TENSION OF THE INDWTRY TRAC!f NOW SERVING LUBBOOK STEEL WORKS, THIS EXTENSION BEIIG ACROOS .3RD STREET AT A POINT APPROXIMATELY 15 t EAST OF THE EAST PROPERTY LINE OF AVENUE 11P" IN THE CITY OF LUBBOOK; REQUIRIW GRADING CONFORMA~E; PAVING APPORTION• MENT AND INDEMNITY AGAilaT LQSS BY THE CITY OF LUBBOOK. WHEREAS, Lubbock Steel Works desires to extend its industrial track South tar a di - tance, which will require a crossing at 3rd Street approximately 15' East of the East 1 property line of Avenue 8 P 11 and the Panhandle and Santa Fe Railroad CompaJ\Y desires the right to make such extension and the governing body of the City o£ Lubbock deems such extension necessary and in the public interest, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOOK, TEXAS& Section 1. That the Panhandle and Santa Fe Railroad Compaqy, a corporation, its assignees, successors and lessees BE, and the same are hereby granted the right, power and privilege of locating, building, erecting, constructing and properly main- taining a railroad industry track, and to operate engines, oars, and trains thereon, upon, along and across .3rd Street at a point approximately 15 1 East of the East property line of Avenue "P", as a South extension to the industry track now serving the •uhbock Steel Works, said location being within the corporate limits of the City or t~bock, Texas. __ .. Section 2. That grantee and its assignees, successors and lessees are hereby required by the acceptance of this ordinance to construct, maintain and operate said industrial track and incidents thereto so av to conform to the grade now, or here• after to be established by the City Engineer of the City of Lubbock, and in such manner as to interfere as little as possible with the use and enjoyment ingress and egress of the abutting premises by the owners and other lawful occupants thereof, and pq all coatiS of paving the space occupied by said track, if and when said street is paved, and will maintain and operate said track and other facilities in• cident thereto in accordance with all l•ws of the State of Texas and the lawful ordinances and resolutions o£ the City of Lubbock in such cases made and provided. Section .3. It is hereby understood that the City of Lubbock shall not be liable to ~ person for damages done or property taken on account of this grant, and that the grantee hereof shall reimburse the City of Lubbock and save it harmless from all claims arising on account ot, or resulting from this grant.
