WHEREAS, it is deemed necessary by the City Commission of the c·ity of Lub• bock that uniform rates be fixed and charged users of the sanitary sewer sys- tem to be furnished by said City's municipal sewer system outside the city limits, by basing such rates substantially on the amount of sewerage dis- charged into the sewer system and calculated on the amount of water consumed for industrial and commercial uses and on a fixed charge per unit and fix- tures for residential premises, THEREF~~. BE IT CRDAINED BY THE CITY COMMISSI.QN OF THE CITY OF LUBBOOK; TEX.ASa Section 1. That after the effective date of this ordinance sewer ser· ' vice and extensions may be made outside the corporate limits of the City of Lubbock upon the following conditions provided the proposed user of the service or connection is a user and consumer of water furnished by the City of Lubbock water system, and further provided, Section 2. That all users of sewer extensions and service p~ all costs of the construction of the sewer extension applied for at the City Hall in Lubbockt Texas on cost estimates of the City Engineer, which payment when made shall constitute a pa.YJBent for the extension and the City of Lubbock shall in no event be obligated to refund all or any part of such payment. Section J. flhere prem~ses are used for residential purposes a minimum charge of $1.50 per month shall be made for four or less units {such as lav- atory, commode, bathtub and sinks) and 25¢ per montn additional for each u- nit or fixture over four in number, to be charged on and collected with the water bill. Section Ja. Where premises are used for commercial and industrial pur- poses, the following schedule of monthq charges shall be made, calculated, billed on and collected month~ according to the water billing and statement. · (1) A minimum of #2.00 per month for the first 10,000 gallons of water or less. (2) An additio~l 15¢ per thousand gallons of water -consumed between 10,000 and 20,000 gallons. (J) An add~tional 10¢ per thousand gallons of water consumed over 20,000 gallons. .. c Section )b. Where premises are both residential and commercial and/or industrial under one proprietor, the charges provided in Section .3a of this ordinance shall apply, PROVIDED the proprietor may elect to pay charges ap- plicable to units and fixtures used for residential purposes, set out in Sec- tion ), and charges for all other uses as provided in Section Ja. Section 4. No industrial or commercial user of any connection with the sewer system shall place or permit any sewer wastes to be discharged into the sewer system unless such wastes have been determined by the City Engineer to be aceeptable for inolusion in the City sewers without pre-treatment. Section 5. All public sewer installations and extensions made pursuant to the provisions of this ordinance shall be in dedicated public w~s with sewer material and supplies belonging to the City of Lubbock or to become the property of the City of Lubbock upon completion of a project by the City's contractor. Section 6. No plumbing fixtures or installations shall be connected with the sewer system or lines except upon permit issued by and approval of the City of Lubbock Plumbing Inspector, and no sewer service shall be continued unless the premises served thereby are at all reasonable times ·made accessible for inspection purposes and maintained in compliance with all ordinances of the City of Lubbock and state laws pertaining to health and sanitation. Section 7. That in no event shall the City of Lubbock be required to ex- tend any sewer line, which shall be determined within the discretion of the City Commission, and in no event shall any sewer connection or service be extended or rendered until a water customer of the City water system shall make written application therefor, agreeing to p~ ell bills promptly at the City Hall in Lubbock, and authorizing discontinuance of anf such serw vice upon failure to promptly pay therefor under regulations governing the city water and sewer departments, AND IT IS SO ORDERED.
