AN ORDINANCE REVISING SECTION XVD, HEADING 3, OF ZONING OhDINANJE NO. 661 ES-
TABLISHING 11 SIDE YARD REGULATIONS 11 •
WHEREAS, the Planning and Zoning Commission has recommended to the City Com-
mission that Section XVI, Paragraph 3, be completely revised to establish and pro-
vide a method of determining side yard requirements where proposed buildings are
for business and industrial uses and provide for no side yards except in certain
events, and,
l~, upon-consideration of such recommendataon and in compliance with Sec-
tion 25 of Grdinance No. 661, the City Commission caused notice of hearing on said
recommendation to be published in the Lubbock Morning Avalanche September 30, Oc-
tober 7 and October 14, 1945, and,
r~, said notice was so published and the public hearing according thereto
was held in the City Commission Room on the second floor of the Ci ty ~all in the
City of Lubbock, at 2t30 o'clock P.M ~, Dctober 16, 1945, at which time interested
persons appeared at said hearing and after which said hearing the City Commission
determined that it would be to the best public interest that Ordinance No. 661 be
amended in substantial compliance with the stated recommendation, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOOK: That Section
XVI, .Paragraph 3, entitled "Side Yard Regulations 11 be completely revised so as
to hereafter read as follows:
Section 1. In the F, G, H, J, K, Land M Districts, if the property is not
used for dwelling purposes, no side yards shall be required, UNLESS openings are
included in the wall of the proposed building and the building wall is adjacent
and abuts a lot upon the side, which lot is zoned for dwelling purposes, or drain-
age is permitted on the side of the building abutting a residential zone, in which
events the building wall must be set back a distance of five (5) feet to provide
side yard clearance adjacent to such residentially zoned property.
Section 2. When property in the F, G, H, J, K, Land M Districts is used for
dwelling purposes, the side yard requirement shall be not less than four (4) feet,
