F. RY. CO. IN THE TOWN OF LUBBOCK WHILE THE CROSSING OF AVElruE H OVER THE SAME RIGHT- OF-WAY IS CLOSED TO THE PUBLIC FOR PUBLIC USB AND TRAVEL; DECLARING THAT THIS ORDINAHCE SHALL BECOME NULL AND VOID WHEN THE UNDERPASS ON A VENUE H UNDER THE RAILROAD TRACKS Oli SAID RIGHT OF WAY IS ACCEPTED BY THE CITY AND OPENED TO THE PUB- LIC FOR PUBLIC USE AND TRAVEL; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COlnU:SsiON OF THE CITY OF LUBBOCK, TEXAS: (1) That that part of Texas Avenue which crosses the railroad right-of-way of the P. & s. F. Ry. Co. in the town of Lubbock, while the crossing of Avenue H over the same right-of-way is closed to the public for :public use and travel, be opened to the public for public use and travel. (2). This ordinance shall become null and void when the underpass on Avenue H under the rail road tracks on said right-of-way is accepted by the City and opeped to the public for public use and travel. (3) The fact that the public crossing where Avenue H intersects said railroad right-of-way is dangerous to the public safety, and same being closed temporarily, creates an imperative demand and necessity for the opening of that part of Texas Avenue which crosses said right-of-way, requiring that this ordinance take effect from and after its passage, and it is so ordered. ~/Passed and approved first reading this ~~~day of ~, 1930. 1ft~ Passed and approved second reading this /l~day of ~eb~ry, 1930. ;12J7/ ntfz_. . .
