HomeMy WebLinkAboutOrdinance - 534-1935 - Issuance Of Permit And Payment Of License Fee For Purchaser Of Motor Vehicles - 08/08/1935{ I :. .. _) '" .r ~ r ~ ""'- ORDINANCE NO. ~ oe-oe-\9a.s AN ORDINANCE REQUIRING THE ISSUANCE OF A PERMIT AND THE ~ ~ PATI~T OF A LICENSE FEE, AND PROVIDING FOR THE FURNISH- ING OF REPORTS OF THE PURCHASER OF MOTOR VEHICLES OUTSIDE OF LUBBOCK COUNTY, TEXAS, AND BROUGHT INTO THE CITY OF LUBBOCK FOR RE-SALE BY ALL PERSONS, FIRMS AND CORPORATIONS HEREAFTER ENGAGING IN THE OCCUPATION OF BUYING AND SELLING USED MOTOR VEHICLES, AND EXEMPTING CERTAIN BUSINESSES, AND PROVIDING A PENALTY FOR THE VIOLATION, AND SETTING FORTH AN EMERGENCY. \I J BE IT ORDAINED by the City Commission of the.City of Lub- . bock, Texas:- 1. That from and after the passage of this ordinance any person, firm or corporation, before engaging in the .-occupation of buying for the purpose of re-sale, and of selling used automobiles, trucks, or other motor vehicles within the corporate limits of the City of Lubbock, such person, firm or corporation shall first apply to and obtain from the City Secretary of the City of Lubbock a per- mit or license to engage in such occupation for a period of one year. Such permit shall be in writing, dated, numbered, contain the name of the licensee, the place where such occupation is to be carried on within the City, state that it is for a period of one year, and be officially signed by the City Secretary, with the City seal attached. The City Secretary shall keep a duplicate portfolio record of such permit . - 2. The annual license fee for such occupation shall be the sum of Five Hundred and no/100 ($500.00) Dollars, and such sum shall be payable to the City of Lubbock in full at the time the li·cense is issued, and before such occupation is pursued or carried on. -1 - I , .-... 0 3. Such person, firm or corporation, from and after the beginning ·of such occupation within the corporate limits of the City of Lubbock, shall thereafter furnish to the Chief of Police of the Cit.y of Lubbock a list of all used motor vehicles brought into the corporate limits of the City of Lubbock for sale from any point outside of Lubbock County, Texas, and such report shall con- tain a fUll description of such motor vehicles, including the name of the manufacturer, model, engine number, and license number, and the name and address of the person whom ~ such motor vehicle was purchased. 4. This ordinance shall n~~ to .nor affect any per--~ sons firms or cor_'Qorations who are ~cr~o~'B~~v - ~co~~~~~~~ ~ePly e&gaged in the City of Lubbock as a dealer or agent selling new automobiles, and who, in connection with such automobile agency or dealership business, trades for and sells used motor vehicles, nor shall it apply to such persons, firms or corporations who have been regularly and in good faith engaged in the bUsiness of buying and selling second hand motor vehicles within the corporate limits of the City of Lubbock continuously Sa• 'he w:ud: ue (1!1) It tl 1• ari6••~ preceding the passage of this ordinance. 5. Any violation of this ordinance shall iUBilediately .. work a forfeiture of the license or permit issued in accordance with the provisions hereof, and no portion of the license fee paid therefor shall be refunded. 6. Any person, firm or corporation violating any of the provisions of this ordinance shall be punished by a fine of One Hundred and no/100 ($100.00) Dollars for each violation, and the pursuit of such occupation on each and every day without a permit, as provided for herein, shall constitute a separate offense and be subject to punishment as such. -2 - '• 7. The fact that large numbers of used motor vehicles are expected to be brought into the corporate limits of the City of Lubbock within a Ye~y short time for the purpose of being sold within said corporate limits to the citizens of Lubbock and other persons who transact their business within the City of Lubbock, and that such condition will increase the use of the streets, sidewalks and alleys within the City, and add to the burdens of traffic and police regulations, and will increase the burdens of police depart- ment in searching for and locating lost and stolen automobiles, and that those who purchase such motor vehicles have no adequate means of satisfying themselves as to the title of such motor vehicles creates an emergency and involves the immediate preservation of the public peace, property and safety, requiring the immediate passage of this ordinance as an emergency measure, and the suspension of rules providing otherwise, and this ordinance is passed to take effect immediately, and the paragraph setting forth this emer~ency shall be co~idered as a p'eamble to this ordinance, as re-q_uired by the Charter of the City of Lubbock.
