BE IT ORDAINED BY THE CITY COMMISSION OF THE ~ITY OF LUBBOCK: irv\ SECTION 1, It shall be unlawful foz' any person, firm, or corporation Cf ,'-0 * \ to display any goods, wares, merchandise, or other commodity for sale upon · any sidewalk, sidewalk area, or parkway in the City of Lubbock at a distance greater than fourteen (14) inches from the wall of the building in which such person, firm, or corporation is doing business. It shall be unlawful for any person, firm, or corporation to place, leave or permit any employee to place or leave any box, barrel, crate, can or other container on any sidewalk, sidewalk area, or parkway in the City of Lubbock. SECTION 3. Any person, firm, or corporation violating the provisions, or any provision, of Section 1 or Section 2 of this ordinance is bereby declared to be guilty of maintaining a nuisance and, upon conviction, shall be fined in any sum not exceeding Two Hundred Dollars ($200). SECTION 4. Sections l and 3 of this ordinance shall not apply to any person, firm, or corporation wbo, in connection with the actual and bona fide transportation of the commodities mentioned in Section ·z, shall place or leave the same upon 'the sidewalk, sidewalk area, or parkway during the time such commodities are being in fact loaded or unloaded from a vehicle engaged in transporting such commodities to or from premises occupied by or under the control of any such person, firm, or corporation, and it is necessary in the course of such transportation to cross or handle such commodities on or over a sidewalk. AND IT IS SO ORDERED.
