A.N ORDINANCE PROHIBITING THE USE OF RADIOS AND OTHER SOUND PRODUCING MACHINES
IN CONNECTION WITH AMPLIFIERS FOR ADVERTISING, ENTERTAINING AND OTHER PURPOSES IN
THE STREETS, ON SIDEIALKS, IN DOORS, WINDOIS AND OTHER OPENINGS OF BUILDINGS;
ESTABLISHING EXCEPTIONS AND PROVIDING PEN!triES.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK&
SECTION 1, It shall be unlawful for an;r person, firm, partnership, association
or corporation to connect or permit the connection of ~ load speaker or ampli•
fier of aqy kind to a radio or talking machine, or to a~ kind of machine which
produces or reproduces sounds Qf aqr kind, and when so connected with electrical
current or otherwise, to use or permit the use of said loud speaker or amplitier
or radio or talking machine or machine of aif3 kind on aey building or vacant lot
within the corporate limits of the Cit1 of Lubbock, or place the same inside of
aey building near an entrance or window or any opening, or place an.:r such loud
speaker or amplifier or radio or talking machine or ~ other such sound producing
machine on the sidewalk or in the street in front of acy building or vacant lot,
and use or permit the use of &nT such loud speaker or amplifier or other machine
to be used to produce or reproduce sounds of aqy kind for the pu.pose of adver-
tising, entertaining or for ~ other purpose •
SECTION 2. The provisions ot Section 1, shall not be construed as prohibiting
the playing or a radio or talking machine when not connected w1 th a loud speaker
or amplifier in aqy building or on ~ vacant lot in the City of Lubbock, PROVIDED,
such use does not constitute a nuisance to nearb.y inhabitants.
SECTION .3. Provided further, that thh ordinance shall not be construed to
conflict with ~ terms of ~ license granted or to be granted by the City
Commission permitting the use of loud speakers and/or amplifiers or sound pro-·
ducing devices and under such conditions and at such places as tbe-Ci~ C~s 3i OD
shall deem to be in the public interest.
SECTION 4. Any person, firm, association, partnership or COI'pOJ!&t!OD wbo
shall violate a~ provision or provisions of Section 1 of this Ordinance shall
be fined in any sum not to exceed ONE HUNDRED ($100.00) DOLLARS.
AND IT IS SO ORDERED.
