IHEREAS, Article 1105a, Revised Civil Statutes of Texas provides for the estab- lishment of building lines on &1\f part or side ot aD¥ street in the City ot Lubbock, said City ot Lubbock having a population of aore than 15 1 000, and, WHEREAS, the CitT COIIDiission ot the City ot Ll~ has heretofore by Ordinance Ho. 816, established a Borth and South building line along .34th Street as therein described; &lid, WHEREAS, said Ordinance No. 816, established the South buildiag line alOQK the South Section line of Section 9, from a point beginning at the Northeast corner ot Section 14, Block B, THENCE East 7920 teet to a point in the North-south halt aeo- tion line ot Section 71 Block B, Lubbock County, Texas, said point being in the South line of Section 71 Block B, Lubbock County, Texas, said aecti~:n line bein,;c at the time at the passage~ said Ordinance No. 816, the South City Liaits liDSJ and- " WHEREAS, subsequent to the establishment of said Korth and South building line1 b.f said Ordinance No. 816, aforesaid, that portion ot Section 10, Block B, l7ing South of .34th Street, and North ot 42nd Street, and East of the West line of Section 10, 4540 teet, haa been taken into the corporate limits ot the City of Lubbock; same being that portion or said Section 10, Block B, Lubbock County, Texas, lying East ot College Avenue, and West of .tvezme Q, and South ot .34th street, a:nd North ot 42nd street, Lubbock, TexasJ and, · 11HEREAS, the City Comaission or the City of Lubbock now desires to amend said Ordinance Bo. 816, in order to re-establish a South building line along that portion ot 34th Street lying between the West section line of Section 10, 4540 feet East, tol the West property line ot Avenue Q1 in connection with the widening, straightening and iaproving of that part ot .34th Street, aforesaid, to prevent further buildi~Jgs, structures or improvements ot any nature being placed within the area required for such needed 4111111.-widening, straightening and improving said .34th Street; and, IHEREAS, widening, straightening and improving said street and the establiShment of such building line aforesaid, is necessar,y and will ultimately provide a street of desirable and adequate width which will aid in relieving heavy traffic in con• jested areas in accordance with the Cit.y'a comprehensive plan, THEREFORE. BE IT ORDAINED BY THE CITY COPMISSION OF THE CITY OF LUBBOCK, TEXAS& Section 1. That, that part of Ordinance lo. 816, establishing the South build• ing line for 34th Street, Lubb~k, Texas, along and from a point beginniDg at the Northeast corner of Section 14, Block B, Lubbock County, Texas, Thence East 4540 teet to a point in the South Section line of Section 9, Block B, Lubbock County, Texas, 740 .feet West at the Southeast corner of said Section 9, aforesaid, be, and is hereby 81lended, and said South building line as established by ~Ordinance No 816, for that portion of said 34th Street, aforesaid, is hereby re-established, to be as follows; •Beginning at a point 40 feet South of the Northwest corner of Section 10, Block B, Lubbock County, Texas; THENCE East 4540 feet to a point which is 40 feet South of the North Section line of said Section 10, Block B, aforesaid, and 740 feet West of the East Section line of said Section 10, Block B, aforesaid, • Said point also being in the West property line of AveDUe Q; THENCE North 40 .feet to the North Section line or said Section 101 Block B, aforesaid.• Section 2. That no building or other structure sh~l be erected, reconstructed or substantially repaired and no ~ building or other structure or part thereat shall .be erected or re-erected between or within the Borth building line as astab~ lisbed b7 Ordinance No. 816, and the South building line as re-established for 34th Street b.r this ordinance. Section 3. That all structures on and between said Borth building line as established 'by Ordinance No. 816, and that part of the South building line as re• established tor 34th Street by this ordinance, or extending in whole or in part within such building lines, aforesaid, are hereby" required to oontorm to the North building lint.as established by said Ordinance No. 816, and that part or the South Buildipg line asfi;ltablished by this Ordinance, within a period of not more than five ( 5) ·years from the effective date of this ordinance. Section 4• It shall be unlawful for ~ person, f~ra or corporation, trustee or a~ authorized agent or representative thereof, to erect, reconstruct or sub- stantially repair ~ building or other structure, or to erect or re-erect a~ new building or other structure within or between the North building line as establish b.r Ordinance No. 816, and that part of the South building line as re-established bT this Ordinance, for 34th Street, and whoever shall violate a~ provisione of this section shall, upon,oonviction, be fined not exceeding $100.00. Section 5. The provisions or Section 4 of this ordinance shall not applT to a~ agent, officer, ellployee or ~ ~rson duly authorized b;y the State of Texas and/or the City of Lubbock when performing ~ emplo_yment pursuant to the widening, straightening or extension of the street and/or right-at~ contemplated by this ordinance. Section 6. Further provided, that no portion of the North and South building lines for 34th Street, as established in Ordinance No. 816, is affected by this aaendment, save and except that portion of the South building line as re-establisbe in ibis ordinance. Provided f'urtber, that that portion at the South building line tor 34th Street, beginning at the Northeast corner or Section 14, Block B, Lubbock County, Texas, and running East 4540 feet, to a point in the South Section line of Section 9 1 Block B, :Wbbock County, Texas, is hereby repealed, and is hereby re- established, as described in Section 1, of this Ordinance.
