Ill ~~ d -u a, k co •n -0 lJ 0 I I 0 00 -:,., -0 .... oD ORDINANCE NO• 3 7.£ AN ORDINANCE PROVIDING CONSTRUCTION DETAILS FOR LAYING GAS, OIL, WATER, ELECTRIC, TELEBHONE AND PUBLIC UTILITY LIN.ES, CONDUITS AND CABLES IN THE TOWN OF LUB~OCK, TEXAS; RE 1,UIRING TRENCHES TO BE REFILLED AND THE MANNER THEREOF; REQUIRING PAVING, 'fflEN CUT, TO BE REPAIRED WITH STEEL REINFORCING; RE~UIRING THE FILING OF PLATS BEFORE WORK STARTSJ PROVIDING FOR DAMAGES FOR INJURIES; FIXING A PENALTY FOR VIOLATION; AND DECLARING AN EMERGENCY: BE IT ORDAINED BY THE CITY CO:MlUSSION OF THE CITY OF LUBBOCK, TEXAS, THAT SECTION 1: All gaa, oil, water, electric, telephone and public utility mains, feeders, service pipes and conduits laid in the streets and alleys shall be laid with the top of the pipe at least ( 2') two feet below the sur'face of -the grouni, and so laid as not to interfere in any manner with water pipes or mains, sanitary sewers, storm sewers, of said City, or pipes, cables, or conduits of other utilities already installed. At street intersections, street a.nd alley intersections, or any other place where it is likely that the street grade will be lowered, the mains, senise pipes, etc., shall be laid at a greater depth than (2')/feet, as directed by the City Engineer. SECTION 21 All trenches shall be backfilled as soon as the pipe is laid and tested. The backfilling shall be done in such a manner so that the street will be in as g ood condition as before such work was done. If at any time after the pipes and ma.ins have been laid, the trench settles below the natural grades of the streets and alleys, the trenches shall be refilled and brought to the proper grade, at the expense of the grantee. The City or City Engineer may make such further requirements as may be deemed necessary to place and keep the streets and alleys in as good condition as before. SECTION 3: In replacing paving which has been cut for trenching, the pavement shall be cut back and removed ror a width of two feet greater than the width of the trench cut, and the paving replaced with the same type of construction and :oaterials as removed, e x cept;that concrete base shall be 6 inches thick and reinforced with t" square steel bars at 12 inch centers across the trench and at 24 inch centers longitudinally; and under pavements on natural base, the surfacing shall be re- placed on a concrete base as described above. All patch work shall be done under the direction of the City Bngineer and shall be paid for by the grantee. SECTION 41 The Cit~ shall be furnished with four detail plats, approved by the City Engineer, before work starts, showing ;the size and exact location, of all the mains and the entire 'I/distribution system. SECTION 5: The grantee shall be responsible for all damages to water mains, water service connections, sanitary sewers, storm sewers, of said City or pipes or conduits of other utilities, caused by the construction of the \7 ork of installing the mains or any part of the distribution system, and shall pay for the cost of repairing same. SECTION,,87( Any person, firm or corporation, failing or refuafhg to comply with any of the foregoing re quirements ~hall be deemedguilty of a misdemeanor, and on conviction thereof shall be fined any sum not exceeding Two Hundred ($200.00) Dollars.~ SECTION£ In view of the fact that there is work of construction and alteration of ~he aforeaaid nature pending, and that the preservation of the streets, public property and public utilities, and the maintenance of the public wel- fare a.nd convenience, require immediate legislation, creates an emergency and public necessity, necessitating that this act take effect and be in force from and after its passage, and it is so ordered. ~ Passed, approved a~d adopted, this the/m day of .Tune, 1927. ,..... /) _,,, 0 %4-~ Mayor ~,1~2nc.-~ ' City Secretary
