HomeMy WebLinkAboutOrdinance - 617-1939 - Closing Streets And Alleys In Blake Subdivision - 05/25/1939\ I 05-25-193.9 ORDINANCE NO. 617 ot.P -ce -\..9::3.9 AN ORDINANCE CLOSING THE STREETS AND ALIEYS IN THE BLAKE SUB- DIVISION OF KcCRUMMENS SECOND ADDITION TO THE CITY OF LUBBOCK, LUBBOCK t:OUNTY, TEXAS: WHEREAS, on January lst, 1910, A. c. Blake, purdbased tro.m Cbas. L. Pickett and E. B. Penney, Blocks 93, 94, 101 and 102 in the Me- Crummens Second Addition to the City of Lubbock, Lubbock County, Texas, by deed dUly recorded in Vol. 29, page 533, Deed Records of Lubbock County, Texas; and WHEREAS, in said deed, a vendor's lien was retained by the grantors, Chaa. L. Pickett and E. B. Penney, to secure the payment of $10?1.43, evidenced by two vendor's lien notes payable to L. M. KcCrummen at Lubbock, Texas, Note No. 1 for the principal sum of $8?3.28 and Note No. 2 for the principal sum of $177 .15; and "ll •• WHEREAS, thereafter on April 22nd, 1910, A. c. Blake platted and subdivided Blocks 93, 94, 101 and 102, McCrummens Second Addition to the City of Lubbock, Lubbock County, Texas, and filed a deed of dedication and plat tor record on May 7th, 1910, and the same is now duly recorded in Vol. 26, at page 140, Deed Records of Lubbock County, Texas, and in said deed of dedication, designated said Addition as the Blake Subdivision of McCrummens Second Addition to Lubbock, Texas, axti did in said deed of dedication dedicate all streets and alleys in said Blake Subdivision to the PUblic; and thereafter, on May 9, 1910, conveyed all of said property, ex- cept Lot 13 in Block 1, to J. L. Blake by deed recorded in Vol. 34, page 82, Deed Records or Lubbock County, Texas; and WHEREAS, on December 18, 1912, in cause No. 445 in the District Court of Lubbock County, L. M. McCrummen am The Lubbock State Bank re- covered judgment _for the title and possession or said Blocks 93, 94, 101 1nd 102 against Chas. L. Pickett and others, including A. c. Blake and J. L. Blake, which judgment 1s of record in Vol. 34, page 135, Deed Records of Lubbock County, and by reason thereof the superior title to said property was never vested in said A. c. Blake and/or J. L. Blake; and WHEREAS, after said judgment the owners of said property never - recognized or adopted the dedication aDi plat of same as the Blake Sub- division, but conveyed the same as Blocks 93, 94, 101 and 102,·McCrummen'a Second Addition; and ) WHEREAS, thereafter J. s . Echols became the owner of said Blocks 93, 94, 101 and 102 of the McCrummens Second Addition to the City of Lubbock, and did on February 14th, 1924, file a plat and deed of dedication, subdividing said Blocks 93, ·94, 101 and 102 of McCrummens Second Addition -_ to the City of Lubbock, and designating said Subdivision of said Blocks as "College Park Addition to the Town of Lubbock, Lubbock County, Texasu, and did in said deed of dedication dedicate to the public for public use all streets and alleys shown by said plat of College Park Addition to the Town of Lubbock, Lubbock County, Texas, said plat and deed of dedication now being of record in Vol. 86, page 611, Deed Records of Lubbock County, Texas; and WHEREAS, none of the streets and alleys of the Blake Subdivision were ever actually opened and used by the public; and WHEREAS, said streets and alleys as laid out and platted in the College Park Addition to the City of Bubbock, Lubbock County, Texas, are actually laid out and opened, and as laid out and opened, are now used by the general public; and v~REAS , the City Commission is of the opinion and finds that it is to the best interest of the general public and to the best inter- est of all property owners in said College Park Addition to the City of Lubbock, Texas, that all of said streets and alleys as laid out and platted in the Blake Subdivision of MCCrummens Second Addition to the City of Lubbock, should be closed. THEREFORE, BE I T ORD AINED BY TH E CITY COMMISSION OF THE CITY OF LUBBOCK, TEXAS, That all streets and alleys of the Blake Subdivision of the McCrurnmens Second Addition to Lubbock, Texas, as the same were platted, laid out and dedicated on April 22nd, 1910, and shown by deed of dedication now of record in Vol. 26, page 140 of the Deed Records of Lubbock County, Texas, be and the same are hereby closed. It is not intended by the passage of this Ordinance to in any way ~ffect, disturbe or change the streets and alleys in College Park Addition to the Town of Lubbock, Lubbock County, Texas, as the same were laid out, platted and dedicated on February 14th, 1924, and this ordinance shall never be construed as closing, changing or affecting any of the streets and alleys in said College Park Addition to the Town of Lubbock, Lubbock County, Texas; and it is so ordered.
