BE IT RE)~ERED that on this the 23 day of November, A.D, 1949 the
City Commission of the City o£ Lubbock, Texas convened in Recessed Re~lar
Meeting, pursuant to Notice of Meeting issued by the Mayor, at the Re~:ar
Meeting Place thereof in th e City Hall building in the City of Lubbock,
Texas with the following members present, viz: ·
Honorable W. H. Ro dge rs, J.layor and Presiding Officer.
W.B. Price Commissioner
E.K. Hufstedler, Jr. Commissioner
John Soikes Commissioner
Clarence \'lhiteside Commissioner
Lavenia Lowe City Secretary
constituting a quorum under section 15, Article 9t Chapter I of the Charter
of the City of Lubbock , with all members of the Cl.ty COmmission being pre-
sent, whereupon the following among other business was transacted:
Commissioner Hufstedler pre s ented for the consideration of the Commission
an Ordinance which was read in full by the secretary.
Commissioner Hufstedler made a motion that the rule requiring Ordinances
to be read at more than one meeting of the City Commission be suspended for
the reason stated in the emerpency clause. The motion was seconded by Com~
missioner Price and prevailed by the following vote:
AYES: Commissioners Price, Hufstedler, Spikes, Whiteside and
~~yor w. H. Rodgers.
NOES: None
'Commissioner Price moved that the Ordinance be finally passed and

OF THE SE'vlER SYS'i'EI•i OF THE CITY OF LUBBOCK INCUJDING THE DISPOSAL PLANT,
AND FOR WIDENmG, IMPR u VEI',IE NT AND EXTENSION OF THE STREF.TS AND HIGHWAYS OF
SA ID CITY INCLUDING THE PURCHASING CF NECESSARY RIGHTS-OF-WAY THEREFOR·
DETERMINillG THE ADVISABILITY OF SUBMITTING TO THE PROPERTY TAX PAITNG VOTERS

\'l~EREAS, the City Commission of the City of Lubbock affirmatively
finds t~<t it is advisable nnd to the best intere st of said Citv that cer-
tain improvements, additions, extensions and enlar~ements be made to the
public streets and highways within said City and to the sanitary sewer
system includinp. the disposal plant of the City, all in accordance lrith
the recommendations, plans a nd estimates which have heretofore b een pre-
sented to,· considered by, and found, by tmis Conmission, to be needed in
the immediate future; and,
WHEilEAS, it is deemed advisable and necessary that the negotiable
interest bearin~ coupon bonds of said City should be issued for the purpose
of financinr, the cost of such improvements, additions, enlargements and
extensions arrl that it is necessary and expedient that an elect ion be held
within and fop said City of Lubbock for the purpose of submitting to tJ-e
legally nua l ified resident property tax-payin~ voberw of said Cit y, who

NOT THEREFORE, BE IT ORDAINED BY THE CITY CO~~USSION OF THE CITY
OF LUBBOCK:
I.
That an election be held within and t~xoughout the boundaries of
. 1!-rthe.~ City of Lubbock, Texas on the Second Tuesday in DEcember, the same
~r being the 13th day of December, 1949, such date being not less than
1~ fifteen (15) days nor more than thirty (30) days fro~ the date of this
·,Ordinance, at which time it shall be submitted to the resident qualified
1 property' tax-paying voters of the City of Lubbock,"''Texas,' who · .own pro-
perty subject to taxation within said city and who have duly rendered

Shall the City Commission of the City of Lubbock be authorized to
•issue the negotiable.interest bearing coupon bonds of the City of -Lub-
ck in the amount of $525,000:00 bearing interest at a rate of no~ ex-
'. oeeding three and one-half (3-1/2%) per centum per annum from date and
maturing at such time or times as may be deemed most expedient by 'the
!....,.City · Commission, serially not later than twenty-five (25) years from
their date, for the purpose of improving, extending and altering public
streets, avenues, alleys, hi ~hways a nd boulevards by paving, widening,
~~,~~~nJ.raising, grading, filling, re-paving or re-surfacing the same or other-
f wise ·improving such streets and highways, and for the purpose of acquir-
q igg the necessary rie:hts-o£-way incidental thereto; and shall there be
annually assessed,·levied and collected upon all taxable property within

and extending and installin~ additional sanitary sewer liaes, and shall
there be annually assessed, levied and collected upon all taxable property
'!':~·.within the City of Lubbock, while said bonds or any o£ them are outstanding,
! · a tax sufficient in amount to pay the annua 1 interest on such bonds and to
a sinking fund for the redemption thereof at maturity?

Said election shall be held under the provisions of and in strict
c~nformity with the Consitution and Laws of the State of Texas, including
C~pter I, Title 22, Revised Civil Statutes o£ the State of Texas, and, f. tlie provisions of the Charte r of the City of Lubbock, and all a<itts amen-
~ .datory, complementary and supplemental thereto.

• · All persons who are le ~ta lly oualified resident property tax-paying
·:. 'voters of the City of Lubboc k , Texas, who o~m property in said City sub-
ject to taxat i on and who have duly rendered the same for taxation, shall
be entitled to vote at said election.

The ballots for said election sh~ll have written or printed

IV.
That said election shall he held in the Central Fire Station
building at the corner of lOth Street and Avenue J in the City of
Lubhock; Texas and the nresidir¥'; judge and clerks of said election
shall be as follows, viz:

T That notice of said electiOn shall be ~iven by posti~ a substantia l
coDy of this Ordinance at the City Hall Building and at two other public
places in the City of Lubbock and such notice shall also be published on
the same day in each of tlro successive weeks in a newspaper of ~neral
circulation published '"ithin the City of Lubbock, the date of the first
publication to be not less than fmtrteen (14} days prior to the date set
for said election.
Tie Mavor and City Secretary shall cause such notices to be prepared
and posted and published and shall make due returns thereof to this City
Commission.

Immediately after said election has been held, the officers holding
the same shall make returns of the result thereof to the City Secretary
of the City of Lubbock, for canvassing by the City Commission and shall
return the ballot boxes to the City Secretary for safekeeping.
The manner of holdim>; such election and canvassing and makin.P..; returns
theeeof shall be ~overned by the general election laws of the State of
Texas, when not in conflict with the provisions of the hereinabove men-
tioned statutes, and the City Commission -will furnish the necessary bal-
lots and other election supplies requisite' for saici'election.

The fact that it is affirmatively found by the City Commission of
the Cit'y of Lubbock, Texas that there is urgent need to proceed with the
., matters of const~1ction, improvement, enlargemen~ and extension of the
sewer system of the City of Lubbock and public streets and highway im-
provements of said City in order to make the same more convenient for
the public at large and to preserve and protect the health and \-lelfare
of the citizens of Lubbock, creates an emergency and public necessity
demanding that the rule requiring the reading of this Ordinance on more
than one day before final passage be suspended, and such rule is hereby
suspended, and it is ordained that th is Ordinance shall take effect and
be in force immediately upon its _!'lassage and adoption.
