HomeMy WebLinkAboutOrdinance - 673-1941 - Providing For Safguarding Of Life And Property By Regulating Neon Tubing - 07/25/1941.. .. • 0"::/--25-194--'l No. b 1 3- oe -J 4--1 s l-f I AN ORDINANCE PROVIDING FOR THE SAFEGUARDING OF LIFE AND PROPERTY BY REGULATING AND PROVIDING FOR THE IN- STALLATION AND MAINTENANCE OF NEON TUBING AND LIGHTING, FLOURESCENT TUBING AND LIGHTING, PROVIDING THE MANNER IN WHICH THE WORK SHALL BE DONE, THE KIND OF MATERIAL TO BE USED IN SUCH WORK, THE INSPECTION OF SUCH WORK, THE SCALE OF FEES FOR SUCH INSPECTION, DEFINING THE TERM "KASTER SIGN ELECTRICIAN," PROVIDING FOR THE GIVING OF A MASTER SIGN ELECTRICIAN'S LICENSE, PROVIDING FOR THE GIVING OF A BOND AND THE COLLECTION OF PENALTIES UNDER SAID BOND FOR VIOLATION OF THIS ORDINANCE, TO PREVENT INCOMPET~NT PERSONS, FIRMS OR CORPORATIONS FROM INSTALLING, MAINTAINING, OR SELLING NEO~t ~BE SIGNS, DEVICES, OR ORNAMENTATIONS. ' j BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: NAME OF ORDINANCE. This Ordinance shall be known as "Electric Sign and Floureseent Ordinance." SECTION 2: DEFINITION OF MASTER SIGN ELECTRIGrAI. That by the term ''Master Sign Electrician" is meant any person engaged in or carrying on the business of neon installations, who is by training, experience and education, competent to lay out, design and install a system of neon tubing and the wirfng that is a part thereof. SECTION 3: REQUIRING MASTER SIGN ELECTRICIANS TO TAKE EXAMINATION. From and after the passage and taking effect of this Ordinance, every person who engages in the work of in- stalling neon signs in the corporate limits of the City of Lubbock, Texas, shall, before engaging in such work, make application to the City Electrical Examining Board for license and such applicants shall be required to take an examination to be given by the City Electrical Examining Board and if said applicant, upon his examination, makes a grade of seventy (10%) per cent, the City Electrical Examining Board shall issue to said applicant a certificate of qualification, certifying that the applicant has been found competent as a master sign ·• ., electrician~ which shall entitle him to a license to carry on such work in the City of Lubbock. SECTION 4: FEES FOR EXAMINATION. EaCh applicant for examination as Maste~ Sign Electrician shall1 at the time of filing his application1 pay to the Secretary of the City Electrical Examining Board the sum of #3.00, which said fee shall be paid over to the City Tax Collector of the City of Lubbock, the same shall be placed in the general fund. SECTION 5: LICENSE. EaCh successful applicant shall be issued a license under the provision of this ordinance upon the payment of a license fee of il5.00 in advance. Said fees to be paid to the Tax Collector of the City of Lubbock; provided further that each applicant for Maste~ Sign Electrician shall execute . an approved surety bond to the City of Lubbock in the amount of tlooo.oo conditioned upon the strict compliance with the requirements of all city electric and sign .hanging ordinances and amendments thereto. All licenses shall expire on the first day of December of each year unless sooner revoked. Lio.enses may be renewed each year thereafter for fee of $3.00 if application for renewal of license is made before the expiration of the old license. If bolder of license fails to make application for renewal of same before expiration of license# he shall be required to pay tull fee and if he fails to renew his license for a period of one year 1 take examination as provided for persons originally desiring to do neon and sign hanging. No. Electricians' person shall receive a Kaster Sig~/.License who has not attained 2 the age of 21 years. All persona now engaged, or Who may here- after engage in the work of a Master Sign Eleci;;rieian, are hereby required to appear before the Electrical Examining Board tor an examination on or before the expiration of sixty (60) days' time from the date this Ordinance takes effect. SECTION 6: LICENSE REQUIRED. It shall be unlawf'ul for any person to engage as Master Sign Electrician in tbe City of Lubbock without first having secured a license therefor as herein provided. Every person, firm, association, copartnership or corporation engaged in the work of installing, ere c ting or altering electric signa or making neon installations shall at all times have in their employ a licensed Kaster Sign Electrician, to do said work. SECTION 7: LICENSE NOT TRANSFERABLE. It shall be unlawtnl for any person, firm, or corporation holding a license as Master Sign Electrician to transfer same or allow the use of same directly or indirectly by any other person for the purpose or ~btaining a permit to do sign and neon work as herein specified. SECTION 8: PERMITS. No person, firm or corporation shall begin work of installing, erecting or altering signs or neon installations in or on any building or premises in the City of Lubbock without first securing a permit therefor from the Electrical Inspector. No permit will be required for repair work on signs and neon installation where no new work is installed. Application blanks ·for permits tor sign and neon installations shall be fUrnished by the electrical inspector who shall approve and counter sign them. No license shall be required to hang signs that are not illuminated in any manner such as sign boards or bill boards mounted on face of buildings, posters, etc. But sign company hanging same must have an approved surety bond. executed to the City of Lubbock in the amount of $1000.00 conditioned 3 upon the strict compliance with the requirements of tbe City sign hanging ordinances and amendments thereto, and must have a permit from the Building Department of the City of Lubbock before beginning the erection or installation of same. SECTION 9: TEMPORARY PERMIT. Temporary permit to connect a sign for demon- stration purposes must be secured from tbe Electrical In~pector and tPe connection must be removed within the specified time. No permanent connection oan be ~ade until the circuit wiring and the sign outlet has been approved by the Electrical Inspector. SECTION 1~>: WIRING METHODS. Wiring methods shall conform to Article 600, Chapter 6, of the -National Electrical Code and this Ordinance. SECTION 11: PRIMARY CIRCUITS. Primary circuits of not more than 1320 watts (transformer input VA) shall be connected to any one cir_cuit, either inside or sign bodies or on any neon or other sign circuit and not over 3 transformers on any one circuit. SECTION 12: FLOOD LIGHTS. Flood lights must be on seperate circuits from sign circuits. TWo goose necks of not over 150 watts each may be connected in circuit with neon sign, provided tba t total wattage does not exceed 1320 wat·ts. SECTION 13: CLASSIFICATION OF SIGNS FOR PERMIT FEES. outside Signs • $1.00 per permit for each sign. Inside Signs, Directional Signs, Window Display, etc. -tl.OO for first two; 50¢ for each additional sign or display in one installation. Inside Decorative Displays or Outline -tl.OO for an installation made at one time. 4 Outside Buildihg Outline or Decorative Tubing - $1.00 for an installation made at one time. SECTION 14: PORTABLE SIGNS. A portable sign is one in which all wiring, transformers and live parts are tully enclosed and o~y the attachment cord extends to the outside and does not exceed 200 watts. No permit shall be required on portable signs. SECTION 15: UNDERWRITERS t LABEL. All signs must bear the Und~rwriters' Label or must pass local iaspection before being closed up or hung in place. SECTION 16: PLOURESCENT FIXTURES AND LIGHTING. All flourescent fixtures must bear the label of approval of the Underwriters• Laboratories, Inc. A Portable fixture is one Which can be moved from place to place, and is not attached to ceiling or walls by chains, rods, hooks~ flanges, or any other means of attach• ment, and that does not require any mechanical ability to in• stall or knowledge of electricity, other than the insertion of tne cap into a proper receptacle. CeiliBS, !!!! or ~ fixtures, or Strip LishtiBS~ must be safely and permanently installed and shall be wired without the use of attachment cords. Wires from flourescent fixtures to the outlet box shall be laced in chain of sufficient strength, or shall be carried to outlet box throush the supporting pipes,_ or through \ a separate piece of rigid conduit. The wires shall not bang free in air from outlet box to the fixture. All joints shall be properly ~ade and in- sulated, both in the fixture and in the outlet box. There shall be no exposed joints outside of fixture or outlet box. Only hi-power factor fixtures~ properly 5 / ballasted as approved by the Underwriters• Laboratory will be accepted. Local manufacturers must secure Underwriters• Label Service before selling or offering for sale any flourescent fixture to be used or installed in the City of Lubbock, Texas. No one, otber .than the holder of a Master Electrician's License and bond, may install any .flourescent fixture either permanently or for tem~orary use. Wbere fixtures are installed temporarily or for approval a temporary permit must be secured from the Electrical Inspector, and the permit will expire at a stated time as shown on the permit. Flourescent fixtures shall not be installed in any hazardous locations ~les~ specifically approved by the "Underwriters • Laboratories, Inc." for such loca tiona. · Primary·wiring for flourescent lighting shall be the same as for incandescent lighting. Surface extensions may be made to floureseent fixture outlets, and for a connected load of not more than eo% 9r 15 amperes, equaling 1320 watts to a circuit. Connected lo~'for tlourese~nt case lighting shall not exceed 600 watts to any one circuit. Wiring methods shall be the same as to type in regard to conduit as for incandescent lighting tor tbe given type of occupancy, hazard, etc. All regulations as to licenses, bonds, tees and permits as contained in Ordinance #285 and its amendments shall apply to the manufacture, sale, offering for sale and installation of flourescent fixtures to be used or installed in the City of Lubbock, Texas. The auxiliaries of floureseent fixtures dissipate heat, and are subject to burn-outs, ignition or destruction as 6 -.. -... in any similar transformer, reactor, resistor, or capacitor; and care must be taken so that in the event of a fault in the tiXture, surrounding material will not be ignited. No flourescent fixture shall be supported from the shade holder or fitter ring of any chain fixtures, electric ran or similar fixture by use of tbe screws provided for holding the glass shade or bowl. As in all eases, the fixture must be supported by a per-manent mechanical method, both as to fitter, chain and ceiling attachment, and shall be permanently wired to the outlet box. Attachment cords plugged in to a fixture will not be accepted. Flourescent fixtures are not to be supported by meaDS of any adaptor designed to be screwed into any light socket or receptacle. In all cases, the wall or ceiling attachment, the supporting chain and the attachment to the fixture must be of sufficient strength and permanence to properly support the weight of the fixture under all circumstances. Strong steel chains, rods or conduit shall be used. Stems or pipe supports Which house wiring shall be approved conduit. The use of common iron pipe is hereby proh11>1ted. Recessed flourescent fixtures shall be wired with heat resistant (ABV) wire and all current NB code rules shall be observed. Transformers (auxiliaries) shall not be placed in attics, unless in approved metal cabinets accessible from the under side of ceiling. SECTION 17: PENALTY FOR VIOLATION. Any person, fir.m or corporation, violating this Ordinance, or causing same to be Violated, shall be not punished by a fine in any s~to exceed $100.00 (one hundred dollars) •. '1 SECTION 18. VALIDITY OF QRDINANCE. If any section, paragraph, subdivision, clause, phrase or provision or this Ordinance shall be adjudged invalid or held unconstitutional the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional, and IT IS SO ORDERED.
