AN ORDINA NCE amending sections, one, Five and Six of Ordi-
nance No. 378, passed June 17th, A. D. 1927, providing for the depth
at Which service pipes shall be laid underneath the ground; providing
for a bond to secure against damages to persons and property occasioned
by the installation and construction of gas, oil, water, electric,
telephone and public utility lines, conduits ana cables, and providing
for method of discharge of liability on such bond, and declaring an
emergency:
BE IT ORDAINED BY THE CITY OF LUBBOC K: That Section One
of Ordinance No. 378, and ~ect1ons Five and Six of said Ordinance
No. 378, passed June 17th, 1927, be so amended as that the same shall
hereafter read as follows:
Section 1: All gas, oil, water, electric, telephone ani pub-
lic utility mains, feeders and conduits laid in the streets and alleys
shall be laid with the top of the pipe at least two (2) feet below the
surface of the ground, and all gas service pipes from such mains to
the property lines shall be laid with the top of such pipe at least
sixteen (16) inches below the surface of the ground, ani all of such
pipes shall be so laid as not to interfere in any manner with water
pipes or mains, sanitary sewers, storm sewers of said city, or pipes,
cables or conduits of other utilities already installed. At street
intersections, street and alley intersections, or any other place where
it is likely that the street grade will be lowered, the mains, service
pipes, etc., shall be laid at a greater depth than two (2) feet, as
directed by the City Engineer.
Section 5: The grantee shall be responsible for all damages
to water mains, water service connections, sanitary sewers, storm
sewers of said city, or pipes or conduits or other utilities, caused
by the construction of the work of installing the mains or any part of
the distribution system, and shall pay for the cost of repairing same.
Section 6: None of the aforesaid work shall be commezded or
done untii a written permit is first obtained from the City, ani a bond
is given the City in such sum as the City may fix to cover all damages
that may be done by such work, and conditioned for the compliance with
all city ordinances;

Section 8: In view of the fact that there~is work of con-
struction and alteration of the aforesaii nature pending, and that the
preservation of the streets, public property ani public utilities, and
the maintenance of the public welfare and convenience require immediate
legislation, creates an emergency and public necessity, necessitating_
that this Aot take effect and be in force from and after its passage,
and it is so ordered.
