ORDINANCE CLOSING BEARING AND LJ:VYIWG ASSESSMENTS FOR A PART OF 0 (/)

THE COST OF IMPROVING A PORTION OF AVENUE Jf AND SUNDRY OTHER
STREETS, AVENUES AND ALLEYS IN THE CITY OF LUBBOCK, TEXAS, AND
PROVIDmG FOR 'IHE COLLECTION OF SUCH ASSESSMENTS, AND FOR THE
ISSUANCE OF ASSIGNABlE CERTIFICATES IN EVIDENCE THEREOF, .AND
DECLARING AN EMERGENCY:
WHEREAS, the City l.iommission of the City of Lubbock, has heretof'ore
ordered that the below mentioned portions of streets and alleys in said
City be improved by raising, grading and filling, and by installing
concrete curbs and gutters on Units Noa. 6~, 66, 6?, 68, 69, ?0, 71,
72, '73, '74, 75, '76, '77, 78, 79, 80·, 81 9 82, and p&lVJblg .!.W1:~h t triple
coura& asphalt surface treatment (Inve~ted Penetration ~ype) on a Six
(6) Inch Compacted Caliche Base, together with necessary in~ldentala
and appurtenances, all as provided in the specifications prepared by
the City Engineer, now on file with said ~ity; and arrangement for the
making and construction of such improvements was entered into with City
of Lubbock, said streets, avenuea and alleys being as follows, to-wit:
Avenue N, fran its intersection with the North Property Line of
Broadway to its intersection with the South Property Line of Main
Street, known and designated as Unit or District No. 65.
13th Street, from its intersection with the East Property Line of
ATenue U, to ita intersection with the East Property Line of
Avenue V, known and designated as Unit or District No. 66.
13th Stree t, from its intersection with the West Froperty Line of
Avenue V, to its intersection with tht East Property Line of
College AvenUe, known and designated as Unit or Vistrict No. 67.
Avenue u, from its intersection with the South. Property Line of
Broadway to its intersection with the North Property Line of 13th
Street, known and designated as Unit or District No. 68.
Avenue u, from its intersection with the ~outh Property Line of
13th Street, to its intersection w!th the North Sroperty Line o~
14th Street, known and designated as Unit or District No. 69.
Avenue Y, from its intersection with the South Property Line of
16th Street, to its intersection with the North Property Line of
19th Stree t, known and designated as Unit or ~istrict No. 70.
Avenue L, from its intersection with the South Property Line of
13th Street, to its intersection with the North Property Line of
14th Street, plus 2/3 of 14th Street intersection, known and
designated as Unit or District No. 71.

Commission and approved, and a time and place wae fixed for a hearing to

The City Commission, from the evidence, finde that the aeseesmente
herein levied shall be made and levied against the :teape ative parcels ot
property abutting upon the said portions of streets and alleys• and
~Tenues. and against the owners of auoh property. and 'tbat such a saesa•
menta are right and prOper and established substantial just1C6 and equality
and un1fo~1ty between the respect1Te owners and respective propertiea,
and between all parties concerned• oona1der1ng benetita receiTed and
burdens imposed, and fUrther finds that in each case the abutting property
assessed ts specially benefited in the enhanced Talue thereof by meane
of the improvement in the Unit upon which the particular property abute,
and for wh~ aseesemen\ ie levied, in a sum in eaceae of the aesessmen~
leTi ed against -aame by this ordinance, and fUrther finds that the
appbrtionment of the cost of the tmpro•eme nte ie in accordance with tbt

particular Unit upon which the property described •-uta. and the
aaaesaments tor the improvements in one Unit are in nowiae related toe
or connected w~th the lmproTements in any other Unit, and in maktna
aas,ssmente an~ in holdins said hearing the amounts so aeaesaed for
improvements in one Unit have been 1n no wise affected by any fact in
any wise connected with the improvement&, or the aeeesaments therefor,
or any other unit.

thereon at the rate of lltx (a) per oent per annum• together wt tb. reaaon-
able attorney•• fees and costs of collection, if incurred, are hereby

against wbioh the same are assessed, and a personal liability and oharp
against ~he real and true owners thereof, whether or not auoh owners
be correctly named herein, and such liens shall be and constitute the
first enforceable claim against the property aaaeaeed, and ehall be a
first a nd paramount lien, superior to all other liens and clatms, exoept
State, co unty and municipal taxes, and the aume so assessed shall be
payable aa follows. to-wits

completion an4 acceptance of the improvements in a particular unit
assessments against the prope rty abutting upon such completed and
accepted unit shall be and become dUe and payable in such installments,
and with interest from the date of auch completio n and acceptance,
provided tbat any owner shall have the right to pay off the entire
assessment, or any installment thereof, before maturity, b7 payment ot
principal and accrued interest, and provided further that if default
ahall be made in the pavment of 1n7 installment promptly ae the same
matures, then the entire amount of the a s sessment upon whloh euch
default ie made shall, at the option of City of Lubbock, or its aasigna,
be and become immldiately due and payable• and ehall be oolleotible
with reasonable attorney' a fees and costs ot c·olleotion; 1-t incurred.
VI.
The Ctty of Lubbock shall not in any manne~ be liable for the pa7•
ment ot any sum• hereby assessed against any property and the owners
thereof, but said City ot Labbook eball look solely to aaid propert71 and the owners thereot. for payment of the euma aeeeeeed against the
reepective paroele of propert71 but said City shall exerolee all of ita
lawtul powers to aid in the enforcement and collection of eaid liens
and assessments, and if default shall be made in the pay.ment of an7
aseeasment 1 collection thereof shall be enforced either by sale of the
~roperty by the Tax Collector and Assessor of the ~1t7 ot Lubbook as
near ae possible ln the manner provid_. for the aale ot property for the
non,payment of ad valorem taxes, or, at the option ot City of Lubbock,
or ita assig na, pa,ment of s a id aums shall be enforced by euit in any
court having jur1ad1ct1on.

For the pUzpose ot evidencing the several sums assessed against &he
said parcels of property, and the owners thereof, and the time and ter.me
of pa,ment, and to aid in the entoroem e n~ thereof, assignable oertl•
fioa.tes shall be issued by the City o t Lubbock upon the completion and
acceptance of the work in each Unit of improvement ae the work in auoh
Unit is completed and accepted, which oert1t1oatea •-all be executed b7
the Kayar in the name of the City, attested by the City Secretary with
the corporate seal, and shall be payable to City or Lubbock or ita
aeelgna, and shall declare the said amounts and the time and ter.ms ot
paym e nt :m d rata of interest and date of eompl e tion and aooeptance ot
the improvements for which the certificate ia iasued, and shall contain
the name of the owner as accurately as p ossible, and the description ot
the property by lot and block number, or ~nt teet thereof, or such
other description as may otherwise identify the aame, and if the said
property ahall be owned by an estate, then to . eo state •he description
thereof as ao owned shall be suftic1ent, or i f the name of the owner ·
be unknown, then to so state shall be sufficient, and no error or mistake
in describing any property, or in g1Ting the name of any owners, ahall
in any wise iUTalidate or impair the as s essment leTied hereby or tbe
certificate issued tn evi.dence thereof.
The aa1d oertlftaates shall further provide substantially that it default
shall be made in the p ayment of acy inatallme~t of principal or interest
when due, then, at the op tion of City ot LQbbook• or ita assigns, the
whole of the said asee a sment eTidenoed thereby shall at onoe become due
and payable, an d shall be collectible wlth reaeonable ·attontey•stlee &84
coats of collection, it incurred. And eaid oertificates shall set
forth and evidence the personal liability of the owners of such property
and the lien upon such p~operty, and shall proTide in effect if default
shall be made 1n the payment thereof the same may be enforc~d e1 tber by
the sale of the property by the Tax Collector and Asse asot of the City
ot Lubbockt as above recited, or by auit in any court having Jurisdiction.
The said certificates shall further recite in etfect that all prooeedinga
with referenc e to making sa1d improvement s haYe been r egularly bad in
compliance with th6 law in force and proceedlngw of the ~ity ot Lubbt~,
and that all prerequisites to the fixing of the lien and clatm ot pereoD&l
liability eTidenced by such certificates have been regularly done and
perfor.med, which recitals shall be evidence of the matters and facts eo
rec1 ted• and no further proof thereof ehall be required in any c ·ourt.
And the said cert1t1catee may have coupons attached thereto in evidence
of eaoh or any of the several installments thereot, or they may have
coupons for each of the first four inetallmente, leaTing the main
oe~\1tioa'e for the fifth.
Sa14 certificates may fUrther provide substantially that the anounts pay-
able thereunder may be pald to the Collector ot Taxesof the City, who
shall 1esue his receipt therefor. which receipt shall be eTidence of
such payment upon a~y demand for the same, either by virtue of the eai4
certificate or any contract to pay the same entered into by the property
owners, and that the Collector of Taxes will deposit a l l sums so reoe1Ted
by him forthwith with the City Treasurer, and upon the payment of any
ins,al~ent with interest upon the ~urrender of the coupon there for,
receipted in full by said Contractor, or other holder of said certificate,
the City Treaaurer shall pay the amount eo collected and due thereon to
said Contractor, or othe~ holder• which aoupone ao receipted shall be
the Treasurer's warrant tor payment. And the aa1d certificates shall
fUrther provide in effect tha t the City of Lubbock shall exeroiee all ot

VIII.
The asaeeamenta levied by this ordinance for the tmprovemen~a in each
Unit are altogether separate and distinct from aseeesmenta in each and
every other unit. The assessments for ~prove.mente 1n one unit are
in nowtee affected by the improvements in or the assessme nts levied for
the tmprovementa in any other unit, and in making and levying aesesaDente
the coste of the improvements in each Unit, the benefits b.Y means of
the improvements, and all other matters and things with reference to the
improv~ente in each Unit, have been considered and determined altogether
without reference to any suoh matters in any other unit, and tbe omission
of the improvements in any unit shall in nowise affect or impair the
validity of assessments for the improvements in any other unit. lbe
omission of i mp rovements in any particula r unit in f~at of aDf propertr
exempt from the lien of such assessments shall in nowise atf•ot or impair
the validity of aaeeasments against other property in that unit.
IX.
Bo mistake, er~r. invalidity, or irregularity in the name Qf &hY
property owner, or the description ot any property, or the amo ~nt of aa7
aeaesSBent, or in any other matter or thing, shall in any wise inYall•
date or impair any assessment levied hereby or any certifica te iaaued,
and any such mistake, error, invalidity, or irregularity, whether in auob
assessment or in the cert1f1c ~t e issued in evidence there of, may be
corrected at any time by the City.
x.
All assessments levied are a personal liability and charge against
the real and true owners of the premises described, notwithstanding such
owners may not be named, or may be inoorteotly named.
XI.
The present condition ot said streets and alleys endangers health
and safety, and it is necessary that said improvements be proceeded with
while the weather will permit, and the construction of said improvemenis
ie bein g delayed pending the taking effect of this ordinance, and eucb
facts constitute •nd oreate an emergency, and an ungent public necessity
requtr1ng that the rules providing for ordinances to be read more than
one time, or at more than one meeting, be suspended', and that thia
ordinance be passed as and take effect aa an emergency measure, and
such rules are accordingly suspended and this ordinance is pas sed aa
and shall take effect and be in force aa an emerg ency measure, and shall
be in force and efreet immediately f~m and after ita paeeag e.
