AN ORDINANCE REGULATING FUMIGATION AND EXTERMINATION ,
PROVIDING FOR n BOND, AND PROVIDING A PENALTY FOR VIOLATION

WHEREAS, there are a number of people in the City of Lubbock
now engaged in the business of fumigating houses and exterminating
insects and rodents, using poisonous and obnoxious gases and other
poisonous drugs and chemicals in such fumigation and extermination;
and
~mEREAS, many of said persons are unskilled and incompetent
to do and carry on such work; and

WHEREAS, the manner in which said fumigation and extermination
campaigns are now being carried on, endangers the lives, health and
property of the general public ·in the City of Lubbock.
THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF LUBBOCK:
Sec. 1.

That the business of fumigation of houses and the extermination
of insects and rodents within the corporate limits of the City of Lubbock,
Texas, shall be done under the approval and supervision of the City Health
Officer, and it shall be unlawful for any person, firm, Association or
corporation to engage in such business without first notifying the City
Health Officer, advising him of the location of the house, building and
r premises to be fumigated, and obtaining from the City Health of~icer his
consent and approval of the method and means to be used in fumigating
and exterminating insects and rodents.
Sec. 2.
That it shall be unlawful for any person, firm, Association o~
corporation to engage in the business of the fumigation of houses and the
extermination of insects and rodents, for profit or otherwise, or at all,
with out first having secured a license to engage in such business, in ,
accordance with the provisions hereof.
S.ec. 3.
That the license fee for engaging in the business of fumigation
and extermination ·within the City of Lubbock shall be $25.00 per annum.
Sec. 4.
No license shall be granted or issued under or in accordance
with the provisions of this ordinance, unless and u n til the applicant for
said license shall have executed a bond with good a nd sufficient sureties
~ in the sum of $1000.00, payable to the City of Lubbock for the use of u

any and a ll persons who may sustain any damage or legal injury by reason
of or on account of the exercise of the privileges conferred by the pro-
visions of this Ordinance, and said bond shall be conditioned for the
faithful performance of all the requirements of the Health ordinances,
rules and regulations of the City of Lubbock, relating to the fumigation
of houses and extermination of insects and rodents, and for the indemni-
fication of any and all persons wh o may sustain any damage, loss or
injury by reason of or on account of the exercise of the privileges
conferred by the provisions of this Ordinance.
Sec. 5.
Any person, firm, As sociation or corporation who shall violate
the provisions of this ordinance shall, upon conviEtion thereof, be
fined in any sum, not to exceed $100.00.

Sec. 6
The lack of any suitable ordinance providing for the regulation
of the fumigation of buildings and the extermination of insects and
rodents, and the further fact that the manner in which said fumigation
and extermination of insects and rodents are now being carried on,
create a menace to the public health, and endanger the property of the
general public, and make it imperative that this Ordinance be passed
as an emergency measure, a.nd the same shall become effective from and
after the date of its passage and publication, and it is so ordered.
