RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
for and on behalf of the City of Lubbock, Public Works Contract No. 17502 for Sanitary Sewer
Manhole Rehabilitation as per RFP 23-17502-TF, by and between the City of Lubbock and
Infrastructure Rehabilitation USA, Inc. of Shreveport, LA, and related documents. Said
Contract is attached hereto and incorporated in this resolution as if fully set forth herein and
shall be included in the minutes of the City Council.

To the Honorable Mayor and City Council City of Lubbock, Texas (hereinafter called Owner)
Ladies and Gentlemen:
The Offeror, in compliance with your Reyuest for Proposals for construction of the referenced project, having
carefully examined the plans, specifications, inshuctions to offecors, notice to offerors and all other related
contract documents and the site of the intended work, and being fami(iar with all of the conditions
surrounding the construction of the intended project including the availability of materials and labor, hereby
intends to furnish all labor, materials, and supplies; and to consteuct the project in accordance with the plans,
speciiications and contract documents, within the time set forth therein and at the price stated. The price to
caver al( expenses incurred in performing the work required under the contract documents.
PROPOSED CONSTRUCTION TIME:
1. Contractors proposed CONSTRUCTION TIME for completion:
TOTAL CON5ECUTIVE CALENDAR DAYS: 124 (to Substantial Completion)
TOTAL CONSECUTIVE CALEND.AR DAYS: 150 (to Final Completion)
(not to exceed 180 consecutive calendar days to Substantial Comaletion / 210 consecutive calendar days
to Final Completion).
Offeror hereby agrees to commence the work on the above project on a date to be specified in a written "Notice
to Proceed" of the Owner and to substantially comptete the project within 180 Consecutive Calendar Days
with final completion within 210 Consecutive Calenda�• Days as stipulated in the specification and other
contract documents. Offeror hereby further agrees to pay to Owner as liquidated damages in the sum of 200 for
each consecutive calendar day after substantial completion and liquidated damages in the sunn. of $1.00 for
each consecutive calendar day after fina[ completion set forth herein above for completion of this project, all
as more fully set forth in the General Conditions of the Agreement.
Offeror understands and agrees that this proposal submittal shall be completed and submitted in
accordance with instruction number 28 of the General Instructions to Offerors. Offeror understands that the
Owner reserves the ��ight to reject any or all proposals and to waive any formality in the proposing. The
Offeror agcees that this proposal shall be good for a period of six 60 calendar days after the scheduled
closing time for receiving proposals.
The undersigned Offeror hereby declares that he has visited the site of the work and has carefully
examined the plans, specifcations and contract documents pertaining to the work covered by this proposal,
and he furthec agrees to commence work on the date specified in the written notice to proceed, and to
substantially complete the wock on which he has proposed; as provided in the contract documents.

surety company, payable without cecou�•se to the order of the City of Lubbock in an amount not less than five
percent (5%) of the total amount of the proposal submitted as a guarantee that offeror will enter into a contcact,
obtain a(1 required insurance policies, and execute all necessary bonds (if required) within ten {10) days after
notice of award of the contract to him.
Enclosed with this proposal is a Cashier's Check or Certitied Checic Enclosed with
this proposal is a Cashier's Check or Certified Check for
N/A Doltars ($ N�A ) or a Proposal Bond in the sum
of Ninetean thousand iwo hundred ninety five Dollars ($ 19,295 ), which it is agreed shall be
collected and retained by the Owner as liquidated damages in the event the proposal is
accepted by the Owner and the undersigned fails to execute the necessary contract
documents, insarance certificates, and the required bond (if any) with the Owner within
ten (10) business days after the date of receipt of written notification of acceptance of said
proposal; otherwise, said check or bond shall be returned to the undersigned upon
demand.
Offeror understands and agrees that the contract to be executed by Offeror shall be bound
and include all contract documents nnade available to him for his inspection in accordance with
the Notice to Offei•ors.
