vaned in called session, pursuant to notice of meeting issued by the
Mayor 1 at the regular meeting place thereof in the City Hall Build-
ing, in the City of Lubbock, Texas, with the following members pre-
sent, viz •

Commissioner W. B. Price presented for the consideration·
of the Commission an ordinance, which was read in full by the Secre-
tary. •
Commissioner J. Ray Dickey made a motion that the rule
requiring ordinances to be read at more than one meeting or the City
Commission be suspended for the reasons stated in the emergency
clause. The motion was seconded by Commissioner W. B. Price and

SINKING FUND FOR THE REDEMPTION OF SAID BONDS AS THE SAME

WHEREAS, the City Commission of the City of Lubbock, af-
firmatively finds that it ie advisable and to the best interest of
said City that car tain improvements, additions, extensions and en-
lar.gemen ts be made to the public buildings, parks, airport, storm
sewer system, streets and highways within said CityJ street light-
ing systemJ water and sanitary sewer system, as well as that a
municipal auditorium-coliseum be erected and constructed within
said City and that a site be purchased therefor and certain fire
equipment be purchased for the use of said City, all in accordance
with the recommendations, p lans and estimates which have heretofore
been presented to this Commission by various Committees of interest-
ed citizens of .said City; and,
WHEREAS, it is deemed advisable and necessary that the
neeotiable interest bearing coupon bonds of said Citt should be is-

sued for the purpos e of financing th € cost of such imp rovements,
additions, extensions and public buildin ~s and that it ie necessary
and expedient that an election be held within and !or said City of
Lubbo ck for the purpos e of submitting to the legally qualified r e -
sident property tax-payin g vot e rs of said City, who own property
subject to taxation therein and who have duly rendered the same for
taxation, the· various propositions to determine whethe r or not such
bo nds shall be . authorized for said purpos e s and wh e th e r or n o t ad
valorem taxes shall be annually levied, asses3ed a n d co1leted
against all prop erty wi thj.n the City: of Lubbock for tho redemption

NOW, THEREFORE DE IT ORDAINED DY THE CITY comHSSIOJI! OF
THE CITY OF LUB BOCK, TEXAS.
That an election be held within and throughout the boun-
dari e s of the City of Lubbock, Texas, on th e Second Tuesday in De -
comber, 1 9 45 1 the s am e b ein g t h e 11th day of December, 1945, su c h
date b e ing not less than fifte e n days nor more than thirty days
from the date of this ordinance, at which time ther.e shall b( sub~
mi t ted to the resid e nt qualifie d pro p erty taxpayin g vot e rs of Lub-
bock, Te xas, vtho own property subject to taxation within said City
and who have duly r e ndered the same for taxation, the following
specific propositionst
P UOPOSI TION ~IUl!BER ONE
Shall the City Commission of the City of Lubbock be auth-
orized t o issue the negotiable interest b e aring coupon ·bonds of
sa~d City to the amount of $75 1 000.00, bearing inter &s ~.at a rate
of not e~ceeding thr e e and on~-half per centum (3t%~ per annum from
date and .maturing at sueh t ·irne or times as may be deemed most ex-
pedien t by the City Commii'J! j,o n, serially .. n.ot la t er than twenty-five
year~ from the~r date~ for the purpose of the con~truction, erec-
tion, enlargement, in·provernent and purchase of City Hall Buildings
anc1 furn.ishing and equipping the same ih the City of Lubbock; and
fhall there be a~nua~ly levied , assessed and collected, while said

bonds or any or them are outstanding, an ad valorem tax upon all
taxable property within said City sufficient in amount to pay the
annual interest on said bonds and to provide a sinking fund to pay
the principal ther ~of as the same matures.
PROPOSITION NUMBER TWO
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds or
said City to the amount of 8101,000.00, bearing interest at a rate
of not exceeding three and one-hal£ per centum (3i%) per annum from
date and maturing at such time or times as may be deemed most ~
pedient by the City Commission, serially not later than twenty-five
years from their date, for the purpose of the construction, erec-
tion, enlargement and improvement o.t' Fire Station Buildings, pur-
chasing sites therefor and furnishing and equipping the same in the
City of LubbockJ and shall ther F be annually levied, assessed and
collected, while said bonds or any of them are outstanding, an ad
valorem tax upon all taxable property within said City sufficient in
amount to pay the annual interest on said b onds and to provide a
sinking fund to pay the principal thereof as the same matures.
PROPOSITION NUMBER THREE
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds of
said City to tho amount of $80 1 000.00 1 bearing interest at a rate
of not exceeding three and one-half per centum (3i%) per annum from
date and maturing at such time or times as may be deemed most ex-
pedient by the City Commission, serially not later than twenty-five
years from their date, for the purpose of the construction, er e c-
tion, enlargement and improvement of Police Station . Buildings and
furnishing and equipping the sa.me and purchasing sites therefor in
the City of Lubbock; and shall there be annually levied, assessed
and collected, while said bonds or any of them are outstanding, an
·ad Yalorem tax upon all taxable property within said City sufficient
in amount to pay the annual interest on said bonde and to provide a
sinkin g fund to pay the principal thereof as the same matures.

PROPOSITION NUMBER FOUR
Shall the City Commission o£ the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds of
said City t o the amou n t of $60 1 000.00 , bearing interest at a rate
of not exceeding three and on e -half per centum (3 t %) per annum from
date and maturin~ at such time or times as may b e deemed most ex~
pedient by the City Commission, serially not later than twenty-five
years from their date, for the purpose of the construction and
erection of an Equipment Storage and Garage Building, purc hasing a
site ther ~for and equipping the same in the City of Lubbock; and
shall there be annually levied, assessed and collected, while said
bonds or any of them are outstanding, an ad valorem tax upon all
taxable property within said City sufficient in amount to.pay the
annual interest on said bonds a n d to provid e a sinking fun d to pay
the principal thereof as the s ame matures.
PROPOSITION NUMBER FIVE
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearin g coupon bonds of
said City to the amount of $6s,ooo.oo, bearing interest at the rate
of not exceeding three and one-half per centum (5i%) per annum from
date and maturing at such time or times as may be deemed most ex-
pedient by the City Commission of the City of Lubbock, Serially not
later than twenty-five years from their date, for the purpose of

ery for the Fire Dep a rtment of sa i d City; and shall there be asses s -
ed 1 levied and collected annually, while said bond s or any of them
are outstandin g , an ad valorem tax upon all taxable property within
said City sufficient in amount to pay the annual interest on said
bonds and to provide a sinking fund for the redemption thereof at
maturity.
PROPOSITION NUMBER S!X
Shall the City Com~iss i on of the City o£ Lubbock be
authori~ed to issue the negotiable interest bearin g coupon bonds of
said City in an amount of $155,000.00, bearing interest at a rate of
not exceeding three and one-hal! per centum (3i%) per annum !rom
date, and maturin g at such time or times as may b e deemed most ex-

pedient by the City Cornmissior:, serially not later than twenty-five
years from their date, for the purpose of purchasin G sites for
parks and of erecting and constructing improvements to the parks of
the City of Lubbock, includin g raising,., grading, filling, terracing,
landscape gardening, erecting buiidings., establishing walks and
pavinP, driveways around, in and through said parks, playgrounds and
other public grounds, as well as installing, con~tructing, repair-
ing and improvin ~ swimming pools, wading paola and other facilities
for the recreation of the children and citizens of said City; and
ehall there be annually assessed, levied and collected, while said
bonds or any of them are outstanding, an ad valorem tax upon all
taxable property within said City sufficient in amount to pay the
annual interest on said bo 'nd6 and to provide a sinking fund for th e
redemption thereof at maturity.
PROPO.SI TION NUMBER SEVEN
Shall the City Commission of the City of Lubbock be au-
thorized to issue the negotiable interest bearing coupon bonds of
said City in an amount of #500,000.00, bearing interest at a rate
of not exceeding th~ee and one-half per centum (Bt%) per annum from
date, and maturing at such ti ~e or times as may be deemed most ex-
pedient by the ~~ty Commission, serially not later than twenty-five
years from their date, for the purpose of constructing, repairing,
erecting and improving buildings, hangars and other permanent im-
provements to the Municipal Airport of the City of Lubbock,includ-
ing the construction of roads, drives, parking ar e as and the pur-
chase and installation of control equipme~t and machinery and other
improvements incidental to the operation of such Municipal AirportJ
and shall there be annually assessed, levied and collected while
said bonds or any of them ~re outstanding, an ad valorem tax u p on
all taxable property within the City of Lubbock sufficient in
amount to pay th e annual interest upon said bonds as it accrues and
to provide a sinking fund for the redemption thereof at maturity.
PROPOSITION NUMBER EIGHT
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bon d s
of said City in an amount of $1 1 750 1 000.001 bearing interest at a

rate or not exceeding three and one-half per centum (3!%) per annum
from date and maturing at such ti me or times as• may be deemed most
expedient by the City Commis8ion, serially not later than twenty-
five years from their date, for the·purpose of the construction~
erection and equipment of a public building and .auditorium to be
known as the Lubbock Auditorium-Coliseum, and purchasing a site
therefor; and shall there be annually assessed, levied and collect-
ed upon all taxable property within the City of Lubbock a tax suf-
ficient in amount to pay the annual interest on such bonds'and to
provide a ~inking fund for the redemption thereof at mat~rity.
PROPOSITION NUMBER NINE
Shall the City Commission of the City of Lubbock be
authorized to i,~sue the negotiable interest bearing bonds of the ·•·-
City of Lubbock in the amount of $60 1 000.00, bearing interest at a
rate of not exceeding three and one-half per centum (3i%) per annum
from dat& and maturing at such time or times as may be deemed most
expedient by the City Commission, serially not later than twenty-
five years from their date, for the purpose of conBtructing, enlarg-
ing, extending and installing storm sewers, drains, curbs and gut-
ters and other improvements incidental thereto, and purc r asing
lands and ri~hts of way requisite for such storm sewer construction
and extension within and without the city limits of the City of
Lubbock; and shall there be annually assessed, levied and collect-
ed upon all taxable property within the City of Lubbock, while
said bonds or any of them are outstanding, a tax sufficient in
amount to pay the annual interest on such bonds and to provide a
sinking fund for the redemption thereof at maturity.

Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds
of the City of Lubbock in the amount of $500,ooo.oo, bearing inter-
est at a rate of note xceeding three and one-half per centum (5~%)
per annum from date and maturing at such time or times as may be
deemed most expedient by the City Commission, serially not later
than twenty-five years from their date, for the purpose or improv-
ing, e~tending and altering public streets, avenues, alleys, high-

ways and boulevards by pa v ing, widening, raising, grading, filling,
repaving or resurfacing the same or otherwise improving such streets
and highways, and fort he pur·pose of acquiring the necessary rights
of way incidental thereto; and shall there be annually assessed,
levied and collected upon all taxable property within the City of
Lubbock, while said bonds or any of them are outstanding, a tax
sufficient in amount to pay the annual interest on such bonds and
to provide· a sinking fund f·or the redemption thereof at maturity.
PROPOSITION NUMBER ELEVEN
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds
of the City of Lubbock in the amount of $245 1 000,.00, bearing in-
terest at a rate of not exceeding three and one-half per centum
(3~%) per annum from date and maturing at such time or times as
may be deemed most expedient by the City Commission, serially not
later than t wen ty-fi ve years from their date, for the purpose or
constructing, installing, extending and improving the strect··light-
ing system of said city, including the inst ~llation of street· lights,
stop and traffic lights and other improvements incidental thereto;
and shall there be annually assessed, levied and collected upon all
taxable p roperty within the City of Lubbock, ~hile said bonds or
any of them are outstanding~ a tax suffi cie nt in amount to pay the
annual interest on such bonds and to provido a sinking fund for the
redemption thereof at maturity.
~ROPOSITION NUMBER TWELVE
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable inter es t bearing coupon bonds
of the City of Lubbock in an amount of $445,000.00, bearing interest
at a rate of not exceeding three and one-half per centum {3!%) per
annum from date and maturing at such time or times as may be deemed
most expedient by the City Commission, serially not later than twen-
ty-five years from their date, for t he purpose of constructing, ex-
tending, enlarging, improving and adding to the sewage disposo.l
plant, filtering beds and emptying grounds for the sewage system,
and acquiring lands and rights of way within and without the limits
of the City of Lubbock for such sewage disposal purposes, and ex-

tendinG' and installing additional sanitary sewer lines~ and shall
there be annually assessed, levied and collected upon all taxable
property within the City of Lubbock, while said bonds or any of
them are outstanding, a tax sufficient in amount to pay the annual
interest on such bonds and to provide a sinking fund for there-
demption thereof at maturity.
PROPOSITION NUMBER THIRTEEN
Shall the City Commission of the City of tub bock be
authorized to issue the negotiable interest bearing bonds of the
City of Lubbock in the amount of $l,BOo,ooo.oo, bearing interest at
a rate of not exceeding three and one-half per centum (3t%) per an-
num from date and maturing at such time or times as may be deemed
most expedient by the City Commission, serially not later than
twenty-five years from their date, for the purpose of constructing,
installing, enlarging, improving, extending and adding to the wat e r
supply system of the City of Lubbock, including the extension of
water lines, mains and facilities, the construction of additional
water supply systems, wells, lines, filtering and treating facili-
ties and other improvements incidental thereto, as well as ac-
quiring lands, water ri~hts in lands, and such other interests
therein, and ri ~h t s of way, within and w itho ~t the limits of the
City of Lubbock for such purpose; and shall there be annually as-
sessed, levied and collected upon all taxable property within the
City of Lubbock, while said bonds or any of them are outstanding,
a tax surf ic ien t in amount to pay the annual interest on such bonds
and to provid e a sinking fund for the redemption thereof at maturifat .,
PROPOSITION NUMBER FOUR TEEN
Shall the City Commission of the City of Lubbock be
authorized to issue the negotiable interest bearing coupon bonds of
the City of Lubbock in the amount of $650,000.00,-bearing inter e st
at a rate of not exceeding thr E>e and one-half per centum (3~%) per
annum from date and maturing at such ti~e or times as may be deemed
most expedient by the City Commission, serially not later than
twenty-five years from their date, for the purpose of constructing,
erecting, installing and improving a complete 'Rater treating and
softening plant with all machinery a~d equipment requisite for the
operat:\on and maintenance thereof, ~nd. acquiring lands and rights

of way within and without the limits of the City of Lubbock requi-
site for the installation and maintenance of such system; and shall
there be annually assessed, levied and collected upon all taxable
property within the City of Lubbock, while said bonds or any of

them are outstanding, a tax sufficient in amount to pay the annual
interest on such bonds and to provide a sinking fund for the re-
demption thereof at maturity.
II.
Said Election shall be held under the provisions of and
in strict conformity with the Constitution and Laws of the State of
Texas, ineluding Chapter I, Title 22, Revised Civil Statutes of the
State of Texas, and, the provisions of the Charter of the City of
Lubbock, and all acts amendatory, complementary and supplemental
thereto.
All persons who are legally qualified ~esident property
taxpayin~ voters of the City of Lubbock, Texas, who own property in
said City subject to taxation and who have duly rendered the same
for taxation, shall be entitled to vote at said election.
III.
The ballots for said election shall have written or
printed thereupon the following, to-wit,

As to each of the foregoing propositions, each voter shall
mark out with black ink or pencil one of the expressions, thus
leaving the other as indicatin g his vote on the propos:i.tion.
IV.
That said Election shall be held at the Central Fire Sta-
tion Building, at the corner of lOth Street and Avenue J, in the
City of Lubbock, Texas, and t h e presiding Jud g e and Clerks of said
election shall be as follows, viz 1

That notice of said election shall be given by posting a
substantial copy of this Ordinance at the City Hall Building and at
two other public places in the City of Lubbock and such notice shall
also be published on the same day in each of two successive weeks in
a newspaper or general circulation published within the City of Lub-
bock, the date of the first publication to be not less t~an fourteen
(14) days prior to the date set for said election.
The Mayor and City Secretary shall cause such notices to
be prepared and posted and published and shall make due returns
thereof to this City Commission.
VI.
Immediately after s a id election has been held, the offi-
cers holding the same shall make returns of the resu'l t thereof to
the City Secretary of the City. of Lubbock, for canvassing by the
City Commission and shall return the ballot boxes to the City Secre-
tary for safekeeping.
The manner of holding such election and canvassing and
making returns thereof shall be go vern ed by the general election
laws of the State of Texas, when not in eonflic t with the pro vis ions
of the hereina bove mentioned statutes, and the City Co11U!lission will
furnish the n~oessary ballots and other election supplies requisite
for said election.
VII.
The fact that it is affirmatively found by the City Co~
mission of ~he City of Lubbock, that there is urgent need to proceed
with the matter of the construction and improvement of the water,
sewer,public streets,park improvements and public buildings within
said city, in order to make the same more convenient for the public
at large and preserve and protect the health and welfare of the cit-
izens of Lubbock, creates an emergency and public neeessity,demand-
ing that the rule requiring the reading of this ordinance on more
than one day before final passage, be suspended, and suoh rule is
hereby euspended and it is ordained that this ordinance shall take
.effect and be in torce immediatet upon its passage an cl adoption.
