RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock and the Lubbock Police Department, an acceptance of the
FY2019 Edward Byrne Memorial Justice Grant Program, by and between the City of
Lubbock and the United States Department of Justice, and the Office of the Attorney General, in
the amount of $187,914.00, of which $93,957.00 will be allocated to the Lubbock Police
Department and $93,957.00 will be allocated to Lubbock County, Texas, pursuant to an
interlocal agreement between the City of Lubbock and Lubbock, County, Texas, and related
documents. Said Acceptance agreement is attached hereto and incorporated in this resolution as
if frilly set forth herein and shall be included in the minutes of the City Council.

COUNTY OF LUBBOCK
INTERLOCAL AGREEMENT
BETWEEN THE CITY OF LUBBOCK, TEXAS AND COUNTY OF LUBBOCK, TEXAS
FY2019 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this —I Oth day of September , 2019, by
and between the COUNTY of LUBBOCK, acting by and through its governing body, the
Commissioners Court, hereinafter referred to as COUNTY, and the CITY of LUBBOCK, acting
by and through its governing body, the City Council, hereinafter referred to as CITY, both of
LUBBOCK County, State of TEXAS, witnesseth:
WHEREAS, this Agreement is made under the authority of Chapter 791, TEXAS
Government Code: and
WHEREAS, each governing body, in performing governmental functions or in paying
for the performance of governmental functions hereunder, shall make that performance or
those payments from current revenues legally available to that party: and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of both parties, that the undertaking will benefit the public, and that the
division of costs fairly compensates the performing party for the services or functions
under this agreement: and
WHEREAS, the CITY agrees to provide the COUNTY $93,957.00 from the JAG award
for the FY2019 JAG LUBBOCK COUNTY JOINT LAW ENFORCEMENT
INITIATIVE PROGRAM; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds.
NOW THEREFORE, the COUNTY and CITY agree as follow:
Section 1.
CITY agrees to pay COUNTY a total of$93,957.00 of JAG funds actually awarded to and
received by the CITY.
Section 2.
COUNTY agrees to use 593,957.00 for the FY2019 JAG LUBBOCK COUNTY JOINT LAW
ENFORCEMENT INITATIVE Program until September 30, 2020.
Section 3.
Nothing in the performance of this Agreement shall impose any liability for clairns against
COUNTY other than claims for which liability may be imposed by the TEXAS Tort Claims Act.
Section 4.
Nothing in the performance of this Agreement shall impose any Iiability for claims against CITY
or the COUNTY other than claims for which liability may be unposed by the TEXAS Tort
Claims Act.
Section 5.
Each party to this agreement will be responsible for its own actions in providing services under
this agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by the other party.
Section 6.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 7.
By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein; further, this Agreement shall not create any rights in any
party not a signatory hereto.

Equipment and Training
A. Cybercrime/Crime Scene Equipment and Training
The Lubbock County Sheriff's Office(LSO)will purchase computer hardware,
software and equipment to enhance their capabilities to investigate cybercrimes
and to process crime scenes. With the advancement of technology,criminals are
increasingly utilizing computers and the internet in their efforts. To keep up, it is
paramount to law enforcement to have advanced knowledge, skills and equipment
to counter the increasing sophistication of technology related crimes. By
upgrading equipment in the crime scene unit we are able to more thoroughly
document scenes for evidentiary and investigatory purposes. By upgrading the
Cyber Crime and Crime Scene Division equipment and training, the LSO will
continue to stay abreast with the rapidly evolving world of technology. These
upgrades along with the training will ensure the LSO continues to have the most
advanced means to investigate crimes.

2. Criminal District Attorney's Office
Equipment and Training
A. Crash Data Retrieval System
The Lubbock County Criminal District Attorney's Office staffs a certified Crash Data
Retrieval Technician/Analyst and a Crash Data Retrieval System(CDR). This
technician is available to provide state and local law enforcement agencies with
technical and analytical assistance investigating motor vehicle crashes. The CDR
system has proven to be an invaluable tool for accident investigators and prosecutors.
It provides an"unbiased witness"to the event,thereby supplementing the
reconstruction process and providing crucial evidence at trial. The equipment and
software are constantly being updated as newer vehicles are manufactured. As a
result,the maintenance of our current CDR system comes at a considerable cost.
The ability to purchase current software, hardware and tools will insure the future
reliability and usefulness of the CDR system. Periodic training is also required to
keep the technician/analyst certified and current with the system upgrades.

B. Digital Forensics Unit
The Lubbock County Criminal District Attorney's Office operates a multi-media
forensics lab. This unit will offer examination of crime related videos and audio files
to all Lubbock County law enforcement agencies as well to agencies and prosecutors
on the South Plains of Texas. Grant funds will be used to equip and maintain the
components of this lab which include infrastructure, computers, monitors, software
and training.

C. Maintain and Upgrade Mobile Infrastructure
The Lubbock County Criminal District Attorney's Office prides itself in being the
most technologically advance prosecutor's office in the region. The Lubbock County
CDA office utilizes an electronic filing system to receive cases from law enforcement
agencies and tries cases using digital courtroom presentations. These presentations
and the data used is mostly accessed by laptop computers and other mobile devices.
As technology advances,the need to upgrade, maintain equipment and infrastructure
is necessary.

D. Digital Video Processing
Perhaps the most pressing issue for the Lubbock County Criminal District Attorney's
Office, and every D.A. Office in America, is the explosion of digital video. Each case
now comes with in car video and the first responders in Lubbock County are now
being equipped with body cameras. This will quickly double the amount of video files
handled by this office. Combined with the dramatic increase in privately owned
surveillance systems, digital video has become one of the most prevalent forms of
evidence used in trial.Not only does this video have to be adapted for proper playing
in court,many of these videos have to be edited or redacted before being allowed to
be played in court. Editing and redacting are often ordered during trial, so having the
proper equipment and software in place is a necessity for today's prosecutor offices.
Also,coordinated efforts between the prosecutor and law enforcement in purchasing
this equipment is must. This requires standard practices and requires the prosecutor to
obtain certain equipment and software for the law enforcement agencies in the
county.
- Digital Video Processing equipment $ 5,000
2017 JAG is currently being utilized to purchase and replace approximately 40 model
X26P Tasers with holsters and batteries. This also includes the related training items.
The LPD would like to utilize most of the funds from the 2019 JAG in order to
purchase and replace approximately an additional 40 model X26P Tasers with
holsters, and batteries.
The LPD continues to work towards its goals of expanding and enhancing their
capabilities in cybercrime and crime scene investigations. Technology and
technology related crimes are advancing at an exponential rate. Investigators must
stay on top of the latest advancements through training and upgrading equipment and
software in order to efficiently investigate these crimes.
The LPD strives to continuously work towards its mission of promoting safety
and security for the community of Lubbock by protecting life and property. One of
the ways to accomplish this is through a properly equipped and trained Mounted
Police Unit. The mounted unit can be particularly effective in fulfilling this mission
during large crowd and riot situations. The LPD will use a portion of this grant to
purchase crowd/riot control gear to outfit the mounted horses to provide them
protection during these situations. The will also seek out training related to
crowd/riot control situations. Mounted Police need continued training in order to
enhance their skill set and meet the changing needs of the community particularly in
crowd control situations. The training sought will address crowd control situations,
defensive tactics on horseback, and horsemanship skills that best prepare the horse
and rider to be deployed in the community.
B. Lubbock Sheriff s Office (LSO)
The LSO Investigation Division continues to expand its capabilities in cyber-
crimes and crime scene investigations to keep up with the latest technology advances.
Technology is advancing so fast that equipment, software and training for
investigators must advance as well to keep up to the modern-day criminals already
using technology to their advantage.
C. Lubbock Criminal District Attorney (LCDA)
The LCDA continues to upgrade its older mobile infrastructure, multi-media
forensics lab, Crash Data Retrieval System and digital video processing capabilities
along with necessary training in order to maintain the most technologically advanced
prosecutor's office in the region.
Project Design and Implementation:
A. Lubbock Police Department
1. The LPD has been using less-lethal equipment for decades. The use of
less-lethal equipment has saved countless lives during that time. The
Taser, one less-lethal tool available to Lubbock Officers, has been used for
over a decade. The Taser model currently in the process of being replaced
by LPD has been phased out by the manufacturer. The original Taser
issued by LPD was introduced by the manufacturer in 2003 and has been
recently redesigned. The manufacturer of Taser, Axon, has indicated that
Taser models that were being used by LPD have been discontinued and
are no longer being supported for parts or repair purposes. The LPD
recognized the importance of keeping Taser as a less-lethal option for
officers so funding from this grant will be used to continue towards the
goal of replacing the outdated Taser equipment.
Allocation of Rinds from this grant will be prioritized to replace oldest
Tasers first. It is not expected that grant fiends will be sufficient to replace
all Tasers issued to LPD officers so alternate funding methods will be
found when depletion of grant finds is completed. Stakeholders involved
include county taxpayers, City government and Police. Grant funding for
new Tasers was allocated with this grant after other Police equipment
needs were fulfilled through State grant funding.
• Performance Measures:
2. As the technology utilized to perpetrate and facilitate crimes continues to
evolve so must the equipment and knowledge of law enforcement. The
procurement of updated computer software and equipment would give law
enforcement the ability to detect and obtain digital evidence for criminal
investigations as this evidence continually becomes harder to uncover. As
new technology is procured the training to properly employ this software
and equipment also becomes essential. The goal of the project is to
enhance the capabilities of the Cyber Crimes and Crime Scene Units so
that the criminal cases presented to the Criminal District Attorney's Office
lead to an increase in successful prosecutions, which in turn also provides
a valuable service to our community.
• Performance Measures: The cases presented to the Criminal
District Attorney's Office which entailed evidence obtained
through crime scene or cybercrime investigations would show
improvement in the amount and strength of evidence submitted
as well as reflect in the prosecution rates.
3. When it comes to professional Mounted Police training the opportunities
are limited. The Lubbock Police Department Mounted Patrol will seek out
the training opportunity that best serves the needs of the Unit which
include improving the Units' horsemanship skills, defensive tactics while
on horseback, and crowd control utilizing the horse as a tool to manage all
types of crowds from calm gatherings to hostile/riot type scenarios.
•Performance Measures: The Lubbock Police Department
Mounted Unit will measure success by the number of certified
horses and officers they are able to send to training. The success
of the training and obtaining equipment is measured in more
intangible forms like reducing the likelihood of injuries to officers,
horses, and citizens, providing a higher level of service and overall
reducing the liability to the City of Lubbock by having a
professional trained Mounted Unit. The LPD Mounted Unit keeps
records of all training and deployments each horse participates in
and documents how the horse responds. These records are
maintained in a database at the police department.
B. Lubbock Sheriffs Office
As cybercrimes continue to grow, becoming more advanced with
increasing innovations in hardware and software technology, law enforcement
must respond. The acquisition of modernized computer hardware, software and
related equipment would enhance law enforcement competencies to secure digital
evidence for successful investigations. With the continued advancement of
hardware and software tools used by law enforcement there is a need for
furthering the knowledge and skills of investigators through training so they may
maintain certifications and gain proficiency with the equipment. The goal of the
project is to enhance the capabilities of the Cyber Crimes and Crime Scene
investigation divisions so that the cases investigated and presented to the Criminal
District Attorney's Office, a stakeholder, lead to more successful prosecutions.
• Performance measures: Cybercrime cases along with other cases
presented to the Criminal District Attorney's Office would show
improvement by way of using the latest technology available to
investigators.
C. Lubbock County Criminal District Attorney's Office
1. The Lubbock County Criminal District Attorney's Office staffs a certified

(CDRS)to assist local and state law enforcement agencies investigate motor
vehicle crashes. The CDRS has proven to be an invaluable tool for
investigators by supplementing the reconstruction process and providing

Capabilities and Competencies:
The LPD, LSO and LCDA not only coordinate their efforts to achieve a more proficient
criminal justice system and process with each other, but do so with many Federal and State
Agencies, educational institutions, regional law enforcement and community stakeholders as
well.
Plan for Collecting the Required Data:
Performance measurement goals, objectives and deliverables will be collected through
communication and coordination with all grantees.
