AN ORDINANCE REVOKING THE PROVISIONS OF ORDINANCE NO. 643 1 BEI~ ENTITLED

ORIGINAL TOWN OF LUBBOCK, TEXAS,. A. NUISANCE, MEifACE AND DAN:fER TO THE PUBLIC
WELFARE AND SAFETY; AND CLOSING SA.ME.•; A FINDING THAT SAID ALLEY IS NEEDED AS A
PUBLIC ALLEY, THAT SAID ALLEY HAS BEEN CONTINU'AIU OPEN AND USED AS SUCH ALLEY
FOR MUNICIPAL PURPOSES; AND OPENI:t«l SAID ALLEY FOR. ALL ALLEY PURPOSES.

inadvertentq passed b.T mistake and said alley has remained open aDd used tor
oustoma.r;y alley purposes since the passage ot said ordinance 1 and,
WHERE&S, said alle7 has continuallY been and now is being used tor utilit7
purposes including power lines aDd garbage disposal and transportation aDd it is
a contiDUiag public need to aaintain said alle7 tor all aunicipal purposes and in
the public interest; THEREFORE,
BE IT ORDAINED BY THE CIT!' COMMISSION OF THE CITI OF LUBBOCKI
SECTION 1. That Ordinance No. 643, t1nall7 dated March 29, 1940, entitled
"ORDINANCE DECLARING ALLEY LYI:tll IMMEDIATELY NORTH OF IDT 6 IN BlOCK 130, IN THE
ORIGINAL TOWN OF LUBBOCK, TEXAS, A NUISANCE, MENACE AND DANGER TO THE PUBLIC
WELFARE AND SA.FETI; AND CLOSING SAME.", BE, aDd the same is hereby in all things
v revoked.

SECTION 2. That all that part ot the alle7 1mmediatel.7 North ot Lot 6 in Block
130 in the Original Town ot wbbook, Lubbock Count71 Texas, is hereb;y fOUDd and
declared to be necessary to the public welt are and saf'et7, that such need has been
a contimrl.Dg need aDd the same has been continua.l.q used tor utilit7 purposes alld
open tor-the usual alley purposes since prior to the passage ot Ordi~ee No. 643,
and should in the public interest remain open for alle7 purposes.
SECTION 3. That part ot said all.e7 hereby' opened is described as tollowsl
BEGINNING at the Northwest corner ot said Lot 6; THENCE East to the Northeast corner
ot said lot; THENCE North to the North side of said alle7; THENCE West to the
Southwest corner ot Lot 1 in said Block 130; THENCE South to the place ot beginni~.
SECTION t.. That said alley described in Section 3 ot this Ordinance is hereby
opened.

ORDINANCE NO. 643
ORDINANCE DECLARING ALLEY LYI NG IMMEDIATELY NORTH OF LOT 6, IN
BLOCK 130, IN THE ORIGINAL TOWN OF LUBBOCK, TEXAS, A MUISANCE,
MEIACE IND DANGER TO THE PUBLIC WELFARE AND SAFETY; AND CLOSING SAME.
BE IT ORDIINED BY THE Crl'Y COMMISSION OF THE CITY OF LUB:OOCK, TEXAS:
SECTION 1 ~ J.hat all of that part of the alley lying inmediat ely north
of lot 6 in Block One Hundred Thirty (1.30), in the Original 'lown of
Lubbock, in Lubbock County, Texas, is hereby found and declared to be
a •uisance, menace and danger to the public safety and welfare.
That part of said alley covered by this ordinance is described as
follows:
BEGINNING at the northwest · corner of said Lot 6;
THENCE east to the northeast corner of said lot;
THENCB North to the north side of said alley.;
THENCE West to the southwest corner of Lot 1,. in
said Block 130
THENCE south to the place of beginning.
SECTION 2: That the aforesaid alley as above described is herebp closed.
Passed and approved first readi ng this 19th day of March, 1940
Passed and approved second reading this 29th day of March, 1940.
