BE IT OrillA.I.NED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEUS1 SECTION 1. There is hereby created aDd established a Cemetery Board to be com- posed of five (5} members, and eaoh member shall be a resident citizen of the City of Lubbock, Texas, and said board shall be officially designated as the •Cemetery Board" of the City of Lubbock, Texas. The members of said board shall be appointe< by the City Commission of the City of Lubbock and shall bold their office for a term of ten (10) years, provided that the meabers first selected shall hold office for wrms o£ two, t01U'1 six1 eight and ten years respectively, the term of eaoh to , be determined b,y lot, and thereafter their sucoessors shall hold office for ten (10) years and/or until their successors are appointed. ~ SECTION 2. Upon the death, resignation, reaoval or expiration of the term ot office of a~ ·Of the members of said Cemetery Board, the City Commission shall nomiD&te and ~ppoint a successor as a member of said board who shall hold his membership on said board tor the unexpired term of the member he is appointed to succeed,· or for the period of ten (10) years when the appointment is made due to the expiration CJf a board members tel'lll, and further provided that in the event the best interest of the Ci~ of Lubbock requires the removal of aqr member of said board, reaoval of such member shall be effected through appointaent of such member• successor by unanimous vote of the City Commission. SECTION 3. No salarr or compensation of any sort shall be paid to the members ot said Cemetery Board for their servioea except ex officio members employed by the City of Lubbock. SECTION 4• When the City Commission of the City of Lubbock has appointed five (5) members to compose the Cemeter.y Board of the City of Lubbock, said board shall, as soon thereafter as is practicable, aeet and organize and shall appoint one of its members as Chairman and one of its members as Secretar.y, and it shall be the duty of the Chairman to preside at all meetings of the Board, and the Secreta.%7 shall keep a record of all the proceedings of said Board, which shall upon the request of the City Commission be delivered to it for its inspection and revi••• SECTION s. ~ and all recommendations made by said board to the City Commie• sian shall be by the o0110urring vote of three (3) members of the board, provided however, this provision shall .not exclude a. mioori ty reo0111aelidation which is hereby authorized to be made in writing by' lesa than a majority of the members of said board, and a majority of the total membership of said board shall constitute a quorua for the transaction of all matt~re to be considered b,y said board. SECTION 6. The Cemetery Board hereb,y created is, and shall constitute an advisor,y board to the City Commission of the City of Lubbock, with full power to consider all matters pertaining to cemeteries. ---- SECTION 7. The following resident citizens of the CitT of Lubbock are hereb.r appointed as members of the Cemetery Board,· namely: o. w. Ribble Joe Nialar Charles Bacon Chaa. E. llaadgen, Jr. P. F. Brown The fact that there is an iDilediate need for stucy and consideration of matters iDVolving the ownership, care, custody alld maintenance of cemetary propertT near the CitT of Lubbock, and the fUrther fact that several hundred interested citizens or the City of Lubbock have petitioned the City Commission to assume the direction, care and maintenance of certain oeaete17 property in the public interest creates an emergency and necessity for suspending all rules that ordinances be read on several days aDd the said rules are hereby suspended and this ordinance sb&ll become effective upon its first reading and passage.
