HomeMy WebLinkAboutOrdinance - 1059-1951 - Establishing Building Lines On Part Of 50Th St. - 02/08/1951lfo!-oe -1..951 ORDINANCE NO. ~9 02-2..2.-1 ' AN ORDINANCE ESTABLISHING BUILDING LINES ON THAT · PART OF 50l'H STREET FROM rrs INTERSECTION WITH THE PRESENT CrrY LIMIT LINE 2640 FEET WEST OF THE WEST LINE OF SURVEY 10, BLOOK B OF THE COUNI'Y OF LUBBOOK, TEXAS, TO ITS INTERSECTION WITH THE PRESENT CITY LIMIT LINE 150 FEET EAST -OF THE EAST RIGHT- OF-WAY LINE OF AVENUE A AND PROHIBITING PLACING OF BUILDINGS OR orHER STRUCTURES OR REPAIR OR RECONSTRUCTION BETWEEN SAID BUILDING LINES, IN FURTHERANCE OF WIDENING, STRAIGHTENING, AND IMPROVING SUCH PARTS OF STREET, AND ESTABLISHING TIME FOR EXISTING STRUCTURES TO CONFORM: WHEREAS, Article 1105a, Revised Civil Statutes or Texas provides for the establishment or building lines on any part or side of ~ street in the City or Lubbock, said City of Lubbock having a popuJ.ation of more than 15,000,and1 . ., WHEREAS, the City Commission or the City of Lubbock desir~s to establish building lines in connection with the widening, straightening and improving or that part of 50th Street from its intersection with the present City Limit Line 2640 feet Wast of the West line of Survey 101 Block B of the County of Lubbock, Texas, to its intersection vith the present City Limit Line 150 feet East of the East right-or-~ line of Avenue A to prevent further buildings, structures, or improvements of any nature being placed within the areas required for suoh widening, straightening and improving this street, and, WHEREAS, widening, straightening and improving said streets and Avenues and the establishment of such building lines are necessar,r and will ultimately provide streets of desirable and adequate width which will aid in relieving heavy traffic in congested areas in accordance with the City's comprehensive plan and the City Planning Commission has recommended such improvements, THEREFORE, BE IT ORDAINED BY THE Cr.l'Y COMMISSION OFT~ CITY OF LUBBOOK, TEXAS: SECTION 1. THAT a building line is hereby established on the North side from its intersection with the present City Limit Line 2640 feet West of the West · line of Survey 10, Blook B of the County ot Lubbock, Texas, to its intersection with the present City Limit Line 150 feet East of the East Right-of-w~ line ~f Avenue A and on the South side from its intersection with the present City Limit Line 150 feet West of the West Right-or-w~ line of Avenue Q to its intersection with the present City Limit Line 150 feet East of the East Right-of-W81 line of Avenue A, to-wit: On the North side or such street beginning at a point 45 feet North of the South line of Survey 14, Block B of the County of Lubbock, Texas, said point being 2640 feet West · of the .West line of SurveylO, Block B of the County ot Lubbock, Texas; THENCE East along~a line parallel to and 45 feet North of the / South Line of Block B of the County of Lubbock, Texas, 13,484 feet more or \ less to a point in the present City Limit line 150 feet East or the~East.Right­ of-li8Y' line of Avenue A and 45 feet North of said South line of Blo{:,J.t B of the County of Lubbock, Texas. On the South side or such street beginning at a point 45 feet South de the South line of Survey 10 of Block B of the County or Lubbock, Texas, said point lying in the present City Limit line 150 feet West of the West Right-ot-way line of Avenue Q; THENCE East 6,445.7 feet more or less along a line parallel to and 45 feat South of the South line or Block B of the County of Lubbock, Texas, to a point in the present City Limit Line 150 feet West or the West Right-of-way line of Avenue A and 45 teet South of said South line of Block B or the County of Lubbock, Texas. · SEO~ION 2. THAT no building or other structure shall be erected, reconstructed, or· substantially repaired and no new building or other structure or part thereof shall be erected or re-erected between or within the building lines established by this ordinance. SECTION 3. THAT all strtictures on and between any building line estab- lished by this ordinance or extending in 'Whole or in part 'Within such building lines, are hereby required to conform to the neli building lines established by Section 1 within a period o£ not more than five years from the effective date or this ordinance. .,_ l~ --.._ ----,_ .......,,.._~ SECTION 4. It shall be unlawful for any person, firm, corporation, trustee or any authorized agent or representative thereof to erect, reconstruct or substantially repair ~ building or other structure, or to erect or to re- ereot ~ new building or other structure within or between the building lines established and described in Section 1 of this ordinance and whoever shall violate ~ provisions or this section shall, upon conviction, be fined not exceeding $100.00. SECTION 5. The provision of Section 4 of this ordinance shall not apply to any officer, agent employee or other.person duly authorized by the State of Texas and/or the City of Lubbock when p~rtorming any employment pursuant to the widening, straightening or extension of rthe street and/or right-ot-way con- templated by this ordinance. l AND IT IS SO ORDERED.
