ORDINANCE NO. 371
AN ORDINANCE DECLARING THAT :PART OF THE ALLEY BETWEEN LOTS
FIVE {5) AND TWENTY (20)• IN BLOCK ONE HU!IDRED TWENTY NINE
(129) OF THE ORIGINAL ~mm OF LUBBOCK, IN LUBBOCK COUNTY,
TEXAS, A MENACE, NUISANCE AND DANGER TO THE PUBLIC PEACB,
SAFETY AND WELFARE; QRl)jffi!NG SAME OLOSED; AND DECLARING A1l
EMERGENCY:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF LUBBOCK, TEXAS:
SECTION ONE: That part of the alley between Lots
Five (5) and Twenty (20), in Blook One Hundred Twenty Nine
(129) of the original tow~ of Lubbock, in Lubbook County.
Texas, is hereby deolared to be a menaoe, nuisance and dan-
ger to the publio peace, safety and welfare.
SECTION TWO : That part of the 811 ey des a rit bed
above is hereby permanently alosed, end the public use tnereof
is hereby barred and forbidden forever.
SECTION THREE: The ao t of any adjacent 9Wner in
building on, over or across said alley shall oe upon the con-
dition that the party so building shall construct anl main-
tain a subway with floors and walls of au.oh dimensi ona, ma-
terial and work:ne.mbip as shall be required by the oi ty for
the installation, maintena.noe and operation of all public
and pr:ft..vate utilities lines that may be erected or laid upon
such property.
SECTION FOUE: The fa.ct that that JS, rt of said alley
is a nuisance, menace and danger to the public peace, ae.fety
and welfare oreates an<l emergenay and imperative publio neoeas-
ity requiring that pa.rt of said alley to be alosea. imnediately
and permanently, and that this aot take effect and be enforced
fran and after its pe.aaage; and it is so ordered.
