HomeMy WebLinkAboutOrdinance - 833-1947 - Prohibiting Fireworks - 10/23/1947\}_ / Ordinance No. 7510 Amending Ordinance No. 833 I0-23 -1.94-=7 ORDINANCE NO. 833 II-I 4--1.94 7 AN ORDINANCE PROHIBITING THE CASTING, THROWING OR FIRING OF FIREWORKS; PROHIBITING THE .POSSESSION WITH INTENT TO GIVE AWAY, THE SALE OR OFFERING FOR SALE OF ANY COM• BUSTIBLE FIREWORKS OF ANY KIND WITHIN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK; EXEMPTING WHOlESALERS FROM THE PROVISIONS OF THE ORDINANCE WHERE SALES ARE MADE TO MERCHANTS OUTSIDE THE CITY LIMITS, OR TO SALES BY WHOLESALERS FOR PRIVATE OR PUBLIC DEWNSTRATIONS; EXEMPTING RAILROAD TRACK TORPEDOES WHEN USED AS SIGNALLINB DEVICES, FLASHLIGHT COMPOSITION USED BY PHOTOORAPHERS OR DEALERS IN PHOTOORJ.PHIC SUPPLIES J PROVIDING FOR PUBLIC AND PRIVATE DISPLAY Q' FIREWORKS UNDER POLICE SUPERVISION., PRO- VIDING FOR PER.MI:TS, INSPECTIONS; PROVIDING FOR THE REMOVAL OF ALL STOCKS OF FIRE- WORKS EXPOSED FOR SALE OR HElD IN STOCKJ AND PROVIDING A PEN.A.LTY. WHEREAS, personal injuries and property damage, both affecting the public eatety, have heretofore been occasioned b.r the indiscriminate sale and use of £ireworka with- in the corporate limits of the City ot Lubbock, and prohibition of such use of tire- works within the corporate limits is deemed in the public interest, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK& SECTION I. SHOOTING PROHIBITEDf No person, firm, compaqy, corporation or aesocia tion shall cast, throw or fire a~ squib, rocket, cracker, torpedo, grenade, gun, revolver, pistol, cap or cartridge or other coabustible fireworks of ~ kind iD the CitT of Lubbock. SECTION II. SELLING PROHIBITEDa No person,fil'll, ccapaey, corporation or associa- tion shall exhibit or have in his possession with intent to give away, sell, offer tor sale, or sell within the Cit7 ot Lubbock a~ squib, rocket, cracker, torpedo, grenade, gun, revolver, pistol, cap or cartridge or other combustible fireworks of aey kind; provided however; that this ordinance shall n.ot apply to the sale ot aD,T suoh article or articles b.Y wholesalers to each other or to the sale of &lJiY suah article or articles at wholesale to merchants conducting businesses entirely with• out the City of Lubbock, or to the sale b.r wholesalers for private or public demon• strations as hereinafter provided. SECTION III. EXCEPTIONS TO PROVISIONS OF PRECEDING SECTIONS • DISPLAYS OF FIRE- WORKS. Nothing in this ordinance shall be construed to apply to the sale, storage or use of railroad track torpedoes or other signalling devices used b.Y railroads nor to the sale, storage or use ot flashlight composition b7 photographers or dealers in photographic supplies, or to prevent a~ public or private demonstration or display of fireworks ot aqy kind it conducted under proper police supervision after applicaw tion made and permit issued by the chief of the fire Department of the Cit7 of Lubboc r such demonstration. Said permit shall not be granted unless such demonstration or display shall be of such a character and so located, discharged or tired, as in the opinion of the said chief of the Fire Department, after proper inspection, shall not be hazardous to property or endanger an;y per_son or persons. SECTION IV& PENALTY. Any person, fim, eorporation, compa~ or association who shall violate aDY of the provisions of th'• Ordinance, or suffer or allow the same to be violated shall, upon conviction therefor, be subject to a fine of not sore th one hundred dollars. SECTION V • STORING OR "$ELLING FIREWORKS AT WHOLESALE. It shall be unlawful to store or sell an;y fireworks at wholesale except by permit from the fire chief or fire marshal, issued for ~period o£ thirty days. An application for such permit must be filed with the fire chief or fire marshal at lea~t ten days previous to the using thereof, and must give a detailed description of the proposed care and storage of said materials and of the structural conditions am occupancies of the building. Permits may be issued only after an inspection of the premises by the fire chief or fire marshal or his authorized agent who shall file with the city manager a certificate of approval or disapproval and his reasons therefor. The fire chief or fire marshal m~, at his discretion, remove or have removed• at the owner 1 s expense, all stock of fireworks or other combustibles exposed for sale or held in stock in violation of this ordinance. Nothing contained in this section shall relieve the applicant from personal responsibility in connection with such storage. AND IT IS SO ORDERED.
