CAPTIONED: "AN ORDINANCE AMENDING ORDIN- ANCE NO. 726 OF THE CITY OF LUBBOCK, CAPTIONED: 'AN ORDINANCE ESTABLISHING BUILDING LINES ON 19TH STREET ON THE SOUTH SIDE FROM A POINT APPROXIMATELY TWO HUNDRED {2001) FEET WEST OF THE WEST PROPERTY LINE OF COLLEGE AVENUE EASTWARD TO EAST AVENUE D (DATE AVENUE); AND ON THE NORTH SIDE OF 19TH STREET FROM COL- LEGE AVENUE EASTWARD, TO THE EASTERN CITY LIMITS IN THE APPROXI MATE VICINITY OF EAST AVENUE D {DATE AVENUE); IN ACCORDANCE WITH A COMPREHENSIVE STREET IMPROVEMENT PROGRAM, ETC. 1 SO AS TO CONFORM SAID BUILDING LINES TO REV'JSED REQUIREMENTS OF THE HIGHWAY DEPARTMENT AND RELOCATE THE RIGHT-OF-WAY FOR U. S. HIGHWAY 62 EAST OF TEXAS AVENUE IN ACCORDANCE WITH A COMPRE- HENSIVE STREE.T IMPROVEMENT PROGRAM, DECLARING THAT PUBLIC CONVENIENCE, NECESSITY AND SAFETY REQUIRES THE EXTENSION, CON- STRUCTION AND IMPROVE.MENT AND SECURING OF THE RIGHT-OF-WAY BETWEEN SAID BUILDING LINES HEREIN ESTABLISHED, FOR U. S. HIGH- WAY 62; PROHIBITING PLACING OF BUILDINGS AND STRUCTURES OR REPAIRS OR RECONSTRUCTION BETWEEN SAID LINES ESTABLISHED BY THIS ORDINANCE; PROVIDING THE TIME TO CONFORM AND PROVIDING PENALTIES AND EXCEPTIONS;" SO AS TO CORRECT THE DESCRIPTION AND LOCATION OF THE CENTER LINE AND BUILDING LINES BETWEEN TEXAS AVENUE AND AVENUE F.; BRINGING ALL AMENDMENTS FORWARD IN THIS ORDINANCE SO THAT THE BUILDING LINE DESCRIPTIONS ARE COMPLETE; AUTHORIZING PUBLICATION OF.THIS CAPTlON TOGETHER WITH PENALTY CLAUSE. WHEREAS, the City Commission of the City of Lubbock in the public interest has entered upon a comprehensive plan with the State of Texas, the Texas State Highway Commission, to extend, open, widen, straighten and improve certain streets a nd highways within the City of Lubbock, and the City of Lubbock has heretofore established building lines on a part of 19th Street, and, WHEREAS, the City Commission finds that public convenience, safety and necessity in the City of Lubbock require that said building lines be revised and extended in part on 19th Street between Texas Avenue East to Avenue A, and that 19th Street be extended. opened, widened, constructed and improved, and the right-of-way secured, and that the designation of building lines is required in the interest and preservation of public safety.,and to prevent structures and trees from being placed within the area between said building lines for said right-of- way, THE;REFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That public necessity, convenience. and safety in the City of Lubbock requires the extension. opening, widening, construction and improve- ment of 19th Street between Texas Avenue and Avenue A, within the building lines herein established. SECTION 2. That a building line is hereby established on the North side o£ 19th Street from a point beginning at a point in the East property line of College Avenue on the North side, and extending Eastward to the approximate intersec- tion of Date Avenue and the P. &: S. F .. Railway to a point in the South property line of Survey Three (3), Block 0 SECTION 4, That all station numbers referred to herein pertain to station numbers on the State Highway Department Base Line extended, and all referen- ces to section lines, corners of sections, and property line references are as surveyed and established on the ground by the City Engineering Department of the City of Lubbock. Between Texas Avenue and Avenue F, the above described building lines are parallel to and forty-five (45) feet from the center line of 19th Street, as established by the State Highway Department, said forty-five (45) feet being measured perpendicular to said center line both North and South, SECTION 5, That no building or other structure shall be erected, re- erected or substantially repaired, and no new structures or parts thereof shall be erected or re-erected on 19th Street within said lines established by Sections Z and 3 of this Ordinance. SECTION 6. That all structures on 19th.Street now extending within such building lines established by sections 2 and 3 of this Ordinance are hereby required to conform to the new building lines established by Sections 2 and 3 of this Ordinance within one (1) year from the effective date of this Ordinance. SECTION 7. That it shall be unlawful for any person to erect, reconstruct or substantially repair any building or other structure, or to erect or re-erect any new building or other structure within or between the building lines estab- lished by Sections 2 and 3 of this Ordinance, and whoever shall violate any provision of this section shall, upon conviction, be fined not exceeding Two Hundred Dollars ($200}. SECTION 8. That the provisions of Section 7 of this Ordinance shall not apply to any officer, agent, anployee or other person duly authorized by the State of Texas, and/or the City of Lubbock, when performing any improvement, pursuant to the widening, straightening or extension of the street and/or right- of""'Way contemplated by this Ordinance. SECTION 9. That the building lines established by Sections 1 and 2 of Ordinance No, 726, as amended by Ordinance No. 1029, are re-written herein / \ f --.. :: - so that this Ordinance contains the amendments as made by Ordinance No. 1029 and is complete within 1he provisions of this Ordinance and supersedes Ordinan- -ces Nos. 726 and 1029. SECTION 10. The City Secretary is hereby directed to cause publication of the descriptive caption of this Ordinance, together with the penalty clause (be- ing Section 7), as an alternative provided by law.· AND IT IS SO ORDERED.
