AN ORDIIANCE PROVIDING THAT MILK PRODUCERS AND
MILK DISTRIBUTORS SHALL BE REQUIRED TO OBTAIN PERMITS BEFORE
ENGAGING I N THE PR ODUCTION AND DISTRIBUTION OF MILK AND MILK PRO-
DUCTS, AND PRESCRIBI NG ADDITI ONAL REGULA!CIO NS RELATING TO THE
ISSUANCE AND REVOCATION OF SUCH PERMITS Br THE CITY HEALTH OF-
FICER OF LUBBOCK, AND PROVIDING A PENALTY FOR TEE VIOLATION
THEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF LUBBOCK, TEXAS s
SECTION I
Yermits: It shall be unlawful for any person, firm,
association or corporation to bring into or receive into the
City of Lubbock, for sale, or to sell or offer for sale, there-
in, or to have on hand,any milk or milk product, excepting evap-
orated milk, condensed milk, condensed skimmed milk, powdered
Whole milk and powdered skimmed milk, who does not possess an
unrevoked permit from the City Health Officer of the City of
Lubbock, and on whose vehicles and in whose place of business
there does not appear in a conspicuous place 1 placard showing
the perm1t number in figures at least three inches high and
one and one-half inches wide.
Such a permit may be revoked b1 the City Health or-
fleer upon the violation by the holder of any of the terms of
this or any other health ordinance of the City of Lubbock, pro-
vided that the holder of such permit shall, after complying
with such revocation, have the right of appeal to the City
Commission.
Before any permit provided for under this ordinance
shall be issued to any milk producer or distributor, a certtf•
1cate of compliance with the code under which the milk producers
and distributors are operating ip~~bboek, Texas, shall be pre-
,,> v sented to the City Health Of.ficer;j\6~rore issuing a permit to
the applicant shall satisfy himself that the person, firm, as-
sociation or corporation seeking such permit has complied with
all o.f the requirements o.f such code, whether the same be op-
erated under the supervision and direction or the Department
of Agriculture or the Federal Go vernment.
In the event a person, firm, association or corpora-
tion operating under a permit issued by the City Health Officer
prior to the promulgation of a code by either of the agencies
named 1n the preceding paragr~h, shall violate any of the
terms, cond1t1ons and requirements prescribed in such code,
the City Health Officer shall, upon certificate or non-com-
pliance on the part of the person, firm, association or cor-
poration hold1ng such permit from the agency supervising the
production and distribution of milk, cancel and revoke said
permit until s certificate ot compliance is issued showing
compliance with such code.
All permits issued hereunder shall be posted in a
conspicaous place on the premises of the holder of such per-
mit.
SECTION II
Any person, firm, association or corporation, or
the agents, servants or officers of any firm or corporation,
found guilty of violating any of the provisions ot this ordi•
nence shell be fined in &nJ sum not to exceed Fifty ($50.00)
Dollars.
SECTION III .
The duties end powers or the City Health Officer
end the City Milk Inspector shall be the same with respec~ to
enforcement of all milk ordinances.
SECTION IV
This ordinance shall not repeal any former ordinen•
ces, but shall be cumulative thereof, end shell take effect
and be in full force and effect from end after the date of its
passage end publication as required by law.
