ADDITION TO THE TOWN OF LUBBOCK, TEXAS, TO A POINT IN THE SOUTH LINE OF BWCK 10, IN
SAID MERRILL ADDITION.
I BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, TEXAS:

SECTION la That the Fort Worth & Denver South Plains Railwlq CompeJ:l1', its assign•
eee, successors, and lessees, be hereby granted the right, power and privilege of
' locating, building, erectiug, constructing and properly ms.intaining two railroad in-
. dustry tracks with the necessary tum-outs, switch stands and other neoeesar.y appli•
, ances connected therewith, and to operate engines, oars and trains thereon, upon,
along and across the north and~uth alley between Avenues E and Fin Blocks 11 1 12
and 13, in the Merrill Addition to the Town of Lubbock, Texas, to a point in the
South line of Block 10, in said Merrill Addition. 1
SECTION 2& That the Fort Worth & Denver South Plains Railway Gompan,y, its assign-!
ees, succeseore, and lessees, are hereby required and b.Y the acceptance of this '
ordinance agree that they will construct, maintain and operate said industrial tracks
and the B1l'i tches, turnouts and other n.ecessary appliances incident thereto, so as to
I conform to the grade or said al1ey, and in such manner as to inte:rf'ere as little as

possible with the use and enjoyment, ingress and egress of the abutting premises b,-
the owners and other lawful occupants thereof, will pay cost of paving spaee occupied j

by the said tracks, 1.f said alley should be paved, and will maintain and operate said !

trackl!l and other facilities, switches and turnouts incident thereto in accordance
l witb the laws or the State of Texas and the lawful ordinances and resolutions of the
City of Lubbock in such eases made and provided.
SECTION 31 It is hereby understood that the City of Lubbock shall not be liable
to aD1 person for damages done or property taken on account of this grant, and that
1 the grantee hereof shall reimburse the City of Lubbock and save it harmle.ss from all
1 claims arisiDg on account of such grant.
