CEDURE TO BE FOL- LOWED BY AN APPLICANT FOR A HEALTH CERTIFICATE; PRESCRIBING Tim DUTY OF THE APPLI- CANT AND THE HUJ~TH OFFICER AND HIS DULY AUTHORIZED REPRESENTATIVES TI~ MAKING THE EXA:t-ITNATION, PRESCRIBING A 'IWO DOLLAR ($2.00) Fill THEREFOR; PRESCRIBING THE FORM OF HEALTH CE RTIFICATE TO BE USED, RETE NTION OF SAID CERTIFICATE IN THE FILES OF THE DEPARTW.NT OF HEALTH AND THE ISSUA NCE OF HF.ALTH REGISTRATION CARDS '1'0 THE APPLICANT; PROVIDING THAT NO HEAL'rH CERTIFICATE OR HEALTH REGISTRATION CARD SHOULD BE ISSUED TO ANY PER..<10N INFECTED HtTH ANY TRANSMISSABLE CONDITION OF' A C0Mf'·1UNICABLE DISEASE; ESTABLISHING CONDI TIONS UNDER vTHICH CARDS AND CERTIFICA':j.'ES MAY BE REVOKED OR CANCELLED AND RE-ISSUED; PROVIDING THAT HEALTH CERTIFICATES .A ND HEALTH REGISTRA- TION CARDS SIIA.T.L NOT BE VALID FOR A PERIOD OF LONGER THAN SIX (6) ~10NTHS; REPEALING ORDINANCE NO. 511 AND 789 RELATING TO THE ISSUANCE OF HF.ALTH CERTI FI CATES; PRO- VIDING A SAVING CLAUSE AND PENALTIES FOR VIOIA TIONS • WHEREAS, the Governing Body o~ the City of Lubbock finds th.9.t existing Ordi- nances are inadequate for the protection of the public health within the corporate limits of the City of Lubbock and deems it necessary that other provisions be made relating to the control of conmrunicable diseases insofar as such diseases are carried and may become transmissable l~ certain pers ons handling foods and bever- ages and the passage of this Ordinance VTould be in the publ.ic interest, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: S ~CTION 1. No person shall engage in any business or occupation as a domestic servant or in the business of handling foodstuffs intended or suited for human con- sumption nor shall any person, firm or corporat:i.on, employ any person in the busi- ness of handling foodstuffs intended for human consumption and sale, until such person or pers ons have obtained from the Department of Public Health of the City of Lubbock a h ealth registration card showing that such person has met the require- ments of the laws of the State of Texne and the local ordinances governing domestic servants ru1d foQd handlers and has a valid health certificate on file in the office of the Department of Public l~alth. SECTI ON 2. Before ~ person shall be ~ssued a health registration card, he or she shall first be exrunined by the City Health Officer of the City of Lubboc , ... , or his duly autho rized representative, and shall submit to such examinations, laboratory tests, and x-rays as may be necessv.ry to determine if the individual examined is free of any transmissable condition of any contagious or communicable disease. If such person examined is found to be free df any transmissable condi- tion of any contagious or communicable dieease, said individual shall be issued a health re ~istration card, a charge of two dollars ($2.00) being made for all said exaninations and rep;istration card. There shall also be a health certificate placed in the files of the Department o~ Public Health bearing the same number as the health registration card issued to said individual. This card may be revoked when in the opinion of the Department the holder is suspected to have a contagious or communicable disease or of being a carrier of such, and ·the Department reserves the right to make other such examinations, tests, etc·., at any time ·that·may·>b£Lnecessary. ·_ , '.:. Director of Public Health This registration card and health certificat e shall be valid for a period of six months unless cancelled by the City Health Officer, or his duly authorized rep- resentative as provided by this ordinance. SECTION 3. In making the aforementioned examinations the City Health Officer, or his duly authorized representative, ·shall have a reasonable time in which to complete the examination and laboratory tests before issuing or re£using the issuance of a health re ~istration card. · SECTION 4. If the City Health Officer, or his duly authorized re-presentative, has reason to suspect that any person may be infected with any transmissible con- dition of any contagious or comnnmicable disease he shall be and is hereby author- ized to require such person to report for fUrther er~nation and shall have authority, upon examination, to cancel or revoke any health registration card and health certificate that may have been issued in the event he finds any such person has become infected with any contagious or communicable disease. c c SECTION 5. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined in any sum not exceeding $100.00. SECTION 6. The fact that conta~ious and communicable diseases threaten and impair the public health, this ordinance is passed in the interest and for the protection of the public Helfare and safety. If any part of this ordinance be declared invalid it shall not affect the validity of the remainder. SECTION 7. Repealing Ordinance No. 511 and Ordinance No. 789 and all other ordinances or parts of ordinances in conflict vrith any provision of this act. The caption and penalty clause only shall be published. ~Passed and approved first reading b y unanimous vote of the City Commission, a quorum being present, at a regular session, this 24th day of March, 1949.
