ORDINANCE NO. 832
AN ORDINANCE AND ORDER BY THE CITY COMMISSION OF THE CITY OF LUBBOCK,
TEXAS, CALLING AN ELECTION TO SUBMIT TO THE QUALIFIED VOTERS OF THE CITY OF
LUBBOCK THE PROPOSITION TO DETERMINE WHETHER OR NOT THE CITY OF LUB:OOCK
SHALL ADOPT OR REJECT THE PROVISIONS OF HOUSE BILL NO. 341 PASSED AT THE
REGULAR SESSION OF THE 50TH LEGISLATURE, THE SAME BEING DESIGNATED AS
ARTICLE 1269 ... M OF THE REVISED CIVIL STATUTES OF TEXAS, .AND WHICH RELATES
TO AND PROVIDES FOR CIVIL SERVICE FOR FIREMEN AND POLICEMEN IN CITIES OF
TEN THOUSAND (10,000) POPULATION OR MORE; PROVIDING FOR THE ELECTION; PRE-
SCRIBING THE PLACE AND TIME OF HOLDING THE SAID ELECTION; APPOINTING ELECTION ~·· OFFICERS; PROVIDING THE QUALIFICATION OF VOTERS, ELECTION SuPPLIES AND RE ...
TURNS INCLUDING THE MANNER OF HOLDING SUCH ELECTION; AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Lubbock, according to the laa~ preceding Federal
Census, was a Gity with 31,853 inhabitants, and House Bill No. 34, passed
at the Regular Session of the 50th Legislature, and being otherwise desig-
nated as Article 1269-M of the Revised Civil Statutes of Texas, provides
for an election in all cities of over Ten Thousand (10,000) population
whereby the question of the adoption or rejection of the provisions of said
Act relating to Firemen's and Policemen 1 s Civil Service shall be adopted or
rejected by the qualified voters of the City of Lubbock, and,
WHEREAS, said act provides that such election shall be held within
ninety (90) days after adjournment of the 5oth Legislature;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
LUBBOOK&
I.
That an election be held within and throughout the boundaries of the
City of Lubbock, Texas, on the first Tuesday in December, 1947, the same
being the 2nd day of December, 1947, at which time there shall be submitted
to the qualified voters of the City of Lubbock, Texas, the following propos!-
tion:
fROPQSITION
Shall the City of Lubbock adopt or reject the provisions of House Bill
No. 34 passed at the Regular Session of the 50th Legislature, being Article

1269•M of the Revised Civil Statutes of Texas and being AN ACT creating a
Firemen•s and Policemen's Civil Service in cities having a population of ten
thousand {101 000) inhabitants or more; defining certain terms used in said
Act; providing for a Fireaen1 s and Policemen•s Civil Service Commission aDd
providing the method whereb,y the same shall be appointed and the qualitica-

tiona of the Commissioners; providing for the organization of said Commission;
/ providing for the powers of said Commission; providing that said Commission
shall make rules and regulations pertaining to Firemen and Policemen and
that said rules and regulations shall prescribe the cause for removal or
s~spension of employees of the Fire and Police Departments; providing cerM
tain grg unds for removal of employees of Fire and Police Departments; pro-
viding for the position of Director of Civil Service; providing for the
office space for said Commission; providing for the removal of the Director
of Civil Service; providing for the civil s~rvice classification of Firemen
and Policemen; providing for the exaBdnation for eligibility lists; provid-
ing the method of filling positions ot the Fire Department and Police Depart-
ment; providing for the certification of employees; providing for probation•
ary and full•tledged Firemen and Policemen; providing for notice of examina-
tions; providing for promotions in the Fire Department and Police Department;
providing for the civil service rights of Department heads; providing far
suspension and reinstatement of Firemen and Policemen,anl the method of
procedure in connection therewith; providing certain additional rules of
procedure before the Commission; providing for an appeal to the District
Court; providing for the procedure in demotions; providing for disciplinary
suspensionsJ providing for reduction of force and reinstatement list; pro-
hibiting certain political activities of Firemen and Policemen; providing for
r~quiring publishing of rules, regulations and listsJ providing for status
of present employees; providing certain penalties; providing sick and injur,y
leaves; providing that Firemen and Policemen shall not be permitted to strike
or take a~ part in a~ syapatbetic strike, and providing penalties therefor;
providing that special elections shall be called ninety (90) days after the
effective date of this Act, in each city, to determine if cities shall

adopt the provisions of this Act; and providing the manner in which the pro-
visions of this Act may be resubmitted to the people annually thereafter; and
providing the manner in which cities adopting this Act ~ submit the matter
to the people for a repeal thereof at an election to be held for that pur-
pose; providing for a repealing and saving cl~use; and declaring an
emergency.

II.
Said election shall be held under the provisions of and in strict contor-
miti with the Constitution and Laws of the State ot Texas and the Charter of
·the City of Lubbock, and all acts amendatory, complementary and supplemental
thereto.
All persons who are legally qualified voters of the City of Lubbock,
Texas, shall be entitled to vote at said election.
III.
The ballots for said election shall have written or printed thereon the
following, to-witJ

PROPOSITION
FOR THE ADOPTION of the provisions of House Bill No. 34, passed ,t the
Regular Session ot the 5oth Legislature, providing Civil Service for Fire-
men and Policemen in cities of ten thousand (101 000) population or more.
AGAINST THE ADOPTION of the provisions of House Bill No. 34 1 passed at the
Regular Session of the 50th Legislature, providing Civil Service for Fire•
men and Policemen in cities of ten thousand (101 000) population or more.
As to the foregoing proposition, each voter shall mark out with black
ink or pencil one of the expressions, thus leaving the other as indicating
his vote on the proposition.
IV.
Said election shall be held at the Central Fire Station Building at
the corner of loth Street and Avenue J in the Cit7 of Lubbock, Texas, and
the presiding judge and clerks of said election shall be as follows, to-wit:

That notice of said election shall be given by posting a substantial
copy of this Ordinance at the City Hall Building and at two other public
places in the City of Lubbock and such notice shall also be published on
the same day in each of two successive weeks in a newspaper of general
circulation published within the City of Lubbock, the date of the first
publication to be not less than thirty (30) days prior to the date set
for said election.
The Mayor and City Secretar.y shall cause such notices to be prepared
and posted and published and shall make due returns thereof to this City
Commissi."'J)n.
VI.
Immediately after said election has been held, the officers holding
the same shall make returns of the result thereof to the City Secretary
of the City of Lubbock, for canvass~ by the City Commission and shall
return the ballot boxes to the City Secretar.y for safekeeping.
The manner of holding such election and canvassing and making returns
thereof shall be governed b,y the general election laws of the State of
Texas, when not in conflict with the provisions of the hereinabove men-
tioned statutes, and the City Commission will furnish the necessary
ballots and other election supplies requisite for said election.
VII.
The fact that the adoption or rejection of the Act herein being sub•
mitted to the qualified voters of the City of Lubbock requires submission
within ninety (90) d~s after adjournment of the Regular Session of the 5oth
Legislature and the time is running short, and the t'urther fact that an
election will be held on said date submitting other issues to a vote of the
people and setting the time and place for submission of the issue herein
~volved on the same date and at the same place makes voting more convenient
~ ·and in the public -interest, creates an emergency and public necessity demand-
ing that the rule requiring the reading of this Ordinance on more than one
day before final passage be suspended and such rule is hereb,y suspended
and this ordinance shall take effect and be in force immediately upon its
passage and adoption.
AND IT IS SO ORDERED.
