ORDINANCE NO. 1130 0.9-14 -l.9.s--,---
AN ORDINANCE REGULATING THE CONSTRUCTION. RECONSTRUCTIO
AND REPAIR OF CURBS ABUTTING NON-COMMERCIAL PROPERTY IN THE
CITY OF LUBBOCK; PROHIBITING THE CONSTRUCTION, ALTERATION OR
REMOVAL OF CURBS ABUTTING NON-COMMERCIAL PROPERTY WITHOUT
A PERMIT GRANTED BY THE BUILDING INSPECTOR; LIMITING THE PUR-
POSE OF DRIVEWAYS TO INGRESS AND EGRESS TO STREETS FROM PRI-
VATE PROPERTY; LIMITING WIDTH OF DRIVEWAYS TO THIRTY (30) FEET;,
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1: That no person, firm or corporation shall construct, recon-
struct, alter, repair, remove or replace any curb abutting non-commercial
property within the City of Lubbock without first obtaining from the Building
In~pector a building permit so to do.
SECTION 2. The Building Inspector is hereby prohibited from issuing
any permit for the construction, reconstruction, alteration, repair, removal
or replacement of any curb within the City of Lubbock, where the proposed
improvement is for any purpose other than the construction of a bona fide drive-
way affording ingress and egress to private property directly from the street
abutting such private property, which driveway shall not exceed thirty feet (301)
in width.
SECTION 3. Any person who shall violate any of the provisions of Section
1 of this ordinance shall, upon conviction, be fined in any sum pot exceeding
Two Hundred Dollars ($200).
AND IT IS SO ORDERED.
