RS AND THE DUTIES OF SAID l.ONING COlr:MIS::iiON . ~VHEREAS, the City of Lubbock desires to avail itself of the rights, privileges and powers g iven and ~ranted to incorporated cities by Articles lOililA to lOllJ, inclusive, of Chapter One Title 28 of the Revised Civil Statutes of the State of Texas and to zone the City of Luboock as prov1ded by said law. THEREFORE, BE IT ORDAINED BY THE CII}'Y COMlviiS>;)ION OF THE CITY OF LUBBOCK: .t.ONING COl\HV~ISbiON Section 1 . There is hereby created a Zoning Com- mission for the City of Lubbock, which ~oning Commission shall be composed of s-members, each of whom shall be a resident, tax paying citizen of the C~ty of Lubbock and who shall have resid'ed in the corporate limits of the City of Lubbock for· a period of time of not less than 0 years. No person shall be appointed a member of said Zoning Commission who has not attained the age of twenty-one years . APPOINTMENT OF I.H1\fBERS Section 2 . The members of the L.oning Commission shall be appointea by the City Cownission and shall hold office at the will and pleasure of the City Commission and any or all of said members may be removed from office at any time by the City Commission. ORG1NIZATION OF ZONING COMMISSION Section 2A. It sha ll be the duty of the persons ~_/ appointed as members of the toning Commission to meet within ten days after their appointment and organize; one member of the Commission shall be elected chairman and one member elected secretary and i~ shall be the duty of the chairman of said Zoning Commission to preside at all meetings held by it and to see that proper notice of its meet~ngs are duly published in a newspaper of g eneral circula tion, published in the City of Lubbock . It shall be the duty of'· the secretary of the ~oning Commission to keep a record of its proceedings and to write up the minutes of each meeting held by said Zoning Commission. -, . . VACANCIES, HO.s FILLED Section 3 . Upon the death, resignation or removal of any member of the ~oning Commission, the Cit y Commission, shall, within ten days after the date of such death, resignation or removal, appoint a successor or successors to fill the vacancy created on said ~oning Commission by such death, resignation or removal . DUTIES OF ZONING COMMISSION Section 4 . It shall be the duty of the Zoning Commission to make a comprehensive survey of the City of Lubbock and to lay out and recommend the number and b oundaries of the original zones and to make or cause to be .made maps showing the various zones and their boundaries and to make or cause to be made, recommendations, rules and regulations to be enforced therein for the promo~ion of health, safety, morals and the general welfare of the City of Lubbock anu to prescribe and recorr~end rules and re Julations to restrict the height, number of stories and size of the buildings and other structures, the per centage of lots that may be occupied, the size of yards, courts and other open spaces, the density of the population, the locations and use of buildings, structures, and land for trade , industry, residenc es and/or o t her purposes, and to recommend and make rules and regulations to divide the City of Lubbock into various zoning districts of such number, shape and area as ma ~ be deemed best suited to carry out the purposes of the zonin~ law of the State of Texas, as set forth in Articles lOllA to lOllJ, inclusive, Title One Chapter 28, ~evised Civil Sta tutes of the State of Texas and to prescribe and recomm end rul e s and re gulations in such dis- tricts to regula t e and r e strict the erection, construction, reconstruction, alteration , repair or use of buildings,. struc- tures or land a nd to provide t hat such r egulations and rules shall be uniform for each class or kind of buildings throughout each district, but it may prescribe and recommend different regulations in one district from those in other d i stricts; and i t is nereby made the further duty of the Zoning Comn1ission . . .... -.... ,. that its recommendations, rules ana. regulations shall be made in accordance with a comprehensive plan and designed to re- strict cong cst~on in the streets, to secure safety from fire, panic and other dangers, to promote h f alth and general welfare, to provide adequate light and air, to prevent the overcroY..'ding of land, to avoid undue concentration of population, to facili- tate the adequate provisions of transportation, water, sewage, schools, parks and other public requirements, and such rules, regulations and recommend tions to be made by the Zoning Cowmission shall be made with reasonable consideration, among ' other things, to the character of the district and its peculiar suitability for particular uses ~nu with a view to conserving the value of build~ngs and encouraging the most appropriate use of land throughout the City of Lubbock; said Zoning Com- mission shall not make rules, regulations or recmr.mendat.tons for the removal or destruction of property existing at the time this ordinance is enacted which is actually and necessarily used in a public service business . Said ~oning Commission shall prepare and make a preliminary report to the City Commission of its recommendations of rules and regulations to be enacted into law to carry out and enforce the rights, powers and privileges granted incorporated cities by law and in making and preparing its report and recommendations, it is hereby made the duty of said ~oning Commission to conduct public hearings at such places within the corporate limits of he City of Lubbock as it may deem best and any citizen living within the corporate limits of the City of Lubbock is hereby given the r~ght to appear before said Zoning Commission and to either protest or advocate ·tbe zoning of the City of Lubbock and when said Zoning Commission has completed its work it shall make its final report to the City Commission, AND IT IS SO ORDERED.
