The provisions heroin set out shall constitute the Plumbing Code of the City of Lubbock and sholl govern all mntters to which it relates, and shall bo construed to carry out the intent and purpose of preserving end protecting the public health, safety, and welfhre, ~nd shall bo othe~t.ise construed consistent with all related lows of the State of Te~s. CH.\PTER I DEFINITIONS-EXlil.fFTICNS Section 1-1 Paragraph 1-1-1. PLUl·:BING. Paragraph 1-1-2. HASTEn PLUNBER. A "Ho.ster Plumborn within the meaning of this Ordinance is a pltunber having a regular place of business, who, by himself, or tl~ough a parson or parsons in his employ, performs plumbing worlc, and who has successfully fulfilled the examinntions apd requirements under the Plumbing License Law of 1947, and amendment~. Paragraph 1-1-J. JOUUNE'ilA'..AN PLut-~BEB.. A UJourncyman Plurnbern within the meaning of this Ordinance is any person other than a master plumber who engages in or ~rorks nt the actual installation, alteration, repair and renovating of plumbing, and who has successfully fulfilled the examinations a.nd rcquiromcnt.s under tho Plumbing License Law of 1947, and amondxnonts. Parogroph 1-1-4. PLUHBE.tl.' S 1\.PPRENT!CE. A 1tfltnnbort s Apprenticon within tho manning of this Ordinance is any person other than a mostor plumber or journeyman plumber who, as his principal occupation, is engaged in looming and assisting in tho inst~llation of plumbing. ?nragruph 1-1 .. 5. PL'ffi''!BING INSPECTOR. A llPlumbing Inspectortt within the moaning of thia Ordinance is nny person employed by tho City of Lubbock for tho purpose of inspecting plumbing work and installations in connection \-lith health and snfoty la\ors and ordinances, and who has suc-cessfully fulfilled tho o~~minntions and requirements under tho Plumbing Liconso Law of 1947, and.amondmonts. Poragraph 1-1-6.. BOARD. The word or tam "Board" as used in this Ordinanc~ 1ncnns the Toxns State Board of Plumbing Ex~inors. Paragraph 1-1-7. EX»U'TIONS. Provided, how- V .L"U.l.UUUt;\J !:1.• CHAPTER 2 A.!:MDUSTRATI ON Section 2-1-1. ~TLE CITED. The following provisions shall constitute the Plumbing Ordinance of the City of Lubbock and may be citad as such. . It shall bo unlawful for any person, association of pe~sons, co-partnership, or corporation, to cngnge in tho business of plumbing, or do or perform any plumbing as definod in this ordinance without first having procured tho nocosenry permits ns horoinafter provided for, and all plumb-ing, plumbing work and worl~nship and oatorials shall moot tho requirements of this ordinanco and shall pass all inspections required in this ordinance in rognrd to tho work done. Tho intent and purpose of this Ordinance is to regulate the construction, erection, onlurgor;lont, alter-ation, ropnir, removal and nnintonnnoo of all piping, fittings, fixtures, otc., used for tho conducting of wator, so~ge and gaa in or on any and all premises in thEJ City of Lubbock, and outside tho boundnrios of tho City of Lubbock if &tmo be connected to eithor ti1o City wator or smrorngo systons. Paragraph 2-1-3. PI?ING ATI<'ECTED BY THIS ORDINANCE. Section 2-4 ~MASTER GAS FITTER'S BOND AND APPLIANCE DEALER Paragraph 2-4-1• BOND AND APPROVAL. No person shall enter upon tho installation, construction, reconstruction, or repair of such gas piping, appliances, fixtures or apparatus or any change thereof, (nor shall any person undertake for any o·ther person; firm or corporation, tho ndjustmont thereof) until the said individual. shall have delivered to the City of Lubbock a good and sufficient surety bond in tho sum o~ One Thousand ($1000.00) Dollars to bo approved by tho City Attorney of tho City of Lubbock, such surety shall be a surety company duly authorized to do business in tho Stat3 of Toxas conditioned for tho faithful performance of all such work entered upon or contracted for in strict accordance and compliance with tho terms, roquir~ments and provisions of this ordinance and such furthor and future ordin&nccs of tho City d Lubbock as ma~r be hereafter passed;. CHAPTER IV SECTION I -PENALTY Paragraph 4•1·1. PLUMBING v~ITHOUT LICENSE~ Ar1;( person who engages in or follows the business or occupation of plumbing, or who shall do a~ plumb-ing asthatJterm is herein defined, or who shall perform aqy function, work or service within the definition of . ~Master Plumbern or "Journeyman Plum~r", or "Plumber's Apprentice," or 11Plumbing Inspectorll within the corporate limits of the City of Lubbock, or·otherwise as provided b,y this ordinance unless es· pecially exempt by·the provisions of this ordinance, shall be deem~d guilty of a misdemeanor and upon conviction shall be punished by a fine ot not more than Two Hundred ($200.00) Dollars. · ' . It shnll be unlawful for aqy person, firm, association, corporation or other legal entity in the City of Lubbock to advertise or. hold himself or itself out to the oublic as a Mast&r Pl~ber or Plumber's Appren-tice or Plumbing Ins~ector when such person ~r other legal entity has not lawfully obtaine~ and does not have·on unr~voked license or permit as pro-vided by the Plumbing License Law of 1947 with amendments, or this ordinance and aqy person or other legal entity which sh~ll. violate this provision of this ordinance shall be fined u~on conviction~ in a~ sum not exceeding Two Hundred .($200.00) Dollars, and that each day that any such violation is com-mitted shall constitute a seperate offe~se. Paragraph 4~1-3. It shall be unlawful tor an.y person, firm, cnrporation or other legel entity to knowingly permit any person who ~s not a lawfully licensed plumber aw herein defined and required, to do a~ plumbing ae de-fined herein, upon any: premises owned or under the control of said person~ firm, or corporation o~ other legal entity within the corporate limits .of the City of Lubbock and whoever ehall violate this provision shall be fined in anf sum not exceeding Two Hundred ($200.00) Dollars. Paragraph 4-1-4. This ordinance shall not be c~nstrued to relieve from or lessen the responsibility .or liability of a~ person or other legal entity owning, operating, controlliDg, or instaJ.+ing Qey plumbing as that term is. herein defined, to persnns or property caused by aqy defect therein nor shal~ the City of Lubbock be held as aaeuming a~ such liability by reason of the inspection authorized herein, or by reason of aqy permit or license herein required or provided for. Paragraph 4-l-7. If ~nr section, sub-section, sentence, clauae, or phrase contained in this ordinance sh~ll Vor a~ reason be held t~ be invalid or unconstitutional, such decisi~n shall n?t affect the validity of the remain· ing portions of this ordinan~e and it is hereb,y declared that all other parts of this ordinance shall c~ntinue in tull force and effect. Paragraph 4•1·8. ~!·ordinances or part. ~f this ordinances in conflict with the provisions herein contained are. hereby repealed~ Paragra~ 4-1-9. The fact that the present ~rdinance of the City o£ Lubbock gov•nning plumting end installation are inadequate and conditions exist in the City of Lubbock endangering the health and welfare of the public which creates an emergency and a oublic neces~ity for the preservation of public health and safety • . THEREFORE, the City Secretary is authori~ed and directed to publish the descriptive caption of thie plumbing orclint~nce together with the penalty sections, once a week tor two consecutive weeks in some newspaper regulartr published in the City of Lubbock in lieu o£ ~ublishing the entire ordinance, as an alternative method of DUblication provided by Chapter 10, Page 112, Acts 1939, of the 46th Legislature as amended by Chapter 264, Page 463, Acts 1947, of the 50th Legislature and this ordinance is to take effect from and after its passage and final pUblication as made and provided by the Charter of the City of Lubbock.
