Al?PLIANCES, FllXTUEES AN D APPARATUS IN ALL BUILDINGS AND STRUCTUR ES OF GAS CONSUM- ERS, AND THE INSTALLATION, CONSTRUCTION, RECONSTRUCTION, ADJUSTMENT AND REPAIR THEREOF, FROVIDED FOR BONDS TO BE GIVEN BY THOSE WHO DO SUCH WORK, PROVIDING FOR PEBMI TS AND PROVIDING . PENALTIES AND DEClAR- ING AN EMERGElfCY •. BE IT ORDAINED BY THE CITY COMMISSION OF THE 1 CITY OF LUBBOCK, TEXAS: . . . SECTION 1: That the City Flumbing Inspector and his assistants be and they are hereby authorized. empowered and directed to super- vise all gas piping. app liances, fixtures and apparatus whether now or hereafter existing, placed in or in any manner connected in any build- ing or tent, or structure of any character, whether used for business or reaidenoe purposes, in the City of Lubbook, and the installation, construction, reconstruotion, adjustment and repair thereof and to see that all the rules and regulations of said City of Lu 1bock With respect thereto are properly complied with and to inspect all such gas piping, appliances, fixtures and apparatus and the installation, construction, reconstruction, adjustment or repair thereof whenever and so often as they shall deem it desirable or necessary, and to do so in order to prevent fires, accidents or injuries to persona or property, and the said City Plumbing Inspector and his assistants be and they are hereby authorized, empowered and directed to oause all such gas piping, appliances, fixtures and apparatus and the in~tall­ ation, construction, reconstruction, adjustment and repair thereo~$o be such as not to cause fire or accident or injury to life or prop- erty and aoy and all euoh gas piping, fixtures and apparatus now existing as well as the installation, oonstruction, reconstruction, ad- justment and ~epair thereof shall be subject to the foregoing inspec- tion and supervision. And -it is further ordained that no gas app liance, fixture or apparatus, either for heating, illuminating or h~t water heating, be installed until type of said gas appliaoce, apparatus or fixture has been approved by the City Plumbing Inspector or his assistant. SECTION 2: That th8 said City Flumbing Inspector -and his as- sistants shall 'be subJect to the order and direction of the Mayor and City Commission of the City of Lubbock, and they are hereby vested with full authority to enter any building or premises or structure, subways, or other places, either publio or private, at any time in the discharge of their duties, and to pass upon and deoide upon questions arising under the provisions of this ordinance or any ord- inance hereafter ~seed or any rules and regulations already adopted or hereafter adopted by the Mayor and City Commission relative to any such gas piping, appliances, fixtures or apparatua or the installa- tion, construction, reconstruction, adjustment and repair thereof or relative to the materials used therein, whether the same be the orig- inal construction and erection or in any alterations or repairs thereof. SECTION 3: No person, firm or corporation shall enter upon the installatio~, construction, reconstruction, or repair of such gas piping appliances, fixtures or apparatus o~ any ohange thereof, (nor shall any such person, fir.m or oorporation undertake for any other person, firm or corporation, the adjustment thereof) until the said individual, fir.m or oorporation shall have secured a license as hereinafter provided and shall have executed and deliYered to the City of Lubbook a g2od and suffioient bond in the sum of Two Thousand .t!'ive Hundred (,2,500.00) Dollars having thereon two or more sureties, approved .by the Mayor and City Commission of the City of Lubbock, one of which said sureties shall be a surety com- pany duly authorized to do business 1n the State of Texas, condi• tioned for the faithful performanoe of all such work entered upon or contracted for in strict acoordance and compliance with the terms, requirements and provisions of this ordinanoe and such fur• ther and future ordinanoea of the City of Lubbook as may be here- after passed. Said bond shall be further oonditioned that suoh person, firm or corporation shall without additional cost to the person for whom the work is done, remedy any defeat therein due to faulty workmanship or incorrect oonstruotion or due to the faulty material furnished or used by suoh person, firm or corporation, and that such person, firm or corporation shall reconstruct or repair suoh work to the satisfaction of the City Flumbing Inspector of the City of Lubbook at any time within one year after the oon- struction, repair or installation thereof, and after forty eight (48) hours notice from the City Plumbing Inspector to reoonstruot or repair the same. In the oase of gas leaks of any nature, upon order of said City Plumbing Inspector or any of his assistants, the gas shall be cut off immediately from the premises forthwith without notice and likewise the said City Plumbing Inspector or any af his assistants may in the interest of the public safety order the gas supplied to any oustomer shut off immediately without notice. The said bond shall for all the foregoing purposes be in foroe for one year after any suoh work in the installation, oonstruction, re- construction or repair of such gas piping, is done and one recovery shall not exhaust said bond but said bond shall be a continuing obligation against the sureties thereon until the entire amount thereof ahall have been exhausted. In case the bond therein pro- vided for shall be decreased on account of any recovery which may be obtained or arising out of the violation of any oonditiona of the same, the Mayor and City Commission shall re~uire, upon notice of such fact, an additional bond to be given by such person, firm or corporation in accordance with this ordinance in any amount suffi- cient when added to the unexpired amount of original bond to be at all times equal to the sum of $2,500.00. The City of Lubbock, may for itself or for the use and benefit of any person injured or dam- aged by reason of failure to repair any defective gas piping or any defective installation, construc t ion, reconstructi on or repair thereof or for the failure or refusal by any pers on, firm or corpor- ation to pay any of ·the fees required by this ordinance, maintain suit on said bond in any court having jurisdiction the reof or suit may be maintained thereon by any person injured or d~aged by reason of any breach of any of the conditions of said bond. The bond here~ in required shall expire on the first day of January, next following the date of ap proval of suoh bond by the Mayor ru1d City Commission and thereafter on the first day of January a new bond in form and substance as herein re~uired shall be given by any such pers on, firm or corporation to cover all such work as sh~ll be done during the year beginning on such January lat. m1.. -L .. _ ...... -•• ---... _ -~ the event of the dissolution of any company or partners h ip holding such license, the member retaining such licens e shall be re Quired to renew the bond herein provided for before doing uny such work provided herein. The person, firm or cor- poration obtaining such license shall pay to the City Secretary of the City of Lubbock, the sum of Thirty-Six ($36.00) Dollars as an ann ual licens e fee theDfor, provided that if said license is issued after January of any year the license fee s hall be the proportionate remaining part of such year computed from the first day of the month in which the same is issued. The same with four or five mixers, lt inch pipe; for larger iostal- lations, approval or size sh a ll be secured from City Plumbing Inspector. Air mixers must not be placed in air tight ash boxes, but where a free blow of air can reach them at all times. By the Term ~oPENING" as used in this ordinance, is meant the point where the pipe comes through the floor or baseboard to the appliance. Service pipe from main to Building must be 1!" inside diameter or larger,no pipe less than 1" inside diameter will be permitted on horizontal run. Vertic~l pipes or risers in two and three story buildings must be l'' inside diameter or larger, depending on the number of fires or openings. The use of street Ells, Bushings or Plugs is prohibited. Use as few elbows as possible; elbowe not absolutely necessary will be con- demned. When impossible to get through an obstruction such as a beam offset the pipe rather than use elbows. For large buildings the plans for piping should be taken up di- rectly with the Uity Plumbing Inspector before any pipe is installed. All piping for fixtures with a.great number of burners on them wa11 have to be made larger accordingly. ~as is never to be sup p lied from a smaller pipe to a larger one. ~ Pipe must be free from obstructions. White lead or other joining material should be used sparingly as not to clog the pipe and only the male threads doped. ihe riser must be extended to a point within 18 inches of the propoaed location of the meter, and to right of same at least 20 inches above floor. Meter should not be located near furnaces or ovens; locked iD compartme nts or placed in any other position where they will be ac- cessible or liab le to injury. Under no condition will a fitter or plumber or other person disconnect any meter, connect to or disturb piping between main and meter. When, to aocomodate different tennants, one or more meters are desired in a given building, the gas supplying company will set as many meters as there are separate customers but unless for specific reasons and where special permission is granted by the Plumbing In- spector a separate service line must be laid from the property line to each meter. Union and valves must not be used in concealed work, but long threads, if necessary, should be used. Long runs of horizontal pipe shoUld be firmly supported at short -intervals by metal fasteTners to prevent sagging. All branch outlet pipes should be taken from the sides or tops of ~ing lines, never from below. Bracket pipes should be run from below when practicable. Dro~ extensions must be supported with at least three supports, one under ~ipe at drop, one across drop between aap and ell or bend and one half-way between drop and main pipe. All supports are to be 3 x l or larger lumber. Two au~~orts must be used f'Dlr all bracket extensions, one directly under riaer .ell and one half-way between ell and main supply pipe. - ~ouse pi~es should be eo run and covered as to be readily accessible. No oast iron fittings smaller than 3 inches are to be used. No individual, firm or corporation shall enter u~on the instal- lation, construction or reconstruction of any work provided for herein until a permit has been issued by the Plumbing Inspector. covering each installation or addition to be made, and when re- quired by seid City Plumbing Inspector plans and specifioations for the proposed work must be. filed with him before the ~ermit is granted or during the progress of said work; provided, however, the City Plumbing Inspector may issue a general permit to any individual, firm or corporation owning or controlling any building for a term not exceeding three (3} months from the date thereof, authorizing minor alterations or changes, but shah permit shall be revocable. No permits will be required for the repair or adjust- ment of gas piping appliances, fixtures and apparatus. SECTION 5. When the plumber or fitter has completed the system of pi~ing and has fUll drop and bracket extensions and heat e r openings firmly and permanently fastened, he shall test the piping and if found tight file a written application for tests ·Wi-ttl the Oi ty Plumbing Inspector and the City Flumbing Inspector or one of his assistants will call and inspect. the piping and witness the te·st, and if the Oity Flumbing Inspector or such assistant findsthe piping tight and the sizes and work in accordance with the provisions of this ordinance, the City Plumbing Inspector or such assistant will issue and deliver proper certificate to such effect, The piping must be tight under a pressure of ten inches of mercury column or fifteen pounds air pressure. 'J:his test will be made before the fixtures are hung and appliances connected and -/ before the piping closed in. ~he use of gas fitter's cement for repatring leaks is strictly prohibited. All gas using appliances shall be connected up solid, llo rubber or metal tubing will be permitted. Any additional piping of outlets installed after a certifi- cate is granted must be reported for inspection and test, ·No gas fitter, plumber or other person doing work in any house or· structure shall conceal any of said gas piping until certificate of inspection is issued and inspection card attached to said piping. ~unning service lines under buildin~s nAtwggn "l --.-•• ' 1 Gas service linea sh~ll not be laid in the same ditch with water or sewer lines. If any person, firm or corporation shall £ail or refuse to remedy .any defects found by the Uity Plumbing Inspector or his assistan t s in any work, provided herein, within seventy-two hours after notice to do so. the City Plumbing Inspector Shall not issue any further permits to such person, firm or corpor a tion until said defects are r emedied; or if it is shown that said person, firm or corporation is incompetent to do such work, then the license o£ suoh person, firm or corporation shall be s~bject to for£eiture by the Mayor and City Commission. The Ma yor and Uity Commission may £or£eit the license of any person, firm or corporation for violation o£ any of the provisions of this ordinance or such £uture ordinance of the City of Lubbook as may herea£ter be passed; pro- vided, that the forfeiture of any such license sh a ll not in manner af£ect the liability of the pri.ncipal or sureties on th e bond af any person, firm or corpor a tion for any work herein pr ovided for previously done by any such )?e r son, firm or corporation; also, provided, that in t h e e v ent th a t the license of any person, firm or corporation issued under the terms of this ordinance is for- feited for a ny violation of this ordinance or other ord.inances of jh~ City of Lubbock, pertainin g thereto, said person, £irm or corporation sh a ll not b e gr an ted a nother license for the period of one year after the date of the canoellation of previous license. SEC 1.CION 7. Any and all gas piping, fixtures a n d e.ppara tus or material,.which may at any time become d.e£ective and in the opinion of the City Pl ur~bi rig Insp e ctor or his assis tan t s likely to c au se lea ks, fires or ~c cia ent a or t o e nj~~~er per~ons or p r operty, sl ~ll be condemned by the said City ?lumbing Inspector or his assistants and. when, in his opinion, it is deemed n e cessary in order to prevent suoh accid e nt or dti.Ilger, said City :Plumbiug I n sp e ctor,or his assis- tants, .. is hereby authorized to disconnect such go.s piping, appli- ances •. ·fixtures s.ncl apparatus, or to cause the service of gas to such consumers to be discontinued until the person or persons owning or using such gas piping, appliaQces, fixtures, apparatus or mater- ial shall cause the sao a to be put in safe condition and tested and approved by the City Plumbing Inspector. When any gas piping , appliances, fixtures, apparatus or materi a l of any nature whatsoeve r has been in a.ny maru1er diaoonnected and rendered inoperat ive by the City Flurnbing Inspector or the service discontinued, as set forth in the foregoing provisions, it shall be unlawful for any person or persons to in any manner reconnect the same or c ~use the same to be reconnected to any supply of gas or to use d the same as a part o£ any gae piping system until they have been put in safe condition and a certificate of acceptance has been issued by the City ~lumbing Inspector. No gas piping, appliances, fixtures or apparatus, or the installation, construction, reconstruction or repair thereof, for ~ which a permit is issued shall be put to use or connected to any supply of gas until inspected and accepted by the Oity Plumbing Inspector. All applications for inspection will be held at least twenty-four hours after the same afe filed. It is required that said individual. firm or corporation or his or ita representatives shall personally inspect every installation before a card for inspection is filed and that all work for which the inspection is asked shall be complete. Applications for re-inspeotion must be m~e out on new cards the s am e as the original application, stating whether the first, second or third inspection. T~!ephone or verbal requests will not be considered. When any gas piping, appliances. fixtures or apparatus is found .to have been installed without a proper permit or not in accordance with the provisions of this ordinance, the City Plumbing Inspector, or his assistants is hereby authorized and empowered to prevent any supply of gas thereto or to the consumer w1til such permit has been secured from the Oaid City Plumbing Inspector and suoh work inspected, and approved. I Application for inspection shall be filed with the said City Plumbing Inspector aud recorded in a book kept in the offioe for that purpose. A fee of One Dollar and Fifty Cents ($1.50) shall be charged for the first inspection and One($1.00) Dollar each for the second and third inspection on condemned installa tiona. Before any such gas piping, appliances, fixtures, or appar- atuB constructed or furnished under permits hereafter granted, shall be approved• or any certificate of acceptance of the same be granted, the said work must be complete, and in compliance with the provisions of this ordinance. Plumbers or gas fitters shall consult gas company for the location of meter before starting job. ~he plumbers or gas fitters shall be held responsible for any changes in meter risers installed in locations not authorized by gas company. SECTION 9. Any gas installation not especially covered by this ordinanoe .must be approved by the City Plumbing Inspec- tor. SECTION 10. All powers conferred by this ordinance upon the City Plumbing Inspector are hereby likewise conferred upon hia assistants and .such assistants and each of them may likewise exercise all such powers. SECTION 11. That any person, firm or corporation who ~-shall violate any of the provisions of this ordinance, or who shall fail to comply with the requirements of this ordinance, shall be fined in any sum not exceeding Twanty-($20.00) Dollars, and each and every day's continuance of any violation of .the provisions of this ordinance shall constitute and be deemed a separate offense. That in case of any such violation of the 7. 0 terms or provisions of this ordinance by any corporation the officers and agents actually in oharge of the business of suoh corporation or th e person or persona sctually performing the work for such corporation. shall be subject to the penalties herein provided. SECTION 12. An emerg e ncy is hereby de c lared to exist. · By reason wher e o it is necessary for the immediate preservation of the ~ublic peace, health and safety of the Citizens of Lubbock, Texas.
