THE VICINITY OF 28TH STREET; AND ON THE EAST SIDE OF AVENUE "A!' FROM THE NORTH PRO~ PERTY LINE OF 6TH STREET AS PRODUCED FROM THE WEST, SOUTHWARD!;! TO THE Ht ESENT CITY LIMITS IN THE VICINITY OF 28TH STREET; SAID ORDINANCE NO. 808, CONSTITUTING AN AMENDMENT TO ORDINANCE NO. 729, AND THIS ORDINANCE CONSTITUTING AN AMENDMENT TO THE BUILDING LINES ESTABLISHED IN SECTIONS 1 AND 2 OF SAID ORDINANCE SO THAT THE BUILDING LINES SHALL CONFORM TO THE BUILDING LINES ESTABLISHED BY THIS AMEND• MENT BETWEEN THE POINTS DESCRIBED AND BFDINNING 'AND'EITENDING FROM AVENUE "A" AND 6TH STREET SOUTH ON AVENUE "A" TO 28TH STREET; AND REPEALING SECTIONS 1 AND 2 OF ORDINANCES 808 AND 729, RELATING TO BUILDING LINES THEREIN ESTABLISHED IN SO FAR AS SAID BUILDING LINES ARE MODIFIED AND CHANGED BY SECTIONS 1 AND 2 OF THIS ORDINANCE. WHEREAS, it has become necessary in the public interest, due to changed condi• tiona to modify and change the location of certain building lines established by Ordinance 729, adjusted by Ordinance No. 808, to avoid excessive expense and re- moval of improvements which can and wUl be avoided by the establishment of the building lines as herein described for Avenue "A" between 6th Street and 28th Stree in Sections 1 and 2 of this ordinance, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKI SECTION 1. That Section 1 of Ordinance No. 729 and Ordinance No. 808, of the City of Lubbock, BE, and the same is hereby amended so that said Section 1, shell here• after be and establish the West building line as £ollows1 •section l. (West Side). Beginning at a point in the prese~t . West property line of Avenue A at the South property line of 6th Street; Thence South along the West property line of Avenue A to the center line of lOth Street; Thence in a South westerly direction at an angle of 2•28' to the right with the West property line of Avenue A to a point in the center line of Main Street and 15' West of the Was~ pro- perty line of Avenue A as now located; Thence South parallel to and 15' West of the West property line of Avenue A, said line also being parallel to and 110' East of the East property line of a 20 foot alley in Block 125, to a point ~ the South property line of Broadway, said point also being 15' West of the West property line of Avenue A; Thence East 7.5'; Thence South parallel to and 7.5' West of the West property line of Av&nne A, said line also being parallel to and 117.5 1 East of the East property line of a 20 foot alley in Blocks 141, 157, 173, 189, 205, 221 and 237 to a point in tpe South property line of Lot 13, Block 237, Original Town of Lubbock .County,·Texas, said point also being 7.5• feet west of the West property line ·of Avenue A; Thence South 20.S 1 West a distance of 75.74 feet to a point in the South line of Survey 1, Block o, Lubbock County, Texas, said point also being 224.5 feet West of the East line of Survey 7,-Block B, Lubbock County, Texas; Thence West 9.68 feet ~long the South line of Survey 1, Block o, Lubbock County, Texas; Thence South 31.5 feet to a point in the North line of Lot 2, Block 30, Merrills Addition to the City of Lubbock, Lubbock County, Texas, said point also being 4.2 feet West of the Northeast corner of said Lot 2; Thence South parallel to the East line of Survey 7, Block B and· 4.2 feet West of the East property line of the East one-half (E~l/2) of .Block 30, Merrills Addition to a point in the South line of Lot 16, said Block 30, 4.2 feet West of the Southeast corner of said Lot 16; Thence Southwester- 17 to a point in the South property line of 2oth Street 247.5 feet West of the East pr?perty line of said Survey 7; Thence South l 0 59'30tt East to a point 1303.7 feet 0 0 .. ! That Section 2 of Ordinance No. 729 and Ordinance No. 808 of the City of Lubbock, BE, and the same is hereb,y amended so that said Section 2, shall here~ after be and establish the East building line as followet •section 2. (East Side). Beginning at a point on the East property line of Avenue A at the intersection of the North property line of 6th Street as produced from the West; Thence East 15 1 ; Thence South parallel to and 15' East of the East property line of Avenue A as surveyed on the ground by the City Engineering Depart• ment of the City of Lubbock, to a point on the center line of lOth Street aa pro- duced from the West and 15r East of the East property line of Avenue A; Thence South westerly at an angle of 2•28 1 to the right to a point on the center line of Main Street and on the East property line of Avenue A; thence Southwardly along the East property line of Avenue A as now surveyed and along the projection of the East pro- perty line of Avenue A to the South line of Broadway; Thence East along the South line of Broadway a distance of 7.5'; Thenoe South parallel to and 7.5' East of the East line of AveZJUe A across Blocks 142 1 158, the Railroad right-of-way, 190, 206 and 222 to a point, said point being 75.90 .feet North of the South line o.f Survey 1, Block 0, and 131.681 West of the East line o.f Survey 1, Block O, Lubbock County, Texas; Thence South 2°!1 West a distance of 379.2' to a point, said point being 144.21 West of the East line of Survey 7, Block B, Lubbock County, Texas; Thence South parallel to and 144.2 1 West of the East line of said Surve.y 7, Block B) to a point in the North property line of 2oth Street. Worth and Denver South Plains Railway rightwof-way; Thence South 0° East parallel to and lOOt West of the East line of said Survey 7, to a point 120.95 feet North of the South line of the North onewhalf of said SUrvey 7; Thence South 2° 12' East to the intersection of the pre"" sent City Limits on the Southwesterly r1ght•of-way line of the Ft. Worth and Denver South Plains Rail~.· SECTION 3. The building lines established by Sections 1 and 2 of this ordinance shall be and constitute the building lines on Avenue "A" between 6th Street and 28th Street, in lieu of the building lines established between said points on Avenue •A• by Sections 1 and 2 of Ordinance No. 729 and Ordinance No. 808. SECTION 4• That no building or other structure shall be erected, re-ereoted or substantially repaired or no new building or other structure or part thereof shall be erected or re-erected within said building lines so established by description in Sections 1 and 2 of this ordinance. · SECTION 5. That all structures now extending within such building lines establish- ed by Sections 1 and 2 of this ordinance are hereb.y required to conform to the new building lines established b,y said sections within a period o.f not more than .five (5) yeare from the , 8th day of November, 1945. ====~~9F==~/~ A-=======-================================~=======================91=== 0 . A l \ SECTION 6. The provisions of this ordinance and the building lines herein estab• lished b,y Sections 1 and 2, shall not be construed as in a~ manner repealing a~ provision or amendment to Zoning Ordinance No. 661, it being the purpose and intent of this ordinance to establish general building lines on Avenue "A", between 6th Street and 28th Street between which no improvements shall not be made in any event, and building setback lines and other provisions of the said zoning ordinan~e and amendments thereto shall be and are hereb.y declared to be cumulative of and appli• cable to abutting property, in addition to the building lines herein established, so that building setback lines of the zoning ordinance and Building Code, shall be measured from the building lines herein established b.1 Sections 1 and 2. SECTION 7. And provided further, that where the building lines herein established coincide with or overlap upon any public way, then the zoning and building ordin• anoe setback requirements shall be determined from the existing property lines of such public way, except where the property line lies within the building lines here• in established. SECTION 8. It shall be unlawful for aQT person, firm, corporation, trustee or a~ authorized agent or representative thereof to erect, re·erect or substantially r epair any building or other structure, or to erect or re-erect any new building or other structure within or between the building lines established and described in Sections 1 and 2 of Ordinance 729 and Ordinance 808, as amended by Sections 1 and 2 of this ordinance, and whoever shall violate any such provision thereof, shall upon conviction, be fined not exceeding $100.00. ~ . SECTION 9. The provisions of Section 8 of this ordinance shall not apply·to aqy officer, agent, emplo.yee or other person duly authorized b,y the State ot Texas and/or the City ot Lubbock, when performing aey imprmrement pursuant to the widen ... ing, straightening or extension of the streets andlor right-of-ways contemplated by this ordinance.
