BEING IN MEMPHIS AVENUE, .AND THE WEST SECTION LINE OF SECTION 17, BLOCK B, LUBBOCK COUNTY, TEXAS, IN SLIDE ROAD; ALSO FROM THE NORTH-SOUTH SECTION LINE COMMON TO SECTIONS 15 AND 13, BLOCK B, LUBBOCK COUNTY • TEXAS. WHICH IS IN INDIANA A VENUE, TO A POINT 348. 5 FEET EAST OF THE SAID COMMON NORTH- SOUTH SECTION LINE COMMON TO SAID SECTIONS 15 AND 13, BLOCK B AND ESTABLISHING THE SOUTH BUILDING LINE ON THAT PORTION OF 34TH STREET BETWEEN THE NORTH-SOUTH SECTION LINE COMMON TO SECTIONS 14 AND 16, BLOCK B, LUBBOCK COUNTY, TEXAS, IN IN'DIANA AVENUE. TO THE NORTH-SOUTH HALF SECTION LINE OF SAID SECTION 16, BLOCK B, LUBBOCK COUNTY, TEXAS, LOCATED IN MEMPHIS AVENUE; DEFINING THE TERM, "BUILDING LINE AND STREET RIGHT-OF-WAY LINE"; PROVIDING FOR SETBACKS ACCORDING TO ZONING ORDINANCE NO. 661, PROVIDING THAT NO BUILDING OR OTHER STRUCTURE SHALL BE REPAIRED OR PLACED BETWEEN THE BUILDING LJ.N'ES EXCEPTING PUB- LIC UTILITIES ON PUBLIC PROPERTY WITHIN THE BUILDING LINES; REQUIRING THAT STRUCTURES CONFORM TO SUCH BUILDING LINES WITHIN FIVE (5) YEARS; AUTHORIZING PUBLICATION OF THE CAPTION OF THIS ORDINANCE. WHEREAS, he governing body finds that public convenience, safety and neces sity in the C ity of Lubbock require that building lines or right-of-way lines be established on that part of 34th Street described in the caption and b ody of this ordinance to prevent repair and placement of structures and trees in the area designated between the building lines so established, such areas being ultimately required in the public inter,est to extend, open, widen and otherwise improve the said 34th Street, which the governing body finds to be adequate to meet requirements for street purposes, and, WHEREAS, the gov erning body finds that the establishment at this time of such lines will promote economy in the extension and widening of said 34th Street, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKz SECTION 1. THAT public necessity, convenience and safety in the City of Lubbock require the extension, opening, widening, construction and improve- _ment of that part of the street hereinafter designated, within the building lines herein established. SECTION 2. That a building line is her eby established on the North side of 34th Street and on the South side of 34th Street as follows: On the North side of said 34th Street the building line is established as follows: BEGINNING at a point in the North-South half section line of Section 15, Block B, Lubbock County, Texas, said point being fifty feet (501) North of the South line of said Section 15, Block B; THENCE West a distance of 7920 feet more or less, parallel to and fifty feet (501} distant from the South line of' Sections 15 and 17, Block B, Lubbock County, Texas, to a point in the West section line of said Section 17, Block B, and in Slide Road. Also on the North side of said 34th Street: BEOINNING at a point in the West section line of Section 13, Block B, Lubbock County, Texas, said point being forty-seven feet (471) North of the South section line d. said Section 13, Block Bl THENCE East a distance of 248.5 feet more or less, parallel to and forty-seven feet (47') distant from the South section line of said Section 1.3,. Block B, ~o a point; THENCE Southeasterly a distance of 102.2 feet more or less to a point, said point being in the present North property line of 34th Street and forty feet (4Q1) North of the Soutp. section line of said Section 13, Block B. On the South side of said 34th Street,. the building line is established as follows: BEGINNING at a point in the North-South section line in Indiana Avenue common to Sections 16 and 14, Block B, Lubbock County, Texas, said point being fifty feet (50'' South of the North line of said Section 16, Block B; THENCE West a distance of 2640 feet more o·r less, parallel to and fifty feet (50') distant from the North line of said Section 16, Block B, to a point in the North-South half section line of said Section 16, Block B, in Memphis Avenue. • SECTION 3. The term, "building line, 11 as used herein shall be const.rued to mean rtstreet right-of-way line, 11 and the set-back requirements under Zoning Ordinance No. 661 shall apply in addition to the right-of-way lines, or building lines, herein established, it being the intent and purpose of this Ordin- ance t~ preserve all land within the building lines herein established for ultimate street purposes. SECTION 4. That no building or other structure shall be erected, re- erected, or substantially repaired, and no new structures 01; parts thereof shall be erected or re -erected on that part of the street herein designated within said lines herein established. SECTION s. That all structures now extending into or being located within or between said building lines herein established are hereby required to conform to the lines herein established within five (5) years from the effective date of this Ordinance. SECTION 6. That the provisions of this Ordinance prohibiting the placing of structures between the building lines herein established shall not apply to any officer, agent, employee or other person duly authorized by the City of Lubbock, when such work relates to utility extensions or street improvements, fjl ( PROVIDED this provision shall not be construed as authorizing any such per- sons to enter upon private property lying between such lines until the same has been dedicated to public use or otherwise acquired for such purpose. SECTION 7. The City Secretary is hereby directed to cause publication of the descriptive caption of this Ordinance as an alternative provided by law. AND IT IS SO ORDERED.
