BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1-1. ~tain animals not to run at large.--The running. at large of horses, ~es, jacks, jennets, cattle, sheep, goats or hogs, within the City of Lubbock is hereby declared a nuisance, and it is hereby made unlawful for the owner or keeper of a:n:y such animals to permit the swne to run at large within the corporate limits of the City of Lubbock. SECTION 1-2. Pound. --The governing body shall select and estab- lish a place within tne City for impounding such.of said animals as are found running at large. SECTION 1-3. Impounding animals. --The Chief of Police, or any policeman, or other person designated by the Chief of Police, City Manager or Governing Body shall take up and impound any anima.l found running at large in the city limits. li SECTION 1-4. Sale of impounded animals; disposition of proceeds. 11 The Chief of Police shall sell impounded animals at public auction for1 cash, after ~1v1ng five days' public notice of the time, terms and i place of sale in a daily newspaper published in the City of Lubbock, I describing the animal impounded and stating that the same will be sold l to defray costs if not reclaimed and costs paid befdre the day of sale~ If nmtreclaimed by said day, he shall, between the hours of 10:00 o' : clock A.M. and 4 o•clock P.M. on said day, sell said animal at public ' auction to the highest bidder, and after deducting all the expenses ~~ of sale and taking up and keeping such animal, shall return the balanc of the proceeds, if any, to the owner of the animal. If no owner sha call for the animal within thirty days from day of sale, said balance shall be paid into the city treasury. Redemrtion of impounded animals.--The o~v.ner of any ij animals impounded as a oresaid may redeem the same as follows: (1) Before sale. By paying the expense of taking up and keeping ; together vdth the cost of advertising, if any. (2) After sale. By paying to the purchaser double the amount bid by hliri for such animal or animals, and his reasonable expenses II for keeping the same provided the ovmer so redeems said animal vith- in thirty days after the date of sale; otherwise said animal shall become the absolute property of the pUrchaser. l SECTION l-6. Fees for poundage.--The following shall be the fees charGed as poundage: For taking up and impounding, per head For taking care of animals, per head, per day For selling an:mals For preparing advertisement of sale For newspaper advertisement, the actual cost as deter.mined to time. ~p 1.50 .so .5o II .50 from tim~ SECTION 1-8. \·lhen O\'mer of premises may impound stock.-.. Jf any of 1 the animals named in this chapter are fom1d upon the premises of anyone, tbe o\v.ner or occupant of said premises shall have the right to confine ! such animal until he can notify the Chief of Pollee or pound keeper to I come and impound such animal; provided, that the same is done in a roasonable time. When so notified, it shil.ll be the duty of said offic rs to at once cause such animal to be impounded as herein provided. SECTION 1-9. Penalt!.--Any owner or keeper of any animal named in I this Ol"dinance, who sha 1 perrni t the same to run at la.:t'~e within the I city limits, shall be fined not more than Twenty ... Five ($25.00) Dollars. SECTION 1-10. The City Secretary is hereby directed to cause publi- cation of' the descriptive caption of this Ordinance, together with penalty as set out in Section l-9 aforesaid, as an alternative provided by Chapter 10, Page 112, Acts 1939 of the 46th Legislature as amended by Chapter 264, Page 463, Acts 1947 of the 50th Legislature.
