ORDINANCE NO • 686 WHEREAS, the City or Lubbock is the owner in fee or a certain tract of land located and situated in the North•ast corner ot the Northeast One- fourth ot the Southwest One-fourth ot Section 131 BlQck B, in Lubbock County, Texas, said tract of land described by metes and bounds as follows: -(Taking Phillips Addition into the City Limi~s) - Motion by Commissioner Jones, secon ded by Co~ssioner McMillan, the ~allowing Resolution carried unanimously. BE IT REMEMBERED that at a meeting of the City Commission of the City or Lubbock, held o~April l0th1. 1942, a quorum being present, among other .business t ransacted, t h e l6l.low1ng r ,esolution was .duly passed: \TllEREAS on August 19th, 1941 the·. City ot -Lubbock, as lessor leased to N.~. Walter and w. Earl Smith, as lessees, a body or land situated· in Lubbock County, Texas, consisting of ee6 .18 acres of land; and at the same time said lease was exeeute4 an· escrow agreement was made and entered thtlo by the lessor and lessees, under the terms ot which the lessees placed in ~scrow in the Citizens National Bank of Lubbock, Texas. the suM or $435o.oo. to be held by tbe Citizens Nat!~al Bank until the lessees had ooopleted a well to a depth or 5500 teet on some part or the land descrliled in the oil and gas lease; and, WHEREAS, thereafter, the lessees, N.c. Walter and w. Earl Smith, made and entered into a contract with Sam G. Dunn and Claude Keeton, who agreed, bound and obligated themselves to drill an oliand gas *-11 on a tract or land adjoining the lands described in the oil an4 gas lease executed by the City of Lubbock to said Walter and Smith; and City ot Lubbock having agreed to the change of the location or said well as per the terms or a contract made between the City or Lubb9tk on February 12th, 1942, and Sam G. Uunn and Claude Keeton. and, WHEREAS. it is provided in said contract that if the said Sam G. Dunn and Claude Keeton, drilled said oil and gas well to a depth of 5500 feet on the location mentioned in said contreot of February 12th 1g42, and completed said well to a depth of 5500 feet that then and in that event the City of Lubbock agreed, subJect to the approval of N.C. Wa~ter and W. Earl Smith, that said $4350 .00 held in escrow by the Citizens atlonal Bank was to be paid to the said Sam G. Dunn and Claude Keeton; and, WHEREAS, the said Sam G. Dunn and Claude Keeton have complted said well called for in the contract ot February 2nd, 194-2, to a depth o~500 teet; NOW, THEREFORE BE IT RESOLVED that the Citizens National Bank of Lubbock, Texas, the escrow agent, designated in the eacrow agreement, mde and entered into en the 19th day of August,· 19U, betwaen the City of Lubbock as lessor and N.C . Walter and w. Earl Smith , as lessees, be and it 1s hereby authorized in so far as the City of Lubbock is concerned and subJect to the consent of the said Walter and Smith to pay said sum of t4350.00 to the said Sam G. Dunn and Claude Keeton.
