BE IT ORDAINED BY THE CITY COMMISSION OF 'l'HE CITY OF LUBBOCK. SECTION 1. That Ordinance }fo. 170 of the City of Lubbock be amended so as to hereafter read as follows t ~ .,. SECTION 2. Each and eve ry person, firm, association of persons, or corporations, before engaging in the business of purchasing what is commonly known as junk or any second hand articles, goods, wares or merch andise of whatever kind or character, shall apply for and procure a: l!cense from the City Secreta ry_ of the <.a ty of Lubbock author·iz:ing him, they or it, to engage in eu~h business, and the license shall be effective for one year from date o·r issuance, and shall be con- spiciouely posted in the place of business or such junk dealer or second hand dea ler,' and for which the applicant~sliall pay a fee of one dollar. SECTION 3. ' Each and every dealer enumerated in Section 2 hereof shall keep a well bound book in which h~ shall enter the date of each purchaee, a description of the ar&icle purchased• the name, age and address of the person offering such article for sale, whether or not he is personal- ly acquainted with the seller, and if he is not acquainted with the seller he ahal~ have him identified and the person furnishing such identification shall be required to sign his n~e on said records, and the purchaser shall not accept identification from any person not per- sonally known to him; and the description of the article entered on said book shall be sufficient to identify the s~e from other articles o-r like kind and character, and such entry shall be made immediately upon purchase. SECTION 4. Said record shall be always open for inspection by the peace officers of the City of Lubbock, and the managers, owners and emplayees of such junk dealer or second hand dealer shall, upon demand made by such officer, point out to him aay article which ie entered upon such record. ~ach owner, manager or employee shall, upon demand made at any time, permit such peace officer to inspect any ·article or articles then in poss!ssion of such dealer. SECTION 5. Any person, fir.m, association of persona. or corporations~ violating any portion of this Ordinance shall, upon conviction, be fined in any sum not leas than Ten ~ollars nor more than One Hundred Dollars. SECTION 6. The fact that this Amendment of Ordinance No. 170 is for the protection of the public peace and property, and the further fact that certain second hand dealers are in the habit of purchasing second hand articles without first ascertaining the true ownership thereof, creates an emergency and an imperative public necessity that the Constitutional Rule requiring ordinances to be read on three several days be suspended and said rule is hereby suspended, and that this Amendment to said Ordinance take effect and be in force from md after its passage, and it is so Ordained.
