HomeMy WebLinkAboutOrdinance - 831-1947 - Calling An Election First Tuesday Dec 1947 - 10/23/1947lO-za.-1.947 ORDINANCE NO. 831 AN ORDINANCE AND ORDER BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, - TEXAS 1 CALLING AN ELECTION TO SUBMIT TO THE QUALIFIED VOTERS OF THE CITY OF LUBBOCK THE PROPOSITION TO DETERMINE WHETHER OR NOT THE CITY OF LUBBOCK SHALL ADOPT OR REJECT THE PROVISIONS OF SENATE BILL NO • .36, PASSED BY THE REGULAR SESSION OF THE 50TH LIDISLATURE 1 THE SAME BEING DESIGNATED AS •ARTIClE 158.3·2" PROVIDING MLNIMUM SALARIES FOR. .fiREMEN AND POLICEMEN ACCORDING TO LENGTH OF SERVICE AND POPULATION; PROVIDING FOR THE ELECTION; PRESCRIBING THE PLACE AND TIME OF HOLDING SAID ELECTION, THE QUALIFICA- TION OF vcm:RS, PROVIDING SEPARATE BALLOTS, ELECTION SUPPLIES AND RETUIUfS, INCLUDING THE MANNER OF HOLDING SUCH ELECTION;.L'ID DECLARING AN EMERGENCY. _.. 0 WHEREAS, the City of Lubbock according to the last preceding Federal Census was a city with 31,853 inhabitants and Senate Bill No. 36, passed by the Regular Session of the 5oth Legislature amends Article 1583 of the Penal Code of Texas and provides for an election in cities of such popula- tion submitting adoption of the provisions of the Act to a vote, and, WHEREAS, the Act designated as "Article 1583·2" provides minimum 4alaries for firemen and policemen according to length of service and population as and when provisions of the Act are a<iopted by a majority of . the people voting at an election sublai tting the Act f'or adoption or rejection, NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK& I. That an eleotion be held within and throughout the boundaries or the City of Lubbock, Texas, on the first Tuesday in December 194 7, the same being the 2nd day of December , 1947, at which time there shall be submitted to the qualified voters of the City of Lubbock, Texas, the following propositions& PRQPOSITION Shall the City of Lubbock adopt or reject the provisions of Senate Bill No. 36, passed by the Regular Session of the 5oth Legislature, the same being designated as Article "1583~2n, providing minimum salaries for firemen and policemen according to length of service and population. II. Said election shall be held under the provisions of and in strict confor~ mity with the Constitution and Laws of the State of Texas and the Charter or the City of Lubbock, and all acts amendatory, complementar,y and supplemental thereto. All persons who are legally qualified voters of the Cit7 of Lubbock, Texas, shal+ be entitled to vote at said election. III. The ballots for said election shall have written or printed thereon the following, to-wit& '\ .. PROPQSITIOB FOR THE ADOPTION of the provisions of Senate Bill No. 36, passed by the Regular Session of the 50th Legislature, the same being designated as Article "1583·2A, providing minimum salaries for firemen and policemen according to length of service and population. AGAINST THE ADOPTION of the provisions of Senate Bill No. 36, passed by the Regular Session of "the 5oth Legislature, the same being designated as Article •1583w2a, providing minimum salaries for firemen and policemen according to length of service and population. A. to the foregoing proposition, each voter shall mark out with black ink or pencil one of the expressions, thus leaving the other as indicating his vote on the proposition. rv. Said election shall be held at the Central Fire Station Building at the corner of lOth Street and Avenue J in the City of Lubbock, Texas, and the presiding judge and clerks of said election Shall be as follows, to-wit~ Glen Hess B. PresidiDg Judge Clerk Clerk Clerk Clerk That notice of said election shall be given ~ posting a substantial copy of this Ordinance at the City Hall Building and at two other public places in the City of Lubbock and such notice shall also be published on the same day in each of two successive weeks in a newspaper of general circulation published within the City of Lubbock, the date of the first publication to be not less than thir.ty (JO) da.ya prior to the date set for said election. ·The ~or and City Secretar,y s~ll cause such notices to be prepared and posted and published and shall make due returns thereof to this City Commission. VI. ImmediatelT after s aid election has been held, the officers holding the same shall make returns of the result thereof to the City Secretar.y of the City of Lubbock, for canvassing by the City Commission and shall return the ballot boxes to the City Secretar.y for safekeeping. The manner of holding such election and canvassing and making returns thereof shall be governed by the general election laws of the State of Texas, when not in conflict with the provisions of the hereinabove men- tioned statutes, and the City Commission will furnish the necessar.y ballots and other election supplie$ requisite for said election. VII. Separate ballots, election supplies and returns shall be furnished the Election Officers and separate returns made by the Election Officers. VIII. The fact that the Act herein being submitted to the qualified voters of the City of Lubbock requires submission within ninety (90) days after the effective date or the Act and the time is running short, and the further fact that an election will be held on said date submitting other issues to a vote and set~ing the time and place for submission of the issue herein involved on .th~ same date and place makes voting more con• venient and in the public interest, creates an emergency and public necessity demanding that . the rule requiring the reading of this Ordinance on more than one day before final passage, be suspended, and such rule is hereb.f suspended, and that this Ordinance shall take effect and be in force immediately upon its passage and adoption.
