If:::]..!:/' AN ORDINANCE ORDERING AN ELECTION IN THE 1CITY OF LUBBOCK, TEXAS, TO BE HELD ON THE 2. S. DAY OF ~ 1932, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFI~RS OF SAID CITY OF LUBBOCK, TEXAS, FOR ADOPTION OR REJECTION PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF LUBBOCK, DESIGNATING THE TIME AND PLACE AT WHICH SAID ELEC• TION IS TO BE HELD, AND APPOINTING PRESIDING OFFICERS THEREOF. WHEREAS, on the 1z8 day of ...w~~~~--' 1932, a resolution was duly passed by the the City of Lubbock, Texas, provi~ing tor notice ot its in• tention to pass an ordinance sub~itting amendments to the existing charter of said city; ana, , WHEREAS, notice of the intention to pass such ordinance was duly given by publication in the manner and tor the length of time required by law; and, WHEREAS, the charter of said city bas not been altered, changed or amended tor more than two 7ears prior to this dates· THEREFORE, BE IT ORDAINED BY THE CITY CO:MMIS• SION OF THE CITY OF LUBBOCK, TEXAS: Thet Lubbock, Texas, for the purpose SECTION I a special ~t1on be held!~it7 ot on the ~a7 ot t!J.: I~ 19321 o~ submitting to th ~litied voters of said city for adoption or rejection the following proposed amendments to the existing charter of the City of Lubbock:\ \ \ , AMENDMENT NO • l t: " To amend the first paragraph ot Section 22 of / Article 2 of Chapter 1 of the City Oha»ter of the City ot I ! I, Labbock, Texas, so that said paragraph sball hereafter read as tollowsl •section 22. There is hereby created and es- tablished a Park Commission to be composed of five (5) mem- bers, all residents of' the City of' Lubbock, and who shall be of'f1c1alty designated as Park Commissioners of said city. Baid Park Co~ssioners shall hold their offices for terma or one, two, three, four and five years, respectively, ·and until their successors are appointed. The general control and supervision of the parks within the City of Lubbock, now or hereafter to be acquired, is hereby vested in said Park Commission and all funds set apart tor said parks, sub- ject to the approval of the governing authorities, shall be under the control or said Co~as1oners, any three of whom shall constitute a quorum tor the transaction of business of said Park Commission." The other three paragraphs of said Section 22, Article 2, Chapter 1, of said City Charter shsll remain un- changed. AMENDMENT NO • 2:: To amend Section 1 of the Board of City Devel- opment amendment adopted at special election held December 10, 1925, so tbat said Section 1 shall hereafter read as follows' "Section 1::· Board of City Development. The Commission shall appoint what shall be known and deaignat• ed as a 'Board of City Development', which aball be composed of fifteen members, who shall serve without compensation, and may prescribe the qualifications and duties or suoh board and shall annually appropriate one-halt mill on the one dollar ($1.00) valuation of the taxable property in the City of Lubbock from the seneral fund ot said city to supe port the work of such board and annually levy a tax sutfi• c1ent to raise said amount." The other seotipna of aaid amendment to the City Charter resarding the Board of City Development shall remain unchanged. AMENDMENT NO. 3~ To amend Section 24, Article 2 of Chapter 1, or the City Charter added by amendment adopted April 1, 1930, so tnat se1a section shall hereafter read as follows: "Section 24. Sale of Electric Light System and Water System and Plant and also 81 acres of land, to be voted on by people. The City of Lubbock shall not sell the municipal electric light system, or water system and plant, or the 81-acre tract of land purchased by the City from J. J.. Wilson out ot Survey Eighteen ( 18) Block A, Lubbock County, Texas, unless such sale is authorized by a two-thirds vote of thequalified tax-paying voters at a general or special election held in accordance with law." SECTION II That the poll places and presiding officers of said election shall be respectively 8S followst Said election shall be held in the office of the City Recorder on the first floor of the City Hall or Lubbock, Texas, and 91-f ~. ,A 'lf l;~ -----and c.£/}, ~ are hereby appoint• ed 8S judges to hold said election. SECTION III That said election shall be held under the pro- visions of the Statutes or the State of Texas and the City Oharter of said City of Lubbock, and all persons qualified to vote in said city under the laws of this State regulat- ing general elections shall be allowed to vote therein. SECTION IV That the manner of holding said election shall be governed by the general laws of the State of Texas reg- ulating general elections, when not in conflict with the proVisions of the law referred to in the last preceding section. "Ballot~• AMENDMENT NO • l Do you vote to amend the first paragraph ot Sec- tion 22 of Article 2, Chapter 1 of the City Charter of the City of Lubbock, Texas, by amending said paragraph so as to increase the number of Park Commissioners from three (3) to five (5)~ and fixing their terms of office at one to five years, respectivelyW Answer: Yes No AMENDMENT NO. 2 Do you vote to amend Section 1 of the Board of City Development amendment adopted at special election held December 10, 1925, by amending said section so that the City Commission shall annually appropriate one-half mill on the one dollar ($1.00) valuation of the taxable property in the City of Lubbock from the general fund of said city to support the work of such board and an- nually levy a tax sufficient to raise said amountT Answer:: Yes No AMENDMENT NO. 3 Do you vote to amend Section 24, Article 2 of Chapter 1, of the City Charter of the City of Lubbock, Texas, by amending said section so as to provide that the City of Lubbock shall not sell the municipal electric light system, or water system and plant, or the 81-acre tract of land purchased by the City from J. A. Wilson out of Survey Eighteen {18), Block A, Lubbock County, Texas, unless such sale is authorized by a two-thirds vote of the ~alified tax-paying voters at a general or special election held in accordance with law?. Answer~ Yes No SECTION VI All voters desiring to vote for the adoption of the proposed amendments shall permit to remain on their ballot with respect to such proposed amendment which they desire to have adopted the word nYesn, end those desiring ·- .. - to vote against the adoption of such proposed amendments shall permit to remain on their ballot with respect to such proposed amendment which they desire to have reject• ed the word "No"• SECTION VII The City Secretary shall at once mail copy of such proposed smendmentsto each qualified voter or the City of Lubbock, Texas, as appear on the tax collector's rolls for the year ending January 31, 1931. SECTION VIII A~ substantial copy of this ordinance shall be sufficient notice of said election and thirty dayst notice of the ttme and places of holding said election shall be given by publishing such notice once each week for five weeks, the date of the first publication being not less than thirty full days prior to the date of the election. SECTION IX This ordinance shall take effect and be in force immediately from end after its passage. Passed and approved first reading this~ day ot ~·, 1932.
