THIS ORDINANCE SHALL NOT BE CONSTRUED AS REPEALIW OR AMENDING ORDINANCE HO. 661;
THAT THE ZONING AND BUilDING ORDINANCE SE']BACK REQUIREMENTS SHALL BE DETEBMINED

SECRErARY IS DIRECTED TO INDICATE ON waRGIN OF EACH ORDINANCE THAT IS HEREBY AMEND-
ED THAT SAME HAS BEEN AMENDED; AND DIRECTING THE CITY SECRErARI TO PUBLISH THE
DESCRIPI'IVE CAPtiON WITH THE PENALTIES, AS SEr Otrr IN SECTION EIGHT (8) OF THIS
ORDINANCE.
WHEREAS, Avenue "A'' froDl Thirteenth (13th) Street to Sixteenth (16th) street
has established building lines on the East and West sides of said Street, and,
WHEREAS, the Highway Department ot the State ot Texas has intentions of wide-
ning said Avenue "A" from Thirteenth (13th) Street South to Sixteenth (16th) Street I
and to construct an Underpass under the Panhandle and Santa Fe Rail~ tracks where
said tracks intersect Avenue •A• and desires additional right-~t-way on the East
and West sides ot Avenue •A," and,
WHEREAS, the Highway Department of the State of Texas desires that no struc-
ture or building be erected within ten (10') feet of the proposed Underpass on
Avenue "A," and,
WHEREAS, it has become necessary 1n th~public interest, due to the chang80

"A" between Thirteenth (13th) Street and Sixteenth (16th) Street, THEREFORE:
BE IT ORDAINED BY THE CITY COAIU:SSION OF THE CITY O.F LUBOOCK:
SECTION 1. THAT, the established building line for the West side c£ Avenue
"A" between Thirteenth (13th) Street and Sixteenth (16th) street shall be and is
hereb,y established as follows, to-witl ·
"Section 1. (West Side)' BEGINNING at a point in the present West property
line of Avenue "A" at the South property line of Thirteenth (13th) street; THENCE
West Ten(lO 1 )Feet; THENCE South parallel and 17.5 Feet West of the West propert7
line of Avenue "AJ" said line also being parallel to and 107.5 Feet East of the
East propert7 line of a twenty (20 1) toot alley in Block 157, 173 and 189, to a
point in the South oroperty line of Lot Eleven (11), Hl.ock 189, Original Town of
Lubbock,~Texs:s; 0

SECTION 2. THAT, the building line for the East side of Avenue "A" between
Thirteenth (13th) Street and Sixteenth (16th) Street shall herea.fter be and is

"Section 2. (East Side). BIDINNim at a point on the East property line
of Avenue "A" at the intersection ot the South property line of Thirteenth (13th)
Street as produced from the West; THENCE East Thirty-five (35') Feet to a point
in the South property line of Lot Ten (10),. Block 142, Original Town, Lubbock,
Texas, 42.5 Feet East ot the East property line ot Avenue 11A;" THENCE South 42.5
Feet from and parallel to the East property line or Avenue 8.!" across Block 158,
the Railroad right~r-ny and Block 190, to a point in the South property line of
Lot Ten (10), Block 190, Original Town, Lubbock, Texas; said point being 142.5
Feet East of the East property line of Avenue "A;• THENCE West Thirty•five (.35 1}
Feet to a point 7. 5 Feet East of the East property line or Avenue II A."
SECTION 3. THAT, the bt,Jilding lines established by Sections One (1) and Two
(2) of this Ordinance shall be and constitute the building lines on Avenue "A" be-tween~ Thirteenth (13th) Street and Sixteenth (16th) street in lieu of and herebT
amending and modit.Jing all Ordinances that established building lines on the East
and West sides of Avenue "A" betnen Thirteenth (13th) Street and Sixteenth (16th)
Street. Any and all Ordinances which shall establish boun:iar;y lines on azw street
other than Avenue "A11 between Thirteenth (13th) street and said Sixteenth (16th)
Street contiain provisions concerning the establishment of bow:dar7 lines on Avenue
"A" between Thirteenth (13th) street and Sixteenth (16th) street are hereby amended
to include the established boundar,y lines as hereinabove described.
SECTION 4. THAT, no building or other structure shall be erected or re-1 erected or substantially repaired and/or no new building or other structure or ~
part thereof shall be erected or re-erected within said building lines so estab•
lished, being described in Sections One (1) and Two (2) of this Ordinance.
SEOXION ;. THAT, all existing structures which are within the defined area
shown b.r this Ordinance, or all structures extending within said building lines es•
tablished by this Ordinance, are hereb,y required to conform to the new building
lines established ~ this Ordinance within a period of not more than five (5) years
!rom the effective date of this Ordinance.
SECTION 6. THAT the provisip_}\s ot this Ordinance and the building lines
herein established by ~ctions One (lJ and Two {2) shall not be construed as in an;r
manner repealing any provision or amend•nt to Zoning Ordinance 'No. 661; it being ,

the purpose and intent o£ this Ordinance to establish general building lines on
Avenue "A" between Thirteenth (1.3th) street and Sixteenth (16th) Street; between
which no improvenents shall be made in-aey-event, and building setback lines and
other provisions of the said Zoning drdiDB.llce aDd amendments thereto shall be aDd
are hereby declared to be cumulati~e 'of and applicable to abutting property, in
addition to the building lines herein est~blished, so that building setback lines
o£ the Zomng Ordinance aDd Building Code Shall be measured .from the building lines
herein established by Sections One (1) and Two (2).
SECl'ION 7. THAT, where the buildillg lines herein established coincide with
or overlap upon any public way, then the Zoning and Building Ordinance setback
requirements shall be determined from the existing propert7 lines of such public
wa)" except where the property line lies ~!thin the building lines herein established
SECTION s. THAT, it shall be unlawfUl tor any person, firm, corporation,
trustee, or &Jl1' authorized agent or representative thereof, to erect, re-erect or
substantial~ repair ~ building or othe~ structure, or to erect or re-ereot an,
new building or a.ny other structure within or between the building lines estab•
lished, and described in Sections One (1) and Two (2) o.f this Ordinance, aDd who•
ever shall violate 8ll7 such provision thereof shall, upon conviction, be fined not
exceeding One Hundred ($100.00) Dollars.
SEGl'ION 9. THAT, the provisions o£ Section 8 o£ this Ordinance shall not
apply to any officer, agent, employee or other person d~ authorized by-the State
of Texas and/or the City of Lubbock, when performing aey improvement pursuant to the I
widening, straightening or extending the streets and/or right-o.f-nys contemplated

SECTION 10. THAT, the Cit:r Secretary is hereby authorized aDd directed upon
the final passage of' this Ordinance to indicate in the Ordinance Records of the City
of Lubbock, on the margin of each Ord/n)j'ff. that is hereby-amended, that the same
has been nAME.Nl)El) BY ORDINANCE NO. [) • a
SECTION 11. THAT, the City Secretary' of the City o£ Lubbock is hereby directed
to cause publication or the descriptive caption of' this Ordinance together with pen•
alties as set out in Section 8 aforesaid, as an alternative provided in Article
1176b-l, Texas Revised Civil Statutes.
AND. IT IS SO ORDERED.
