AN ORDINANCE AMENDING SECTION 4401, OF BUILDING ORDINANCE NO. ;eJ7, RmULATI!«l THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMO- LITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHTH, AREA AND MAINTENANCE OF BUILDING AND/OR STRUCTURES IN THE CITI OF LUBBOCK, PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTION OF FEES THEREFOR, DECLARING AND ESTABLISHING FIRE DIS- TRICTS, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, ETC.; SO AS TO CLARIFY THE MEANING OF THE THIRD SENTENCE IN SECTION 4401, RELATING TO THE TEMPORARY USE OF STREETS DURING CONSTRUCTION, AND LIMITING USE OF ALLEYS. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKt THAT, Section 4401 ot Chapter 44 ot the buildiDg code ordinance No. 587, be amended so as to hereafter be 8Jld read as follows 1 "PART IX .. BEGULATIONS FOR USE OR OCCUPANCY OF STREETS AND PROJECTIONS OVER PUBLIC PROPERTY CONSTRUCTION Temporar,y Use of Streets Duriug Construetioa SEC. 4401. No buildiug material or materials shall be placed upoa the streets, sidewalks or alleys exoept as provided in this Chapter. Building materials required tor use immediatelY or in connection with the construction of a building ~ be placed upon the street or sidewalk in front of the building in course of construction or al- teration. Building materials may be placed in t~e alley adjoining the building site for which a permit has been issued, provided that a clear and unobstructed roadway not less than ten feet (10 1 ) in width is maintained through such alley along the buildiDg site. In Fire Zone No. 1 and when the prOposed building exceeds a height of two stories in &1:\f part ot the ci t;y, the 01t'Jler or his agent shall construct, before an;,y building is commenced, a temp• orar;y covered walk'""Wa;y not less than five teet (5 1 ) wide, of sufficient strength to protect the public from falling materials duri~~g construction and such covered walk-way shall reJD&in in place until the completion of all or the exterior portions of the building. When the area occupied by the sidewalk or temp- orary walk--wq is to be excavated, such walk shall be lbade of boards not less than two inches (2•) thick, designed to support ,v a load ot not less than 150 pounds per square toot, provided with suit- able ramps at each end, and lli tb hand rails on each side. The root OYer such walk-way shall be the full width ot the walk-way 8lld ot not less than two lqers or one inch (1•) boards with joints broken, and shall be placed not less than ten teet (10') above the temporary walk• way. Whenever such root is used for stori.Dg of materials a railing and foot board shall be so installed as to prevent the materials from spilling into the street. Mortar or concrete ~ be prepared in the space permitted for storage or bUilding materials, but shall be done in a mechanical mixer or in a tight box or on a tight mixing board in such a manner that dripping or splashing is prevented. Pavements shall be well cleaned at all building materials at the completion of the construe• tion of a building. The covered walk-wq shall be kept well lighted continuousq between sunset and sunrise and the outer edge of the occupied space ot the street or sidewalk shall have placed thereon red lights which shall be kept burning continuouslf between sunset and sunrise. The street side of aqy barricade or fence and handrails aDd side• walks shall be kept reasonably smooth and in good repair while con• struction work is in progress or while such barricadea, fences or walk-.eys are placed in or over public property.• .f.ND IT IS SO ORDBBED.
