THE STATE OF TEXAS COUNTY OF LUBBOCK CITY OF LUBBOCK 0 0 0 0 0 ON THIS, the 26th d~ of February, 1948, the City Commission of the City of Lubbock, Texas, cionvened in regular session at the regular meeting place thereof in the City Hall, with the following members thereof, to-wit: C. A. BESTWICK, J. RAY DICKEY, F. H. CHILDRESS, W. B. PRICE, JOHN SPIKES, LAVENIA WILLIAMS, MAYOR, Presiding, CGmUSSIONER, {)[I)MMISSIONER, COMMISSIONER, CCMMISSICN.ER, SECREl'ARY, present, and the following absent: _____ N_o_n_e ____________ , constituting a q1orum, when, among other proceedings had, were the following: Commissioner J. Ray Dicker presented for the consideration of the City Conunission an ordinance prescribing rates for the City's Electric Light System. The ordinance -was read in full by the City Secretary. Thereupon, Commissioner W. B. Price moved that the rule requiring that no ordinance shall be passed on the day on which it ie introduced be suspended, and . that in view of the emergency set forth and defined in the pre- &.Ili>le to the proposed ordinance, the same be declared an emergency measure. The motion was seconded by Commissioner F. H. Cbildre~srhis motion was duly carried by the following vote: AYES: Commissioners Dick~r , Chi~~re s s, ~r}ce, Spikes ~d Mayor Bestpick. NOES: None. Thereupon, the Mayor announced that the proposed ordinance had been -\"' ......_ ·a~~lared an emergency measure by unanimous Jote of the Coiiillission. - I \ Thereupon, Commissioner _w_._B_._Pr_i_c_e ___ moved that the ordinance as read in :tull by the City Secretary be finally passed and adopted by the Conmission. This motion was seconded by Commissioner F. H. Childress , and CJ the motion, carrying with it the final passage and adoption of t h e ordinance, was unanimously carried by the following vote: ' AYES: Commissioners Dickey, Childress, Price, Spike s and Mayor Bestpic k NOES: None. Thereupon, the Mayor announced that the ordinance had been finally passed am adopted by unanimous vote of the Commission, in accordance with the requirements of Section 15, 16 and 17 of Article IX, of the Lubbock Charter; and the Mayor thereupon signed and approved the ordinance in the pres.ence of the Commission. The ordinance is as follows: I nAN ORDINANCE by the City Coiiii!lission of the City of Lubbock, Texas, prescribing rates to be charged for service furnished by the Electric Light System owned and operated by said City; repealing all ordinances, orders or resol- utions in conflict; and declaring an emergency •11 WHEREAS, heretofore, to-wit: on the 2nd day of December, 1947, at an election duly held for the purpose, a ma j ority of the qualified electors of said City, voting at such election, authorized the issuance of City of Lubbock, Texas, Electric Light System Revenue Bonds, Series 1948, in the prin- cipal swn of $4,924,000.00; and, WHEREAS, thereafter, to-wit: on the 26th day of February, 1948, the City Commission of the City of Lubbock pissed and adopted that certain ordinance Number 860 authorizing $1,850,000.00 of said bonds, under Articles 1111 et seq., Texas Revised Civil Statutes of 1925, a.s amended, being - - "AN QRDINANCE by the City Commission of the City of Lubbock, Texas, authorizing the iseuance of $1,850,000.00 .'CITY OF LUBBOCK, TEXAS, ELECTRIC LIGHT SYSTEM REVV.ENUE BONDS, SERIES 1948 1 , dated March 1, 194$ (being parcel of a total issue of $4,924,000.00 bonds authorized at the election held in said City on December 2, 1947), for the purpose of constructing improvements, enlargements ex- tensions and repairs to the Cityr s Electric Light System ~ an amount l}ot exceeding $900,000.00; and for the purpose of improving, enlarging and extending and con- structing improvements, enlargements, extensions .· and repairs to t~e City1 s Waterworks System in an amount not ~xceeding -$650,000.00; and for the purpose of constructing l..tnprovements,. enlargement s , extensions and repairs to the Cityr s Sanitary Sewer System in an amount not exceeding $.300,0 00.00; as authorized by the General Laws of the State \/ of Texas, particularly Articles 1111 et seq., Revised Civil statutes of 1925, .as amended; prescribing the fo:nn of the bonds and the form of interest coupons; pledging the revenues of the City's Electric Light System to the payment of the principal. of and interesyon the bonds, after deduction of reasonable expenses of operating and maintaining sairl system; enacting pro- v~s~ons incident and relating to the subject and purpose of this ordinance; and declaring an emergency •11 a.nd which said ordinance is recorded in Book --~ page ___ et seq., of the Minutes of this Commission, to which reference is here made, and which said ordinance provides and stipulates that the City shall fix and maintain rates and collect charges for the facilities and services afforded by its Electric Light System, which will provide revenues sufficient at .all times to pay for all operation, maintenance, depreciation, replacement and betterment charges.Jof the Syst€1!1., to establish and maintain a Bond Fund, and to pay all outstanding indebtedness against the System, other than the bonds, as and when the same becomes due; and, WHEREAS, it now appearing to this Commission that it is necessar.y and proper to prescribe a schedule of rates or charges to be paid for services rendered by the City• s Electric Light System; and WHEREAS, it is to the best interest of the City that the said improvements, enlargements, extensions and repairs to the Cityt s Electric Light SystEIIl, the City• s Waterworks System, and the City• s Sanitary Sewer System be constructed at the earliest possible date, thereby creating this an emergency measure for the immediate preservation of the public peace, property, health and safety, as well as a more efficient administration and operation of said systems and of the municipal government; therefore BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCX : SECTION 1: That the monthly rates or charges for electric service fumished by the City's Electric Light System shall be as follows: Sernee Charge None Energy Charge First Next Excess Mj pigrum Bill 75¢ per Month Discount SCHEDULE RL-1 DOMESTIC ELECTRIC SERVICE 25 KWH 50 KWH llonthl.y bills subject to 10% discount it paid within 10 days from date rendered Service ~ingle ¥base, 110/220 Volt, 2 or 3 wire Application 6¢ per KWH 5¢ per KWH 3~ per KWH This Schedule applies to residences, stores, offices. Service If metered on secondary side of distribution transformers, lighting service may be either 115/230 v9lt, 3 wire single phase or 115 volt 2 wire, single phase. If poly phase power service is required it shall be 3 phase, 230 volts, unless otherwise specified. Where primary metering is used, service supplied will be 2300 volt, single or poly phase as the case may require. APPLICATION This rate schedule applies to all commercial places of business, including stores, shops, factories, warehouses, hotels, lodges, churches, apartment houses on one meter, garage and filling stations. Determjnation of Demaog Consumer's monthly~ demand, shall at the option of the City, be determined by estimate or meas urement. ~ihere it is determined by estimate the following percentage of the Kilowatt equivalent to the total horsepower rating of ~onsumer's contracted load shall be used at the monthly ~ demand. 16 over to 20 R. Statements will be rendered at our regular meter reading dates eac.h rontJ, the amount of such statements to be applied against the deposit made until such deposit shall be absorbed, at which time not later than September 1st. dta.te- ments for additional current used after deposit is absorbed shall than become payable 10 days after regu.lar meter reading date following that in which service is rendered. If paid within the 10 days a discount of 10~ will be allowed. Seryiee Service supplied sh&llt at the option of the City of Lubbock be 220 volt or 2200 Volt, 60 Cycle, 3 Phase, with reasonable variation in frequency and voltage. Appl~cation This rate is applicable for Irrigation power service where motor installation is 20 H. P. or more. Service furnished only under Uontract. SECTIOO 2: That such rates and charges hereby fixed and prescribed shall become due and payable tm days a.:fter the bill for such charges is rendered, and shall be paid by the users of such service of the Electric Light System of the City to the Secretary Qf the City of Lubboc~; and b¥ zones, as now, or hereafter, establ~shed. said bill shall be rendered/~ If not paid within ten days after such bills are rendered the penalties or revocation of discounts shall become effective as prescribed above. SECTION 3: In event any user or customer of such Electric Light Systa:n does not pay matured rates and charges within tlw:8.rtty(t2I))days from the date the same become due and payable, it is hereby made the further duty of the City Secretary to disconnect the electric service; and whenever the amount past due and delinquen t is paid by such user or customer, such service may be resumed, but there shall be charged and collected a re-connection charge of $1.00· SECTION 4: That no free service shall be allowed; and to the extent that the City of Lubbock, Texas, or any of its agencies or instrumental- ities avail themselves of the service and facilities provided by the Electric Light System, they shall ray therefor the same rates and charges herein prescribed. SECTION 5: That all ordinances, orders, or resolutions, or parts thereof, heretofore pass.ed and adopted by the City Commission in conflict herewith, shall be, ani the same are hereby repealed •. SECTIQIJ' 6: That the public importance of this measure and the fact that it is to the best interest of the City that the authorized construction of improvements, enlargements, extensions and repairs to the City's Electric Light System, the City• a Waterworks SystEm and the City • s Sanitary Sewer Systen, as here- inabove set out, be effected at the earliest possible date, creates this an emer- gency measure for the immediate preservation of the public peace, property, health and safety, as well as a more effici~t administration and operation of the City•s above mEntioned Systems, demanding that the Charter provisions to the effect that no ordinance shall be passed on the day on which it shall be introduced, be sus- ' .... " . pended, and this ordinance is hereby declared an emergency measure by unanimous vote of the City Commission, and the same shall take effect from and after its passage, and it is so ordained.
