The Ordinance tallows: H... •• and, WHEREAS, the City Engineer prepared rolls or statements ~or the improvements in each District or Unit, showing the amounts to be assessed against the various parcels o~ abutting property, and the owners thereot, and shewing other matters and things; and same were examined by the City ¢ommission and approved, and a time and place was fixed tor a hearing to the owners o~ such abutting property, and to a~l others in any wise inter- ested, and due and proper notice was given, and suoh hearing was had and held at the time and place fixed therefor~ to-wit • on the 24th day ot Karch1 , A.D. 1938, at 1:30 o'olook ~R., in the Commission Eerom In the City of Lubbock, Texas, and at~ hearing all desiring to be heard were tully and fairly heard, and evidence was received and considered and all protests and objections made were considered, and said hearing was in all respects held in the manner provided and req_uired by the Charter and law in :force in this City and by the proceedings ot the City with reterenoe to such matters, and the following protests were made concerning the improvement in the units indicated, namelY: And all objections and protests made were tully considered and said hearing was continued troDL day to day and from ti.IJLEI to time until this date, and the City Commission having fully and fairly heard al~ parties making any protest and all parties desiri ng to be heard, and having fully considered all matters presented tor consideration, and having tully considered all of the evidence, and all pertinent and proper matters, is ot opinion that the following disposition should be made ot such protests and objections, and that assessments should be made as herein ordained: .... ' ........ THEREFORE, BE IT ORDAINED BY THE CITY CCI4MISSION OF THE CITY OF IDBBOCK, TEXAS: THAT, I. All protests and obJections, whether herein specifically mentioned or not, shall be and the S8III3 are hereby overruled and the said hearing, with respect to each and all of said Units, is hereby closed. II. Tbe City Commission, from the evidence, finds that the assessments herein levied shall be made and levied against the respective parcels of property abutting upou the said portions of streets and alleys, and avenues, and against the owners ot such property, and that such assess- ments are right and proper and established substantial justice and equality and uniformity between the respective owners and respective properties, and between all parties concerned, considering benerits re- ceived and budens imposed, and fUrther finds tbat in e,~h case the abut- ting property assessed is spedially benefited in the enhanced value thereof by means ot the improvement in the Unit upon which the particular property abuts, and for which assessment is levied, in a sum in excess of the assessment levied against same by this ordinance, and turther finds that the apportionment of the cost of t ·he improvements is in accord- ance with the proceedings heretofore taken and had with reference to such improvements and is in all respects valid and regular. III. That there shall be and is hereby levied and assessed against the parcels of property hereinbelow mentioned and against the real and true owners thereof, whether such owners be correctly named herein or not, the suma of money below mentioned and itemized shown opposite the description of the respective parcels of property; the descriptions of such property, and several amounts assess- ed against same • and the owners thereof, being as follows: Copy Engineer's Rolls here. IY. + Tbat the assessments so levied are for the improvements in the particular Unit upon which the property described abuts, and the assessments for the improvements in one Unit are in nowise :related to or connected with the illlprovements in any other Unit, and in making assessments and in holding said hearing the amounts so assessed tor illlprovements in one Unit have been in nowise attected by any tact in euy wise connected with the improvements, or the assessments therefor, or any other unit. v. Tbat the several sums above mentioned assessed against said parcels of property, and against the real and true owners thereof', and interest thereon at the rate ot six (O) per cent per annum, together with reasonable attorney's fees and costs ot collection. if incurred. are herebr declared to be and made a lien upon the respective parcels of' property against wbich the ~e are assessed, and a personal liability and charge against the real and true owners thereof, whether or not such owners be correctly named herein, and such liens shall be and constitute the first enforceable olaim against the property assessed,and shall be a tirst and paramount lien, superior to all other liens and · claims, except State, County and Municipal taxes, and the sums so assess- ed shall be payable as follows, to-wit: In five equal installments, the first payable on or before ten (10) days after the completion and acceptance by the said City ot tbe improvements in the unit upon which the particular property abuts; the second installment due on or before one rear from said date of completion and acceptance, the third installment due on or before two y·ears tram said date ot completion and acceptance, the rourth instal- lment due on or before three years trom said date of completion and acceptance, the titth installment due on or before four years tram said date of completion and acceptance; and such assessments shall bear interest from the date ot such canpletion and acceptance at the rate of' 6~ per annum, payable annually with each installment, so that upon completion and acceptance of the improvements in a particular unit assessments against the property abutting upon such completed and accepted unit shall be and beoome due and payable in such installments, and with interest trom the date of such completion and acceptance, provided that any owner shall have the right to pay off the entire assessment, or any installment tbareot, before maturity, by payment of principal and accrued interest, and provided fUrther that it default shall be made in the payment of any installment promptly as the same matures, then the entire amount of the assessment upon which such default is made sball, at the option ot City of Lubbock, or its assigns, be and became immediatelf due and payable, and shall be collectible with reasonable attorney's tees and costs of collection, it incurred. VI. The vi ty of Lubbock sball not in aey manner be liable tor the pay- ment ot any sums bereby assessed against any property and the owners thereof, but said City ot Lubbock shall look solely to said property, and the owners thereof, tor payment of the sums assessed against the respective parcels o~ property; but said ~ity shall exercise all ot its lawfuli>owers to aid 1n the enforcement and collection ot said liens and assessments, and it default shall be made in the payment ot any assessment, collection thereof shall be enforced either by sale of the property by the Tax Collector and Assessor of the City ot Lubbock as near as possible in the manner provided tor the sale ot property tor tbe non-payment of ad valorem taxes, or, at the option ot City ot Lubbock, or its assigns, payment ot said sums shall be enforced by suit in any court having jurisdiction. r ,. ;. VII. For the purpose ot evidencing the several sums assessed against the said parcels ot property, and the owners thereat, and the time and terms ot payment, and to aid in the entordeme:at thereof', assignable certi- ficates shall be issued by the City ot Lubbock upon the completion and acceptance ot the work in each Unit ot improvement as the work in such Unit is completed and accepted, which certificates shall be executed by the Mayor in the name of' the City, attested by the City ~ecretary with the corporate seal, and shall be payable to City of Lubbock or its assigns, and sball declare the said amounts and the time am terms of' pa.yDEnt and rate or interest and dlte of oanpletion and acceptance of the improvements for which the certificate is •issued, and shall contain the name ot the owner as accurately as possible, and the description or the property by lot and block number, or front teet thereof, or such other description as may otherwise 1dentif7 the same, and it the said property shall be owned by an estate, then to so state the description thereof' as so owned shall be suf'ficient, or if' the name of the owner be unknown, then to so state shall be suft'icient, and no error or mistake in describing aQY property, or in giving the name of any owners. shall in any wise invalidate or impair the assessment levied hereby or the certificate issued in evidence thereof. The said certificates shall turther provide substantially that it default shall be made in the payment ot any installment of principal or interest when due, then, at the option ot City ot Lubbock, or its assigns, the whole of the said assessment evidenced thereby shall at once become due and payable, and shall be collectible with reasonable attorney's fees and costs of' collection, itincurred. And said certificates shall set torth and evidence the personal liability ot the owners of such property and the lien upon such property, and shall provide in effeot it default shall be made in the payment thereof the same may be enforced either by the sale ot the property by the Tax Collector and Assessor ot the City ot Lubbock, as above recited, or by suit in any court having jurisdiction. The said certificates shall further recite in ettect that all proceedings with reterenoe to making said improvements have been re~arly had in compliance with the law in torce and proceedings ot the City of' Lubbook, and that all prerequisites to the fixing of' the lien and olaim ot personal liability evidenced by such certificates have been regularly done and performed, which reel tale shall be e vidence of tba matters and taots so recited, and no further proof thereof shall be required 1n any court. And the said certificates may have coupons attached thereto in evidence ot each or any of the several installments thereof, or they may have coupons tor each of the first tour installments, leaving the main certificate tor the fifth. Said oertif'ioates may turther provide substantially that the amounts pay- able thereunder may be paid to the Collector of Taxes of the City, who shall issue his receipt therefor, which receipt shall be evidence of such payment upon any demand tor the same, either by virtue ot the said certificate or a~ c ontract to pay the same entered into br the property owners, and that the Collector of Taxes will deposit all sums so received by him :forthwith with the City Treasurer, and upon the payment of any installment with interest upon the surrender of the coupon therefor, receipted in f'Ull by said Contractor, or other holder of said certificate, tbe City Treasurer shall pay the amount so collected and due thereon to said Contractor, or other holder, which coupons so receipted shall be the Treasurer's Warrant tor payment. And the said certitioates shall further provide in erteot that the City of Lubbock shall exercise all ot its lawful _,,powers, when requested so to do by the holder ot said certificates, to aid 1 n the e nf'or cement and c oll eat ion thereof, and said certificates may contain other and further recitals pertinent and appropriate thereto. It shall not be necessary that said certificates shall be in the exact form as above set torth, but the substance and eff'eot thereot shall suffice. '• VIII. The assessments levied by this ordinance ~or the improvements in each Unit are altogether sep~te and distincj from assessments in eaoh and every other unit. The assessments tor i.Jn.provements in one unit are in nowise affected by the improvements in or the assessments levied tor the improvements in acy other unit, and in making and levying assessments the oosts o~ the improvements in each Unit, the benefits by means or the improvements, and all other matters and things with reference to the improvements in eaoh Unit, have been considered and determined altogether without reterenae to aey such matters in acy other unit, and the omission ot the improvements in acy unit shall in nowise attect or .impair tbe validity ot assessments tor the improvements in any other unit. The omission ot improvements in any particular unit in front ot aey property exempt tram the lien ot such assessments shall in nowise affect or impair the validity or assessments against other ~roperty in that unit. IX. No mistake, error, invalid! ty, or irregularity in the name or any property owner, or tbe description of any property, or the amount of' any assessment, or in any other matter o» thing, shall in any wise invalidate or impair any assessment levied hereby or any certificate issued, and any such mistake , error, invall d1 ty', or irregular! ty, whether in such assessment or in the certificate issued in evidence thereof, may be corrected at any time by the City. x . . All assessments levied are a personal liability and charge against the real and true owners or the premises descri11ed, notwithstanding such owners may not be named, or may be incorrectly named, XI. The present condition ot said streets and alleys endangers health and safety, and it is necessary that said improvements be proceeded with w!Lile the weather will permit, and the construction of' said improvements is being del.ayed pending the taking ettect or this ordinance, and such facts constitute and create an emergency, and an urgent public necessity requiring that this ordinance be passed.
