ORDINANCE
AN ORDINANCE RE QUIRING PAYMENT OF LICENSE FOR
ENGAGING IN THE BUSINESS OF OR EXHIBITING OR PERFORMING IN ANY
OF THE FOLLOWING LINES OF BUSINESS: CIRCUSES, CA.'t{NIVALS, TENT
SHOWS, RODEOES, WILD WEST SHOWS, MEDICINE SHOWS, PUBLIC DANCES,
WRESTLING MATCHES, BOXING MATCHES, SKATING RINKS, DOMINO PARLOR~
ETC; DECLARIUG SAME UNL;. .. WFUL WITHOUT PAYMENT OF LICENSE FEEOR
RECEIVING WRITTEN PERMIT THEREFOR: AND FIXING PENALTY THEREFOR,
MAKING CERTAIN EXCEPTIONS AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY C1F Lu:BBOCK, TEXAS:
Section 1: That on and after January 1, 1926, there shall be
collected a lidense fee from every~erson, firm~; corporation
engaged in any of the following kidS o~lines o~businesss
CIRCUSES shall pay in advance for each d~'a perform-
ance a license fee of $150.00 for a three ring circus, $10~00
for a two ring circus and $50.00 for a one ring circus.
CARNIVALS, ETC.: A license fee of $50.00 per day for
each day' a performance shall be paid by each carnival, rodeo or
wild west show.
TENT SHOWS: Tent shows where any kind of comero,
vaudeville or theatrical performance or exhibit is shown shall
pay a license fee of Jl5.00 for each day's performance or exhibi~.
MEDICINE SHOWS AND OPEN AIR PERFORMANCES OR EXHIBITS
outdoors where goods are sold in connection with open air enter-
tainments, shall pay a lacense fee of $25.00 per day for each
day's performance;
PUBLIC DANCING, ETC: All persona, firms or corpor-
ations conducting or operating a public dance for pay where the
right to participate in any form is char ged for, a license fee
of $25.00 for each day's performancd; provided that dances
'!Conducted in~fire proof buildinru( classed as such under the
d city building code and dances conducted under the supervision of
college authorities at college stude nt dormitories shall not be
construed to be public dances for pay within the meaning ~
this section on public dancing.
ACROBATIC PERFORMANCEs·: All persons, firms or cor-
por&aions who shall operate or conduct any wrestling or boxing
na.tch for pay where an admission ie charged or paid for shall
pay a license fee of $25.00 for each day's performance or exhibit.
SKATING RINKS: All persons, firma or corporations
operating or conducting skating rinks, nine or ten pin alleys,
shall pay a license fee of $5.00 per day for each day.
DOJIINO PARLORS: All persons, firms or corporations
conducting or operating public domino parlors, whether far pay
or not, shall pay a license fee of $10.00 per day.
SECTION 2: It shall be unlawful for any person, firm or corpor-
ation to engage in ~ line of business aforesaid without
having paid the license fee in advance for each of aaid days
or for each of said perfommances, and made written application
to City Secretary stating time and place of conducting such
business.
SECTION 3: It shall be unlawful for any person, firm or cor-
poration to engage in such business where a license fee is
required without having received a written permit from the
City Secretary.
SECTION 4 : Any person, firm or corporation violating any of
the provisions hereof shall be deemed guilty of a misdemeanor
and on conviction shall be fined any sum not exceeding one
hundred (tloo.oo) dollars.
SECTIOI 5: Should any ciause, sentence or provision of this
ordinance be held illegal or unconstitutional, such finding
shall not inva lidate the remainder of this ordinance.
SECTION 5: The fact that the City of Lubbock is in urgent need
of regulation of the conducting of such businesses, createes
an emergency and an imperative public necessity that the rule
requiring ordinances to be read at more than one meeting af the
City Commission be suspended, a ni it is eo ordained, and this
ordinance shall take effect and be in force from and after its
passage and approva l.
