HomeMy WebLinkAboutOrdinance - 549-1936 - Regulating Photographers And Solisitors Obtaining Permit - 04/09/1936:-.--'"' ·- 04-09-l93lP ORDINANCE NO. 549 04-2.3~ 1.93U> AN ORDIN.l\.NCE REGULATIN-G PHOTOGRAPHERS AND SOLICITORS THEREFOR, RE- ~UIRING SUCH PERSONS TO OBTAIN A PERMIT BEFORE ENGAGING IN SUCH OC ~UPATION, IMPOSING A FEE THEREFOR AND PROVIDING A PENALTY FOR VIO- LATION THEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: Section 1. No photographer shall hereafter engage in the business or occupation of taking photographs within the limite of the City of Lub- bock, Texas, where a fee may be charged therefor, nor shall any per- son solicit business for any such photographer taking or offering to take photographs within said city limits where a fee may be charged therefor, without first obtaining a permit from the City Tax Collector authorizing such photographer, or the person soliciting business for such photographer to engage in such business in the City o f Lubbock. Section 2. No such permit shall be issued by the City Tax Collector un- til such person applying therefor shall have first paid a fee of $10.00. Section 3. Such permit shall authorize the person obtaining same to en- gage in such business in the City of Lub' ock for a period of one year from its date. §~~· Any person violating any of the provisions of this ordi- nance shall be punished by a fine not exceeding the sum of $100.00, and each day that such ordinance or any part thereof may be violated shall be c onstrued as ~ separate offense, and punishable as such. section 5. This ordinance is desi gned and passed for the purpose of regulating such occupations and persons as may be required under its terms to obtain a permit before engaging in such business, and is designed as a protection to the citizens of Lubbock to prevent a fraud and imposi- t ion upon them by irreEponsible photographers and the agents or solici- tors and representatives of such photographers wh~ave heretofore in many instances p erpetrated a fraud or frauds upon the citizens of s a id city, and is n ot designed as an oc c upation tax at all but purely in the nature of a regulation of such persons for the benefit of the Public, and to protect against fraud and imposition. Section 6. If any portion or part of this ordinance be declared in- valid for any reason, same shall not affect the validity of the remain- ing portions of said ordinance, but same shall remain in fUll force and effect.
