Z 7 ~ - AN ORDINANCE CA1~ASSING THE RETURNS AND DECLARING THE RESULTS OF JU~ ELECTION HELD IN THE CITY OF LUBBOCK, TEXAS ON APRIL 6, 1948, ON PROpOSED AMENDMENTS TO THE CHARTER OF THE CITY OF LUBBOCK, TEXAS, SAID AMENDMENTS THUS SUBMITTED AND VOTED ON PROPOUNDED TO Tm. VOTERS THE FOLLOWING QUESTIONS. AMENDMENT NO. 1. DO YOU VOTE TO AMEND THE ffiESENT CITY CHARTER OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING AND CHANGING SECTION 8, ARTICLE II, CHAP!'ER ONE, RELATilC TO CLAIMS AGAINS THE CITY? ANSWER: YES NO AMENDMENT NO. 2. DO YOU VOTE TO AMEND THE PRESENT CITY CHARTER OF THE CITY OF LUBBOCK, TEXAS, BY ADDING SECTION SA, ARTICLE II, CHAPTER ONE, RELATI NG TO LIABILITY OF THE CITY AND SPECIAL WRITTEN NOTICE PERTAINING THERETO? DO YOU VOTE TO AMEND THE PRESENT CITY CHARTER OF THE CITY OF LUBBOCK, TEXAS, BY ADDING SECTION .3A, ARTICLE I, CHAPTER ONE, RELATING TO AND CONCERNING THE ADDITION• AL POWER OF THE CITY COMMISSION TO EXTEND THE CITY BOUNDARIES AND ANNEX ADJACENT TERRITORY BY ORDINANCE? .ANSWERI YES NO AND WHEREAS, the foregoing propositions were submitted by ballots to the quali ~ fied voters of the City of Lubbock on April 6 1 1948, after notice of intention to '-,.~. pass an ordinance submitting such amendments was duly given and published in accor- dance with law, and said proposed amendments are set out in full in O~dinance No. 86.3, pursuant to which ordinance said proposed amendments were submitted, THEF~ORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEXASt SECTION 1. That there was submitted to the qualified voters of the City of Lubbock, Texas on April 6, 1948, in accordance with the law, tor the purpose of passing on the question of adopting amendments to the City Charter of the City of Lubbock, Texas, the questions thus submitted and votes on, reading as follows& Amendment No. 1. Do you vote to amend the present City Charter of the City of Lubbock, Texas, by amending and changing Section 8, Article II, Chapter One, relat- ing to claims against the City? Answer! Yes No Amendment No. 2. Do you vote to amend the present City Charter of the City of Lubbock, Texas, b.1 adding Section 8A, Article II, Chapter One, relating to liabilit of the City and special written notice pertaining thereto? Answer: Yes No Amendment No. 3. Do you vote to amend the present City Charter of the City of tubbock by amending Section 23, Article II, Chapter One, relating to establishment of the method and manner of disbursing payroll funds? Answer& Yes No Amendment No. 4• Do you vote to amend the present City Charter of the City of Lubbock by amending and changng Section 1, Article X, Chapter One, relating to the appointment of a City Manager, and which eliminates the existing one year residence in Texas requirement? Answert Yes No Amendment No. 5. Do you vote to amend the present City Charter of tbe City of Lubbock, Texas, by adding Section JA, Article I, Chapter One, relating to and con- cerning the additional power of the City Commission to extend the City boundaries and annex adjacent ter-ritory by ordinance? Answer~ Yes No SECTION 2. That the qualified voters voted on said questions at the polls and cast their ballots and answered the foregoing questions as followss On Amendment No. 1, ~.3 votes answered YES, and .3J!f 2 votes answered NO. On Amendment No. 2, 1!;1 1:1 votes answered YES, and .$3:Zia votes answered NO. On :Amendment No. 3, ~ fi...S'£= votes answered YES, and 7J .s'f votes answered NO. On Amendment No. 4, -:t.k2, g votes answered YES, and L/ II votes answered NO. On Amendment No. 5, ...Z E t:>j votes answered YES, and /,..3 :Z ::2--votes answered NOo That there w~;e only ..Jf.:Z.., o votes in all cast at said election and that a majority there~s cast in the negative in answer to each of Amendments 1 and 2, and that a majority thereof was cast in the affirmative in answer to each of Amendments 3, 4 and 5. . SECTION 3(a). The City Commission has duly canvassed the election returns and find that a majority of the qualified voters do not favor the adoption of amend- ments No. 1 and 2, aforesaid, and that they have been legally rejected. (b) And the City Commission further finds that a majority of the quali- fied voters favored the adoption of Amendments 3, 4, and 5, and that they have legally carried, been adopted and approved. SECTION 4(a). It is1herefore ordered that the s aid proposed Amendments No. 1 and 2 1 be considered and they are hereby disapproved and rejected. . (b). It is therefore further ordered that said proposed Amendments No,. 3 1 4 and 5, be considered and they are here~ approved and adopted and made a part of the Charter of the City of Lubbock, Texas, and that a copy of said ordinance ordering said election, to-wit, Ordinance No. 863, as well as this ordinance be recorded at length in the records of said City.
