AN ORDINANCE REDUCING THE. BUILDING SET -BACK LINE ON THE
SOUTH PART OF 23D STREET BETWEEN AVENUE "J" AND AVENUE "H"
SO AS TO RE-ESTABLISH THE BUILDING LINE ON THE SOUTH SIDE TO CON-
FORM TO THE BUILDING LINE HERETOFORE ESTABLISHED BY THE
LAWFUL CONSTRUCTION OF EXPENSIVE BUILDINGS AND STRUCTURES,
AND REPEALING THAT PART OF EXISTING CONFLICTING PROVISIONS.
WHEREAS, for many years, m.d prior to the passage of an amendment
to the Zoning Ordinance relating to set-back lines, the street known as 23d
Street between Avenue J and Avenue H, and the block east of Avenue H, several
buildings were constructed upon the then existing property line. allowing for a
street fifty {50) feet in width between said property lines, and to require con-
templated improvements upon abutting property to set back beyond existing
property lines would be inequitable to owners of vacant abutting property due
to the existence of buildings constructed which, if required, would produce an
abnormal, irregular set-back line; and the City Commission finds that by
reducing the set-back line on the South side of 23d Street between Avenue Hand
Avenue J from a distance of thirty-seven and one-half {37-1/2) feet from the
c enterline of the existing paved street.to a distance of twenty-five (25) feet,
affected property owners would not be discriminated against, and that the
street as it now exists is adequate to meet public needs for street purposes
within the reasonably foreseeable future, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the building set-back line on the South side of 23d Street
between Avenue H and Avenue J is hereby modified and re-established to coin-
cide with the South property line of 23d Street between Avenue Hand Avenue J,
the same being twenty-five {25) feet South of the centerline of said street.
SECTION 2. That part of every ordinance in conflict with the provisions
of Section 1 of this ordinance is hereby repealed, but the provisions of this
ordinance shall never be construed in any manner to modify or otherwise affect
the provisions of existing ordinances as they relate to other building lines.
AND IT IS SO ORDERED.

sion this 2nd--day of Augu.st, l-951.
