BE I'l1 ORDAINED BY THE CI'I'Y COMM:IS-.)ION OF THE CITY OF LUBBOCK: SECDDN 1. It shall be unlawful for any person to use a bicycle propelled wholly or in part by musclar power upon any of the streest ·or public highways of the City of Lubbock, without first obtaining from the City of Lubbock a license therefor. SECTION 2. The City Secretary is hereby authorized and dir-ected to issue upon the written application, bicycle licenses which shall be effective from January 1st, 1939, to and including December 31st, 1940, and thereafter said license shall be issued for the calendar year commencing on the first day of January of each of said Calendar years, and ending on the 31st day of December·of said calendar year. Said licenses when issued shall entitle the licensee to oper-ate such bicycle for which said license has been issued, upon all of the streets, alleys and public highways exclusive of the sidewalks thereof, in the City of Lubbock. SECTION 3. The City of Lubbock shall provide each year metalic ' license plates and seals, together with registration cards and holders therefor, said metalic license plates and registration cards having ""\ ., '~v numben thereof, and the number of the metalic license plate found thereon, i'f any. All persons engaged in the business of selling new or second-hand bicycles are hereby required to make a daily report to the Police _; Department, giving a list of all sales made by such dealer, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and frame number thereof, and the number on the metalic license plate attached thereto, if any. SECTION 5. It shall be the duty of each person who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the City Secretary the registration card issued to such person as licensee thereof, together with the name and address of the person to Whom said bicycle was sold or transferred, and such report shall be made within 5 days of the date of said sale or transfer. It shall be the duty of the purchaser o~ the transferee of such bicycle to apply for a transfer of registration thereof ~ithin 5 days of said sale or transfer. SECTION 6. It shall be unlawful for any person to wilfully or maliciously use, destroy, mutilate or alter the number on any bicycle frame license pursuant to this Ordinance. SECTION 9. Should any section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of said Ordinance shall hot be affected thereby. SECTION 10. All Ordinances and parts of ordinances in conflict he~eb~ herewith are hereby repealed, but it istexpressly provided that this Ordinance shall not repeal any ordinance or parts of ordinances not in conflict herewith, and it is so ordered.
