WHEREAS, the Cit7 Engineer prepared rolls or statements for the improvements in
each District or Unit, showing the amounts to be assessed against the various par•
cels of abutting property, and the owners thereot, and showing other matters and
thi.ngs; and same were examined by the City COIIIdseion and approved, and a tiM and
place was fixed for a hearing to the owners of such abutting property, and to all
~thera i~ ~ wise interested, and due and proper notice was given, and such bearing
,was had and held at the time and place fixed therefor, to-wit, on the 23rd
'day of Ma:r , .l.D. 1946 at 2&30 o 1clock P.M., in the Colllllliasion
Room in the Cit7 of Lubbock, Texas, and at such hearing all desiring to be heard were
fully and fairly heard, and evidence was received and considered and all protests
and obj actions made were considered, and said hearing was in all respects held in
the 1118.1Dler provided and required by the Charter and Law in force in this Cit;r and b,-
the proceedings of the City with reference to such matters, and the followillg pro-
tests were made concerning the iaprovement in the units indicated namely I NONE.
And all ohjections and protests made were fully considered and said hearing was
continued from day to dey and from time to time until this date, and iilie City CC!)Il•
mission having fully and fairly heard all parties making aQ1 protest and all parties
desiring to be heard, and having fully considered all matters presented tor consider-
ation, and having fully considered all of the a•idence, and all pertinent and proper
mattera~is of opinion that the following disposition should be made o£ such protests

THEREFORE, BE IT aiDAINED BY THE CITY COMMISSION OF THE CITY OF :LUBBOOX, TEDSt
That all protests and objections, whether herein specifically mentioned or not,
shall be and the same are hereby overruled and the said hearing, with respect to
each aDd all ot said Unite, is hereb,y closed.
II.
The Ci~ Commission, from the evidence finds that the assessments herein levied
shall &e made and levied against the respective parcels of propert7 abutting upon
the said portions of streets and alleys, and avenues and against the owners of such
property, and that sueh assessments are right and proper and established substantial
justice and equality and uniformity between the respective owners and respective pro•
perties, and between all parties concerned, considering benefits received and burdens
imposed, and further finds that in each case the abutting property assessed is spec•
ially benefited in the enhanced value thereof by means of the improvement iD the
UDit upon which the particular property abuts, and for which assevsment is levied,
in a sum in excess ot the assessment levied against same by' this ordinance, and fur•
ther finds that the apportionment of the cost of the improvements is in accordance
with the proceedings heretofore taken and had with reference to such improvements
and is in all respects valid and regular.
III.
That there shall be and is hereby' levied and assessed against the parcels or pro-
perty herein below mentioned and against the real and true owners thereof, whether
such owners be correctly aamed herein or not, the sums of maney below mentioned aDd
itemized shown opposite the description of the respective parcels of property; the
descriptions of such property, and several amounts assessed against same, and the
owners thereof, beillg as follows a

IV.
That the assessments so levied are for the iaprOYeaents in the particular Unit
upon which tae property described abuts, and the aa•eaa-.nts for the improvements

in one Unit are in nowise related to or connected with the improvements in a:J11 other
Unit, aDd in making assessll&nta and in holding said hearing the amounts so assessed
for improvements in one Unit have been in nowise affected by aqv fact in ~ wise
connected with the improveme11ts, or the assewameDta therefor, or azv-other unit.

That the several sums aboveantioxaed uaesaed against said pareels of property,
and against the real and true owners thereof, and interest thereon at the rate or
six (6) per cent per annwa, together with reasonable attorney1 s fees and costs of
collection, if incurred, are here~ declared to be and made a lien upon the respec•
tive parcels of property against which the same are assessed, and a personal liabi•
li ty and charge against the real and true owners thereof, whether or not such owners
be correctly named herein, and such liens shall be and constitute the first entorce-
able claim against the property assessed, and shall be a first and paramount lien,
superior to all other liens and claims, except State, County aDd Municipal taxes,
and the sums so assessed shall be payable as follows, to-wit& ·
In five equal installments, the first payable on or before ten (10) days after
the compl?tion and acceptance b;y the said City of the i111provements in the unit upon
which the particular property abuts; the second installment due on or before one
year from said date of completion and acceptance, the third ins-tallment due on or
before two years from said date of completion and acceptance,(the fourth installment
due on or before three years from said date or completion and acceptanee,)the titth
installment due on or before four years from said date of completion and acceptance;
and such assessments shall bear interest from the date or such completion and ac-
ceptance at the rate of 6% per annua, payable annually with each instal.l.llent, eo
that upon completion and acceptance of the i~rovements in a particular unit aaseea•
mente against the property abutting upon such completed and accepted unit shall be
and become due and payable in such installments anci with interest froa the date ot
such completion and acceptance, provided that any owner shall have the right to pq
ott the entire assessment, or aey installment thereof', before maturity, by pa.yment
of principal and accrued interest, and provided further that if' default shall be
made in the payment Gf an;y installment promptly as the sue matures, then the entire
aaount of the assessment upon which such c.ief'ault is made shall, at the option ot the
City of Lubbock, or its assigns, be and become immediately due and payable, and s
be collectible with reasonable attorney's fees and costs of collection, if incurrea.
VI.
The City of Lubbock shall not in any manner be liable for the payment of ai\1
sums hereby assessed against ~ property and the owners thereof, but said City of
Lubbock shall look solely to said property, and the owners thereof, tor payment or
the sums assessed against the respective parcels or propert7; but said City shall
exercise all or its lawful powers to aid in the enforcement and collection of said
liens and assessments, and if default shall be made in the ~ment at aqy assess-
ments collection thereof shall be enforced either by sale or the propert7 b)r the Tax
Collector and Assessor of the City or Lubbock as near aa possible in the manner pro•
vided for the sale or property for the non-pqment or ad valorem taxes, or, at the
option of City of Lubbock, or its assigns, p~ent or said sums shall be enforced
by suit in aqy court having jurisdiction.

VII. 6.
For the purpose of evidencing the several sums assessed against the said parcels
of property, and the owners thereof, and the time and terms of pqment, and to aid
in the enforcement thereof, assignable certificates shall be issued b.1 the City of
Lubbock upon the completion and acceptance of the work in each Unit of improvement
as the work in such Unit is completed and accepted, which certificates shall be
executed by the ~or in the name of the City, attested b,y the City Secretar.y with
the corporate seal, and shall be pqable to City of Lubbock or its assigns, and s
declare the said amounts and the time and terms or payment and rate or interest and
date of completion and acceptance of the improvements for which the certificate is
issued, and shall contain the name of the owner as accuratel1 as possible, and the
description of the property b.1 lot and block number, or front feet thereof, or such
other description as IU:3' otherwise identif7 the same, and it the said propert7 shall
be owned by an estate, then to so state the description thereof as so owned shall
be sufficient, or it the name of the owner beunknown, then to so state shall be suf•
ficient, and no error or mistake in describing a:tlf propert;y, or in giviDg the name
of anT owners, shall in a~ wise iuvalidate or impair the assessment levied hereb.y
or the certificate issued in evidence thereof' •
The said certificates shall further provide substantially that it default shall
be made in the pqment of 8.JV' install.Jaent or principal or interest when due, then,
at the option of City of Lubbock, or its assigns, the whole ot the said assessment
evidenced thereb,y shall at once become due and pa7able, and shall be collectible
with reasonable attorney's fees aDd co9ts of collection, if incurred, And said cer•
fificates shall set forth and evidence the personal liability of the owners of such
property and the lien upon such property, and shall provide in effect it default
shall be made in the payment thereof' the same may be enforced either by the sale ot
the property b;y the Tax Collector and Assessor of the City of Lubbock, as above re•
cited, or b7 suit in aD3" court having jurisdictioza.
The said certificates shall further recite in effect that all proceedings with
reference to making said improvements have been regularly had in compliance with the
law in force and proceedings of the City or Lubbock, and that all prerequisites to
the fixing of the lien and claim of personal liabilit7 evidenced by such certifica•
tes have been regularl7 done and performed, which recitals shall be evidence of the
matters and facts so recited, and no further proof' thereof shall be required in 8.DT
court.
And the said certificates may have coupons attached thereto in evidence of each
or ~ of the several installments thereof, or they may have coupons for each of the
first four installments, leaving the main certiticate tor the fifth.
Said certif'icates ma;y further provide substantially that the aaounts pqable
thereunder ma;y .be paid to the Collector of Taxes of. the Cit;y, who shall issue his
receipt therefor, which receipt shall be evidence of such p~ment ·upon ~de~
tor the same, either by virtue of the said certificate or anr contract to pay the
same entered into by the property owners, and that the Collector of Taxes will de..,
posit all sums s~ received by' him forthwith with the Cit;y Treasurer, and upon the
p~nt of ~ installment with interest upon the surrender of the coupon ther4br,
receipted in full b;y said Contractor, or other holder of said certificate, the City
Treasurer shall PlY' the amount so collected and due thereoa to said Contractor, or
other holder, which coupons so receipted shall be the Treasurer's Warrant for pay-
ment,
And the said certificates shall further provide in effect that the City of Lubboc
shall exercise all of its lawful powers, when requested so to do b;y the holder of
said certificates, to aid in the enforcement and collection thereof, and said cert•
ificates ~ contain other and further recitals pertinent and appropriate thereto.
It shall not be necessary that said certificates shall be in the exact form as above
•et forth, but the substance and effect thereof shall suffice.

VIII.
The assessaenta levied by this. ordinance for the improYementa in each Unit are
altogether separate and distinct from assessments in each and every other unit. The
assessment• for improvements in one unit are in nowise affected by the improvements
