BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS: SECTION 1: That The Pecos and Northern Texas Railway Company, a corporation, and its lessee, The Panhandle and Santa Fe Railway Company, a corporation, and their suooessors and assigns, be and they are hereby given the right, power and privilege ot locating, building, erecting, constructing and maintaining an industry track with the necessary turnouts, switch stands and other necessary appliances in connection therewith upon and over the alley runniDg north and south through blocks 173, 189, 205, 221 and 237 in the Original Town ot Lubbock, Lubbock County, Texas, and proJecting trom the alley in Block Two Thirty-seven (237) to the north line Gt Section 7, Block B, Lubbock County, Texas, and upon and over Fifteenth Street, Sixteenth Street, seventeenth Street, Eighteenth Street and Nineteenth Street at the points where such streets would be crossed by the projection ot said alley above described, and the right to operate its equipment on said track when built. SECTION 2: That The Pecos and Northern Texas Railway Company and The Panhandle and Santa Fe :Railway Compuy, their successors and assigns, are hereby required and by the acceptance ot this ordinance agree that they will oolilstruot, maintain and operate said industrial track and the switches, turnouts and other necessary appliances incident thereto, so as to oontorm to the grade ot said alley, and in such manner as to interfere as little as possible with the use and enjoyment, ingress and egress ot the abutting premises by the owners and other lawtul occupants thereot, will pay cost ot paving space occupied by the said traok, it said alley should be paved, and will maintain and operate said track and other facilities, switches and turnouts incident thereto in accordance with the laws ot the State ot Texas and the lawtul ordinances and resolutions ot the City o:t Lubbock in such oases made and provided.
